HomeMy WebLinkAboutReso 1985-12065 RESOLUTION NO. 12065 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THE NEGOTIATED PROPERTY TAX EXCHANGE AND OTHER AGREEMENTS RELATING TO THE MONTGOMERY REORGANIZATION The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, Revenue and Taxation Code Section 99 requires the negotiation of any exchange of property tax revenues occasioned by jurisdictional changes between the affected County and City, and WHEREAS, the proposed "Montgomery Reorganization" has been filed with the Local Agency Formation Commission consisting of the annexation of territory to the City of Chula Vista, detachment of territory from the San Diego County Flood Control District, dissolution of the Montgomery Fire Protection District, dissolution of the Montgomery Sanitation District, dissolution of County Service Area No. 66, dissolution of County Service Area No. 42 and dissolution of County Service Area No. 98, and WHEREAS, the County of San Diego, the City of Chula Vista and affected special districts have negotiated to determine an equitable exchange of property tax revenues applicable to the proposed jurisdictional changes. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista hereby agrees with the County of San Diego on the apportionment of property tax revenues for the Montgomery Reorganization as stated in the Master Property Tax Agreement which states the following: (a) The base property tax revenues shall be adjusted such that the City of Chula Vista receives 41% of the combined (pooled) county and detaching special districts' share of the base property tax revenue. The balance of the pooled base property tax revenue shall be transferred to the County General Fund. (b) The annual property tax increment shall be adjusted such that the City of Chula Vista receives 41% of the combined (pooled) County and detaching special districts' share of the annual tax increment with the balance transferred to the County General Fund. The resulting percentage distribution of th annual tax increment shall be maintained in subsequent years unless altered by additional jurisdictional changes. (c) The estimated distribution of property tax revenues based on the aforementioned formula is as shown in Exhibit "B", attached hereto and made a part hereof by reference as if set forth in full. BE IT FURTHER RESOLVED that the appropriations limits of all parties to this agreement be adjusted in accordance with the base property tax revenue transfer. BE IT FURTHER RESOLVED that the City of Chula Vista and the County of San Diego have mutually agreed to the following matters. These agreements are not intended as terms and conditions of the reorganization but are hereby ordered by both the County of San Diego and the City of Chula Vista: (a) The effective date of the reorganization will be prior to December 31, 1985. The County agrees that it will provide contract services through June 30, 1986 at the City's request. Such contracts will be at full cost recovery for the County. (b) This reorganization shall not result in a change in the Library District boundaries at this time. The City of Chula Vista shall make an annual payment to the County Library District to cover the amount the operating costs of the Castle Park and Woodlawn branch libraries that exceeds the amount of property tax estimated to accrue to the County Library District from within the territory of this "Montgomery Reorganization". That amount is currently estimated at $32,000. By mutual agreement of the City of Chula Vista and County of San Diego, this territory may be subsequently detached from the County Library District with the City of Chula Vista as the successor agency. Such detachment would nullify this section of this resolution for subsequent years. (c) The City of Chula Vista hereby agrees that it will not annex any territory within the "Montgomery Reorganization" into the Chula Vista Redevelopment Agency, nor form a new Redevelopment Agency which includes any portion of this territory, for at least four years after the effective date of this reorganization. -2- (d) The County agrees that subsequent to annexation, as long as the County's Community Development Block Grant (C.D.B.G.) entitlement is partially based on demography in Montgomery, the County will allocate the amount of C.D.B.G. funds received on behalf of this territory to eligible projects within Montgomery. It is also agreed that any C.D.B.G. projects funded prior to annexation and under construction will be completed by the County. It is further agreed that any C.D.B.G. projects that have or will be funded but not yet started will be contracted to the extent of the allocation by the County to the City of Chula Vista for completion. A list of projects that are now under construction or funded is included as Exhibit A. (e) The County agrees to the reasonable transfer of certain revenues, including (1) fund balances; and (2) revenues received by the County on behalf of this territory subsequent to annexation, if any; based on the revenue amounts generated by the Montgomery territory. These certain revenues include: o Park Land Dedication Ordinance; and ° Drainage fees. (f) The County of San Diego hereby agrees that it will complete two undergrounding utilities projects using the County's allocation. Those two projects are: Removal of four poles on Main Street in Otay at the SDG&E substation (Underground Utility District No. 27); and ~ Completion of the 3rd Avenue conversion project (Underground Utility District No. 47). (g) The County of San Diego hereby agrees to fully cooperate with the City of Chula Vista in the establishment of a drainage fee program within the Telegraph Canyon drainage basin. The City of Chula Vista shall be the lead agency in establishing said program. (h) Within one year following the effective date of the Montgomery Reorganization, the City agrees to detach this territory from the County's Lighting -3- Maintenance District and accept service responsibility for street lighting. The County agrees to transfer all of the property tax revenue allocated to the County Lighting Maintenance District within this territory to the City of Chula vista upon transfer of service responsibility. i) The City of Chula Vista and the County of San Diego hereby agree to equally fund the cost of the November, 1985 annexation election in Montgomery.
