HomeMy WebLinkAboutReso 1985-12210 ALTERNATE 1 RESOLUTION NO. 12210 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THE RELOCATION OF AN EXISTING CARDROOM FROM 11 THIRD AVENUE TO 631 "H" STREET - VEGAS CLUB, INC. The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, The Vegas Club, Inc. has applied for a conditional use permit to relocate its existing cardroom from 11 Third Avenue to 631 "H" Street, and WHEREAS, at its August 14, 1985 meeting, the Planning Commission failed to adopt a motion to approve this request by a vote of 2-2 (one abstention and two absent), and WHEREAS, on October 1, 1985, after a public hearing on the appeal of the Planning Commission decision, the City Council directed that a resolution be brought back approving the relocation of the cardroom with conditions. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve the conditional use permit allowing the relocation of the existing cardroom at 11 Third Avenue to 631 "H" Street subject to the following conditions and based upon the following findings: CONDITIONS: 1. This conditional use permit shall be valid for a period of five (5) years after which time it may only be extended by action of the City Council. 2. This conditional use permit authorizes the operation of three (3) tables with the ability to expand to a total of six (6) tables upon approval of the Zoning Administrator. The Zoning Administrator shall base his approval of the additional three (3) tables upon a parking survey of the shopping center at 631 "H" Street which shall determine whether there is adequate parking to serve the existing uses in the shopping center. The operation of the additional three (3) tables shall be subject to subsequent Zoning Administrator approval on a yearly basis. -1- FINDINGS: 1. The proposed use is located in a shopping outlet with compatible uses, and is centrally and conveniently located to those wishing to utilize its services. 2. The proposed use is adequately separated from incompatible residential uses to the north, and the shopping center has been found to have sufficient parking to accommodate the cardroom without adversely impacting adjacent businesses. 3. The proposed use represents the relocation of an existing cardroom and meets the regulations established therefor by Chapter 5.20 of the Chula Vista Municipal Code. 4. The subject property is designated for retail commercial use on the General Plan. The proposed use is in keeping with this designation.
