HomeMy WebLinkAboutReso 1985-12270 Revised 12/4/85 RESOLUTION NO. 12270 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA AFFIRMING THE DECISION OF THE PLANNING COMMISSION AND THUS APPROVING CONDITIONAL USE PERMIT PCC-85-24 FOR A PARK AND RIDE USE The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, on September 25, 1985, the Planning Commission unanimously voted to conditionally approve PCC-85-24 for the use of 24 parking spaces at the Chula Vista Alliance Church located at the northeasterly corner of Telegraph Canyon Road and Paseo del Rey for a park and ride use, and WHEREAS, said Planning Commission approval is after a public hearing in which proponents and opponents of the project presented evidence to the Commission, and WHEREAS, staff believes it would be appropriate to recommend approval of the use upon the condition that the conditional use permit would be subject to review if complaints were received regarding noise, and WHEREAS, the City Council has reviewed the Negative Declaration issued on IS-85-49 which was adopted by the Planning Commission on September 25, 1985. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista hereby adopts Negative Declaration IS-85-49 which indicates that this project will have no significant environmental impacts. BE IT FURTHER RESOLVED that the City Council hereby affirms the Planning Commission's approval of conditional use permit PCC-85-24 with the following conditions: 1. A landscape plan shall be prepared in accordance with the City's Landscape Manual and shall be submitted for review and approval prior to the utilization of the site. -1- 2. Any complaints received regarding the noise level within the park-and-ride facility shall be cause for review and possible revocation of this permit. 3. Any signs proposed shall be subject to the approval of the City Planning Director to ensure compatibility with the adjacent residential area. 4. The parking lot shall open at 6:30 a.m. and close at 5:30 p.m. 5. Electrical wiring suitable for installation of outdoor lighting shall be stubbed into the site. BE IT FURTHER RESOLVED that approval is based on the following findings: 1. The park and ride facility will encourage ridesharing and a consequent reduction in commuter traffic and the consumption of fuel. 2. The facility will generate some minor increase in noise, but adjacent residents should be adequately buffered therefrom by existing slopes. Furthermore, a condition of approval has been added which will subject the permit to review and possible revocation if complaints are received regarding adverse noise impacts. 3. The use will be required to comply with all applicable codes and regulations, prior to the issuance of permits for the project. 4. The approval of this permit will facilitate energy conservation and improved traffic flow, both of which are encouraged by the Chula Vista General Plan. 5. The term of this conditional use permit shall be for two years.
