HomeMy WebLinkAboutReso 1985-12060 RESOLUTION NO. 12060 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THIRD AMENDMENT TO AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND COMMUNITY TRANSIT SERVICES, INC. FOR HANDYTRANS OPERATION FOR FY 1983-85 The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve the Third Amendment to the Agreement between the City of Chula Vista and Community Transit Services, Inc. for HandYtrans operations for FY 1983-85, dated June 14, 1985, a copy of which is attached hereto and incorporated herein by reference as if set forth in full. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said Third Amendment for and on behalf of the City of Chula Vista. FOR HANDYTRANS OPERATION, FY 1983-85 This Amendment to A~reement made this 25th day of June, 1985, by and between the City of Chula Vista, hereinafter called "City," and Conununity Transit Services, Inc., hereinafter called "CTS." WITNES SETH : WHEREAS, City and CTS entered into an asreement for operation of HandYtrans on May 24, 1983, for a term of two (2) years, commencing on July 1, 1983, and terminating on June 30, 1985; and, WHEREAS, this aEreement contained an option to renew an agreement between the City and CTS for one (1) additional year, for the period July 1, 1985, through June 30, 1986; and, WHEREAS, on January 27, 1985, Council adopted a motion to exercise its option to renew an agreement with CTS for FY 1985-86 at an hourly rate of $30.69; and, WHEREAS, the First Amendment to the agreement dated May 24, 1983, reduced the contract cost for "regular" HandYtrans service for FY 1984-85 due to a reduction in Transportation Development Act (TDA) Article 4.5 funding available to the City of Chula Vista; and, WHEREAS, the Second Amendment to the agreement between the City and CTS established a new rate for the Starlight Center/Regional Center coordination project through June 30, 1985; and, WHEREAS, on May 30, 1985, the Chula Vista City Council approved an increase in HandYtrans vehicle service hours for FY 1985-86; and, WHEREAS, it is necessary to amend this agreement between the City and CTS to extend this agreement for services for the period July 1, 1985, throu§h June 30, 1986; and, WHEREAS, both City and CTS wish to amend this agreement for FY 1985-86. NOW, THEREFORE, the parties hereto a§ree as follows: 1. Amend Section 3, page 1, to read: "The term of this agreement shall be from July 1, 1985, through June 30, 1986." 2. Amend Section 4 to read: "Maximum obligation--Regular HandYtrans service (Exhibits B and C): For consideration of CTS's services described herein pertaining to the regular HandYtrans service component, the City will pay CTS as follows: a. A maximum cost not to exceed $207,004.05, based on an hourly rate of $30.69 an hour times 6,745 vehicle service hours. b. Fuel cost is estimated at $1.35 per gallon for the period July 1, 1985, through June 30, 1986. If the actual average cost for fuel varies from this estimate, reimbursement will be made by the appropriate party (either City or CTS) during the month following the determination of the actual cost of fuel." 3. The te~ms and conditions of the "Second Amendment to A~reement Between the City of Chula Vista and Community Transit Services, Inc. for HandYtrans operations, FY 1983-85," dated January 8, 1985, and attached hereto, will remain in effect from July 1, 1985, through June 30, 1986, or until such time that a new rate per mile and/or scope of service chan~e are mutually agreed upon by the City of Chula Vista, CTS, Starlight Center, and Reglonal Center. 4. All of the other terms and conditions of the agreement between the City and CTS shall remain in effect as they are described in the a~reement of Hay 24, 1983. IN WITNESS WHEREOF, the parties hereto have caused this Third Amendment to A~reement to be executed by and through their respective officers thereunto duly authorized on the date written below their si§natures.
