A Virtual Regular Meeting of the Charter Review Commission of the City of Chula Vista was
called to order by Chair Felber at 6:01 p.m. via WebEx.

Item 3 was heard o ut of orde r. Vice Chair Tom O’Donnell, Assistant City Attorney Jill
Maland and City Clerk Kerry Bigelow presented . The Co mmission members discussed the
item.
ACTION: Commission er Buddingh made a motion to recommen d that Charter section
602(d) be amended to r eplace “q u alif ied electors” with “residents” on all Boards &
Commissions other than the Districting Com mission , and to clarify related issues .
Commissioner Hopida seconded and the motion p ass ed as follows:
Yes: 4 (Buddingh, Hopida, McDonald and Sco field )
No: 3 (Felber, O’Donnell and Ross)

On gen eral consensus , the Commission agree d to create a subcommittee consisting of
Co mmissio ners Buddingh, Hopida, and McDonald to wo rk with City staff on drafting the
proposed amendment for recommendation to the City Council.

ACTION: Chair Felber made a motion to approve the March 11, 2020 minutes.

Assistant City Attorney Jill Maland presented. Commission membe rs discussed the item.
ACTION: Commission er Hopida made a motion to have City staff take the proposed
amendments forward to City Council without a recommendation . Commissioner Buddingh
seconded and the motion passed as follows:

No: 0

4. DISCUSSION AND POTENTIAL ACTION ON PREPARATION OF BI-ANNUAL
REPORT TO CITY COUNCIL REGARDING COMMISSION ACTIVITIES
Assistant City Attorney Jill Maland presented a draft report. Commission members discussed
the draft. Commission req uested tha t the report be revised based on Co mmis sion in put a nd
that the revised report be placed on the next Commission agenda.

5. STAFF COMMENTS – Maland reported that two Co mmissioners were te rming out, which
would leave openings on the Commission to be filled , and that the Districting Commission
application process ha d begun.

Sec. 602.
Appointments; Terms and Vacancies.
(a) Appointments a nd Terms. The members of each of such boards or commissions shall be appointed, and
shall be subject to removal, by motion of the City Council adopted by at least three affirmative votes. The
members thereof shall serve for a term of four (4) years and unt il their respective successors are appointed and
qualified. Members of such boards and commissions shall be limited to a maximum of two (2) consecutive
terms and an interval of two (2) years must pass before a person who has served two (2) consecutive term s
may be reappointed to the body upon which the member had served; provided, further, that for the purpose of
this section, an appointment to fill an initial term or an unexpired term of less than two (2) years in duration
shall not be considered as a term ; however, any appointment to fill an initial term or an unexpired term in
excess of two (2) years shall be considered to be a full term.
(b) Initial Classification of Appointees. The members first a ppointed to such boards and commissions shall so
classify themselves by lot so that each succeeding July 1st the term of one (1) of their number shall expire. If
the total number of members of such body to be appointed exceeds four (4), the classification by lot shall
provide for the grouping of terms to such an extent as is necessary in order that the term of at least one (1)
member shall expire on each succeeding July 1st.
(c) Vacancies. Vacancies in any board or commission, from whatever cau se arising, shall be filled by
appointment by the City Council. Upon a vacancy occurring leaving an unexpired portion of a term, any
appointment to fill such vacancy shall be for the unexpired portion of such term. If a member of a board or
commission is a bsent from three (3) regular meetings of such body consecutively, unless by permission of
such board or commission expressed in its official minutes, or is convicted of a felony or crime involving
moral turpitude, or ceases to be a resident qualified electo r of the City, the office shall become vacant and shall
be so declared by the City Council.
(d) Eligibility. All voting members of City boards and commissions shall be qualified electors in must be
residents of the City of Chula Vista and at least 18 years of age . with the exception of Youth Commissioners
who need only be residents of the City of Chula Vista . For purposes of this Charter, a “resident ” is any person
whose “domicile ,” as that term is defined in t he California Elections Code, is within the City, or territory
annexed to the City . The residency requirement shall not apply City Council may appoint non -electors of the
City of Chula Vista to members of those boards and commissions on which non-resident members are
permitted to serve by City ordinance which are advisory only and whose duties involve regional issues .
Appointment of non -residents to such boards and commissions must be passed by at least four affirmative
votes. The age requiremen t shall not apply to members of boards and commissions on which youth members
are permitted to serve by City ordinance . Districting Commission members must also be registered voters of
the City, pursuant to section 300.5 of this Charter. Appointment of non -electors must be passed by at least four
affirmative votes. No person may be appointed nor shall serve on more than one of the Charter-created boards
or commissions simultaneously.

Highlights of Activities During the Past Fiscal Year:
1. Preparation of three potential Charter Amendments for City Council consideration,
based on results of 2019 Public Survey and direction from City Council in July
2019
2. Consideration of City Council referral to analyze and draft for City Council
consideration a Charter amendment that would allow City “residents,” not just
“qualified electors,” to serve on City boards and commissions
Detailed Summary:
In early 2019, the Commission prepared and circulated a public survey to obtain feedback
regarding potential Charter amendments. The Commission presented the results of the survey to
the City Council on July 23, 2019. The City Council accepted the recommendation of the Charter
Review Commission an d directed the Commission to draft potential ballot measures for Council's
consideration for the November 2020 election on the following items: 1) Requiring that the elected
City Attorney be a resident of the City; 2) Creating a process to suspend an elect ed official if the
official is charged with a felony; and 3) Using mail -in ballots, only, for special elections involving
the Mayor, Councilmembers, or the City Attorney. Accordingly, the Commission drafted the
proposed amendment language for the City Cou ncil’s consideration.
The Commission has considered, and listened to public comment regarding, the City Council’s
referral relating to the Charter language requiring board and commission members to be qualified
electors. The Commission is preparing draft language for the City Council’s consideration . It
anticipates that it will have the draft language finalized for presentation to the City Council in July
2020.
