HomeMy WebLinkAboutReso 1985-12251 RESOLUTION NO. 12251 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA RECITING THE FACT OF THE MUNICIPAL GENERAL ELECTION HELD ON THE 5th DAY OF NOVEMBER, 1985, DECLARING THE RESULT THEREOF AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, a municipal general election was held and con- ducted in the City of Chula Vista, County of San Diego, State of California, the 5th day of November, 1985, as required by law, and WHEREAS, notice of said election was duly and regularly given in time, form and manner as provided by the law; that voting precincts were properly established; that election officers were appointed and that in all respects said election was held and conducted and the votes cast thereat, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in cities, and WHEREAS, pursuant to Resolution No. 12095, adopted on the 16th day of July, 1985, the City Clerk of the City of Chula Vista canvassed the returns of said election and has certified the results to this City Council, (and as certified by the Registrar of Voters of the County of San Diego), said results are received, attached and made a part hereof as "Exhibit A". NOW, THEREFORE~ THE CITY COUNCIL OF THE CITY OF CHULA VISTA CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. That there were 69 voting precincts in the City and 15 precincts in the Montgomery area established for the purpose of holding said election consisting of the regular elections precincts in the City of Chula Vista and the Chula Vista City School District, as established for the holding of state and county elections. SECTION 2. That said municipal general election was held for the purpose of election of two members to the office of Council for a full term of four years, and to fill seven positions on the Montgomery Community Planning Committee. -1- SECTION 3. That at said municipal general election, the following measures were submitted to the electors of said City, to wit: PROPOSITION B An amendment to the Charter of the City of Chula Vista amending Article III, Section 300, to read that elected officials take office on the first Tuesday following certification of election results by the Registrar of Voters. PROPOSITION C An amendment to the Charter of the City of Chula Vista amending Article V, Section 502(b), by deleting the requirement that the City Clerk maintain separate books in which a record shall be made of all written contracts and official bonds, and Section 502(f), by deleting the requirement that the Clerk be an "ex-officio assessor". PROPOSITION An amendment to the Charter of the City of Chula Vista amending Article V, Section 504, to allow the Finance Director to submit quarterly statements to the Council as opposed to monthly statements. PROPOSITION E An amendment to the Charter of the City of Chula Vista amending Article X, by deleting Section 1012 which presently requires the City to maintain a revolving Cash Basis Fund and Section 1016 which requires the City to register warrants. PROPOSITION F An amendment to the Charter of the City of Chula Vista amending Article XI, Sections 1100-1103, which purport to regulate the Board of Education by deleting the entire article. -2- SECTION 4. That the whole number of votes cast in said City including absent voter ballots was 9,544. That the whole number of absent voter ballots cast in said City was 584, making a total of 10,128 votes cast in said City. SECTION 5. That the names of persons voted for at said election are as follows: Seat No. 1 (full term - 4 years) Gayle L. McCandliss Penny Allen Seat No. 2 (full term - four years) Leonard M. Moore George Brining Mont~omer~ Planning Committee J. O. Lee Solomon Ed Storm Ben G. Patton Thomas A. Martin Joe A. Berlanga Frank Balistrieri Antonio Castro, Sr. Fred M. Creveling Robert P. Fox W. Scott Frazeur That the number of votes given at each precinct to each of such persons above named for the respective offices for which said persons were candidates are as shown in Exhibit "A", attached hereto and made a part hereof by reference. That the Propositions voted upon at said election are as set forth herein above. SECTION 6. The City Council does declare and determine that: Gayle L. McCandliss was elected as a Member of the City Council (Seat No. 1) for a full term of four years. Leonard M. Moore was elected as Member of the City Council (Seat No. 2) of said City for a full term of four years; -3- The following were elected to the Montgomery Planning Committee: J. O. Lee Solomon Ed Storm W. Scott Frazeur Ben G. Patton Fred M. Creveling Joe A. Perlanga Robert P. Fox and That as a result of said election, a majority of the qualified voters voting on Proposition B, C, D, E and F did vote in favor thereof, and that said propositions carried, and shall be deemed adopted and ratified. SECTION 7. The City Clerk shall enter on the records of the City Council of said City, a statement of the results of said election, showing (1) The whole number of votes cast in the City and the Montgomery Area; (2) The names of the persons voted for; (3) The measures voted upon; (4) For what office each person was voted for; (5) The number of votes given at each precinct to each person, and for and against each measure. SECTION 8. That the City Clerk shall immediately make and, upon compliance by the person elected with the provisions of Section 11565 and Section 11568 of the Elections Code of the State of California, shall deliver to the person so elected a Certificate of Election signed by her and duly authenticated; that she shall also administer to such person so elected the Oath of Office prescribed in the State Constitution of the State of California and shall have him subscribe thereto and file the same in her office. Whereupon, said person so elected shall be inducted into the office to which he has been elected -4- SECTION 9. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original Resolutions of said City, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed adopted Presented by Approved as to form by ~en~ie M. The total number of precincts in the Montgomery area was 15. That attached hereto and made a part hereof is a list of the number of votes received in each precinct for the.candidates voted on and the total number of votes received in the election plus the number of votes received for each Proposi- tion. Further, as a result of the said election, a majority of the qualified Canvass of November S, 1985 Election Page voters elected the following persons to office: For Council: Gayle L.
