QUICK FOR CONSULTANT SERVICES TO PERFORM FINGERPRINT EXAMINATION AND CLASSIFICA- TION AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that that certain agre~aent between THE CITY OF CHULA VISTA, a municipal corporation, and RICHARD L. QUICK for consultant services to perform fingerprint examination and classification dated the 17th day of December , 1985, a copy of which is attached hereto and incorporated herein, the same as though fully set forth herein be, and the same is hereby approved. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said agreement for and on behalf of the City of Chula Vista. DATED (seal) City Clerk 3C-660 CONSULTING SERVICES AGREEMENT THIS AGREEMENT is made at Chula Vista, California as of January 1, 1986, by and between the CITY OF CHULA VISTA, a municipal corporation ("City") and RICHARD L. QUICK ("Contractor"), who agree as follows: 1. Subject to the terms and conditions set forth in this Agreement, Contractor shall provide to the City the services described in Exhibit A1 which is, by this reference, incorporated herein. Contractor shall provide said services at the time, place, and in. the manner specified in Exhibit Al. 2. Payment. City shall pay contractor at the rate of $25.00 per hour for services rendered pursuant to this Agreement. Said amount shall be the total compensation paid for work performed under this Agreement. The total compensation for this agreement shall not exceed ~18,000. Contractor shall provide City with a bi-weekly statement of the total hours worked, on the day following the end of each pay period as defined by the City. Compensation for these services should be paid bi-weekly. 3. Exemption from Civil Service. It is expressly agreed and understood by City and Contractor that this Agreement and the rendition of services hereunder is specifically exempted from Civil Service of the City of Chula Vista. The parties to this Agreement agree that Contractor is a professional person, in business for himself, and that the relation created by this contract is that of employer-independent contractor. Contractor is not an agent or employee of the City and is not entitled to benefits provided by the City to its employees, including but not limited to health insurance and unemployment insurance. 4. General Provisions. (a) Except as otherwise provided in Exhibit Al, this contract shall be based on the performance of the Contractor to the satisfaction of the Director of Public Safety. (b) This Agreement shall commence on the date first stated above and shall continue thereafter through December 31, 1986. (c) This Agreement may be terminated by City or by Contractor upon 15 days written notice to the other party. CITY OF CHULA VISTA Contractor Mayor City of Chula Vista aidhard b. Approved as to form by Date EXHIBIT A1 SCOPE OF WORK ASSIGNMENT It is intended that the Contractor shall apply his full time, during the hours of employment to the technical and professional processes of Fingerprint Examination and Classification and, as may be required by judicial process, the appearance in Court for the purpose of testifying as a recognized expert in such matters. 1. Work shall be of the type and quality usually performed by a court recognized expert in the art of fingerprint examination and classification in identifying from fingerprint cards and latent prints the points of comparison to make legal identification of criminal suspects, to prepare the court exhibits for use in courtroom presentation of evidence, to testify to the methods used and the processes used for comparison and to do other related work as may be required. 2. The hours of work and the time spent shall be at the discretion of the Contractor unless otherwise directed by the required response to a criminal subpoena. The number of hours to be devoted to the examination and comparison of fingerprints or latent print evidence shall not exceed Fifteen (15) hours per week unless specific approval of the Director of Public Safety or his designee be obtained prior to the performance of said work and in such event the extended hours shall be directly related to articulable high priority matters. Response to and performance of assigned duties as a court witness shall not be a part of the fifteen (15) hour weekly work limit but may be considered in possibly reducing the number of hours to be worked in subsequent pay periods. 3. The place of employment, except for court ordered appearances, shall be the Chula Vista Police Department. 1067a
