HomeMy WebLinkAboutReso 2003-323RESOLUTION NO. 2003-323 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ORDERING CERTAIN OPEN SPACE AND MAINTENANCE FACILITIES TO BE MAINTAINED, APPROVING MODIFICATIONS TO THE ENGINEER'S REPORTS FOR FISCAL YEAR 2003/2004 AND LEVYING ASSESSMENTS FOR EASTLAKE MAINTENANCE DISTRICT #1 WHEREAS, prior to the adoption of this resolution, the City Council has caused the formation of various districts under and pursuant to Article 4, Chapter 1, Part 2 of Division 15 of the California Streets and Highways Code, also known as "Landscaping and Lighting Act of 1972" and Chula Vista Municipal Code Chapter 17.07; and WHEREAS, as required by ordinance, the City Engineer has prepared and filed the annual reports for all existing Open Space Maintenance Districts in the City; and WHEREAS, on June 10, 2003,.Council approved the engineer's reports and set July 22, 2003 as the date for the public hearing; and WHEREAS, the proposed assessment for fiscal year 2003/2004 as they compare to the last year are shown in the following table: TABLE 1 PRIOR FISCAL YEAR'S VS. Total Revenue=S185,986 NOW, THEREFORE, BE IT RESOLVED as to all Open Space and Maintenance Districts herein referenced that the City Council of the City of Chula Vista does hereby find that written protests against the proposed assessment adjustment has not been made by owners representing more than one-half of the area of land to be assessed from the improvement and confirms the diagram and assessment contained in the engineer's report, and orders the open space and maintenance facilities to be maintained. The adoption of this resolution shall Resolution 2003-323 Page 2 constitute the levy of assessments as proposed in the engineer's report for the 2003/2004 fiscal year and set forth hereinabove for Eastlake Maintenance District #1.
