RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING AGREEMENT BETWEEN THE CITY OF CHULA
VISTA AND BENTON ENGINEERING INC. FOR SOILS INVESTIGATION
WOP~K P~EQUIRED FOR CONSTRUCTION OF DRAINAGE FACILITIES
BETWEEN "F" STREET AND "G" STREET NEAR WOODL~N AVENUE
AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGRE~4ENT
The City Council of the City of Chula Vista does hereby
resolve as follows:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chula Vista that that certain agreement between THE CITY
OF CHULA VISTA, a municipal corporation, and BENTON ENGINEERING
INC. for soils investigation work required for construction of
drainage facilities between "F" Street and "G" Street near Woodlawn
Avenue
dated the 20thday of August , 198 ~ a copy of which is
attached hereto and incorporated herein, the same as though fully
set forth herein be, and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor of the City of
Chula Vista be, and he is hereby authorized and directed to
execute said agreement for and on behalf of the City of Chula
Vista.
BE IT FURTHER RESOLVED that the City Council does hereby
authorize the expenditure of funds approved for construction of the
project at the time of award (project expected to be awarded
October 1, 1985).

THIS AGREEMENT is made and entered into this 20thday of August , 1985,
by and between the CITY OF CHULA VISTA, C~[[-IlrORNIA, a public corporation
(hereinafter referred to as "City"), and Benton Engineering, Inc.
(hereinafter referred to as "Soils Engineer"). '
NOW, THEREFORE, IT IS HEREBY AGREED by and between the parties hereto as
follows:
SECTION 1. That Soils Engineer shall perform a soils investigation between
"F" Street and "G" Street near Woodlawn Avenue and the MTDB
right-of-way for drainage improvements as described in attached
Exhibit A.
SECTION 2. TIME FOR COMPLETION OF WORK:
The Soils Engineer shall perform his work during construction of
the project.
SECTION 3. OWNERSHIP OF DATA, REPORTS AND DOCUMENTS:
The Soils Engineer shall deliver to the City, as the work is
completed, all reports of tests made, studies, reports, plans,
drawings, and all other materials and documents received by or
prepared by the Soils Engineer in the performance of this
Agreement; all such reports, studies, plans, drawings, and other
materials and documents shall be the property of the City.
SECTION 4. That the City shall perform as follows:
A. Furnish to Soils Engineer such records, and other documents
as are available and may be reasonably required by Soils
Engineer in the performance of the services hereunder.
B. Pay to Soils Engineer a fee in accordance with attached
Exhibit A .
SECTION 5. INDEMNITY:
Soils Engineer agrees to indemnity and save City and its agents
and employees harmless from any and all liability, claims,
damages or injuries to any person, including injury to Soils
Engineer's employees and all claims which arise from or are
connected with the negligent performance of or failure to
perform the work or other obligations of this agreement, or are
caused or claim to be caused by the negligent acts of Soils
Engineer, his agents or employees, and all expenses of
investigating and defending against same; provided, however,
that this indemnification and hold harmless shall not include
any claim arising from the sole negligence or willful misconduct
of the City, its agents or employees.

SECTION 6. That this Agreement may be terminated by either party hereto by
mailing written notice thereof to the other party.
IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be
executed on the day and year first hereinabove written.

Proposal for Field Inspection Services
"F" Street Drainage Improvement

Gentlemen:
This is to present, at your request, a proposal for providing soils engineering
inspection services during the excavation and installation of the new drainage
improvements for the "F" Street area of Chula Vista, California.
!~he charges for these services will be in accordance with our standard hourly
~tes in effect at the time our services are requested. It is understood that
,ne work will commence after July 1, 1985, therefore, the following hourly
rates will be applicable.
The field engineers that will verify the in-place density, strength and suitability
of subgrade and any field density tests needed to verify proper compaction would
be charged at the hourly, rate of $38.00.
The charges for staff engineers for the inspection of stability would be at an
hourly rate of $50.00 and for decisions relative to underpinning structures, the
charges for principal engineer, Philip H. Benton~, would be at the consulting rate
of $80.00 per hour.
The charges for any laboratory tests required would be either at $30.00 per hour
for laboratory technician time and at $35.00 per hour for senior laboratory
technician.
Also, the hourly rates for draftsman and technical typist are at $30.00 and $20.00
~er hour, respectively.
