HomeMy WebLinkAboutReso 1985-12309 RESOLUTION NO. 12309 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND METROPOLITAN AREA ACTION COUNCIL (MAAC) TO PROVIDE FOR GROUNDS MAINTENANCE AT LAUDERBACH PARK, APPROPRIATING AN ADDITIONAL $2,000 THEREFOR AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that that certain agreement between THE CITY OF CHULA VISTA, a municipal corporation, and METROPOLITAN AREA ACTION COUNCIL (MAAC) to provide for grounds maintenance at Lauderbach Park for the period January 1 through June 30, 1986 dated the. 17th day of December , 1985, a copy of which is attached hereto and incorporated herein, the same as though fully set forth herein be, and the same is hereby approved. BE IT FURTHER RESOLVED that the sum of $2,000 is hereby appropriated from the unappropriated balance of the General Fund for said maintenance. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said agreement for and on behalf of the City of Chula Vista. AGREEMENT THIS AGREEMENT, made and entered into this 17th day of December , 19 85 , .by and between the City of Chu-~T~--~i-sta, a Charter City, State of C~rnla, hereinafter called the "City" and MAAC Project, hereinafter called the "Contractor"; WITNESSETH: WHEREAS, the Contractor declares that he has carefully examined the specifications for "LANDSCAPE MAINTENANCE OF LAUDERBACH PARK" (Exhibit "A"), and that he has examined the location of the proposed work; WHEREAS, the Contractor hereby proposes to furnish all labor and do all work required to complete the said work in accordance with said specifications for the lump sum of $7,500. WHEREAS, the Contractor and City agree that the Contractor shall operate as an independent contractor in carrying out the terms of this agreement. WHEREAS, the Contractor hereby agrees to indemnity, hold harmless and defend the City for any liability arising out of the performance of this contract due to the acts of its agents and employees. This shall include liability related to Worker's Compensation. IN WITNESS WHEREOF, the parties hereto have executed this Agreement the day and year first above written. Attest: '~X ~- By: APPROVED AS TO FORM BY: WPC 0525R I~em #13 EXHIBIT "A" CITY OF CHULA VISTA, CA SPECIFICATIONS Furnish landscape maintenance of Lauderbach Park at 333 Oxford Avenue, Chula Vista under supervision of Parks Superintendent of City of Chula Vista for the period January l, 1986, to June 30, 1986. It is estimated that approximately $1,250/month will be required for the Lauderbach Park park maintenance contract. GENERAL REQUIREMENTS 1. All shrubbery and ground cover shall be properly irrigated, pruned and shaped continuously to produce the best possible effect and growth conditions. 2. Shrubbery and ground cover beds and planter boxes shall be fertilized with a commercial fertilizer of no less quality than 16-6-8 every three months. All turf grass shall be fertilized by the Contractor every three months. City will provide materials. 3. All shrubs, ground covers and turfs shall be sprayed, dusted and/or otherwise treated for pest control as required. 4. Sidewalks fronting all planter are to be swept or vacuumed clean of debris or hazardous materials fallen from adjacent trees each day, excluding holidays, Saturday and Sunday. 5. Sidewalks, street furniture and other landscaping features are to be kept neat and clean. 6. All benches are to be kept in good repair and well varnished. Benches require a constant vigil to maintain a bright appearance. City will provide materials. 7. Daily investigation of the playground equipment to ensure SAFE conditions. 8. Throughout the contract the contractor will keep the City informed immediately on any acts of vandalism in the park. REPLACEMENTS 1. Any plant material damaged by others or adverse conditions shall be replanted. 2. Removal of existing plants and planting of a new variety of shrub or ground cover may be requested during the contract period. The City will furnish the nursery stock and materials required. Item ~13 Specifications (continued) IRRIGATION 1. Irrigation shall be done by the use of manual and/or automated systems, where available and operable; however, failure of the existing irrigation system to provide full and proper coverage shall not relieve the contractor of this responsibility. All areas not adequately covered by a manual and/or automated sprinkler system shall be irrigated by a portable irrigation method. The Contractor shall furnish all hoses, nozzles, sprinklers, etc., necessary to accomplish this supplementary irrigation. Care shall be exercised to prevent a waste of water, erosion, and/or detrimental seepage into existing underground improvements or structures. 2. Special attention shall be directed to the maintenance sprinkler equipment. Any damage to or malfunction of the irrigation system shall be promptly repaired by the Contractor, utilizing the same type, size and specification pipe and fittings as the original installation. At no time will systems be shut down for extended periods - repairs are to be made as discovered or reported. The City will furnish materials required for the repairs. WEED CONTROL All fence lines and parking surfaces shall be sprayed and otherwise treated with weed killer for weed control. DEBRIS 1. As work in any area is completed, the clippings, trimmings and weeds will be removed and the area left in a neat and attractive condition. 2. All other trash or noticeable debris shall be removed daily during the normal work week. Either party, upon thirty (30) days written notice, may terminate contract. WPC 0525R
