HomeMy WebLinkAboutReso 1986-12505 RESOLUTION NO. 12505 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND THE COUNTY OF SAN DIEGO FOR THE SWEETWATER AREA TRAFFIC CORRIDOR STUDY AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT The City Council of the City 6f Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that that certain agreement between THE CITY OF CHULA VISTA, a municipal corporation, and THE COUNTY OF SAN DIEGO, for the Sweetwater Area Traffic Corridor Study dated the 3 day of JUNE , 198 6, a copy of which is attached ~ and incorporated herein, the same as though fully set forth herein be, and the same is hereby approved. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said agreement for and on behalf of the City of Chula Vista. FULASZ, CMC, CITY CLERK of the City of Chula Vista, California, DO HEREBY CERTIFY that the above and foregoing is o full, true and correct copy of RESOLUTION NO, 17~5 ,and that the same has not been amended or repealed DATED  City Clerk -, ¢i y OF CC-660 AGREEMENT BETWEEN COUNTY OF SAN DIEGO AND CITY OF CHULA VISTA REGARDING SWEETWATER AREA TRAFFIC CORRIDOR STUDY THIS AGREEMENT, executed this 3rd day of June , 1986, by and between the County of San Diego, a political subdivision of the State of California, hereinafter called "COUNTY" and the City of Chula Vista, a municipal corporation, hereinafter called "CITY." WITNESSEll~: WHEREAS, the City and County wish to jointly participate in a Traffic Corridor Study for the Sweetwater area; and WHEREAS, the Study will be used to guide the CITY and COUNTY in: 1. Establishing conditions for development of future projects; 2. Developing the Capital Improvement Program in the area; and 3. Preparing future General Plan amendments. WHEREAS, the County Board of Supervisors has approved the expenditure of $30,000 for the Study; and WHEREAS, the CITY has budgeted $50,000 for the Study; and WHEREAS, the CITY and COUNTY desire to specify herein the terms and conditions by which the Study will be accomplished. NOW, THEREFORE, IT IS MUTUALLY AGREED by and between the CITY and the COUNTY as follows: 1. The CITY will hire a traffic engineering consultant to prepare the Sweetwater Area Traffic Corridor Study. 2. The Study will include the area bounded by 1-805 on the west, State Route 54 on the north, "H" Street on the south, and future State Route 125 on the east. 3. The Study will include: A. Traffic projections along Bonita Road and other significant roads in the corridor. B. Determinations of bottlenecks and proposed projects to eliminate them. C. Alternatives to solve traffic problems in the Valley. D. Detailed study of the 1-80S/Bonita Road/Plaza Bonita Road interchange area. E. Study of accidents along the corridor. 4. The COUNTY will be given the opportunity to provide representatives to participate in the citizen Steering committee, staff technical committee and the consultant selection process. 5. The cost of the proposed study, estimated at $80,000, will be shared by the CITY and the COUNTY. The COUNTY will contribute up to a maximum of $30,000 and the CITY will contribute the remainder, approximately $50,000. 6. If the total cost of the study is less than $80,000, the COUNTY will contribute 37-1/2~ of the total project costs. --2-- 7. To comply with the COUNTY Minority Business Program policy, the CITY will solicit bids from approprirate minority businesses from the list of minority businesses provided by the COUNTY. 8. The COUNTY will pay to the CITY one-half of COUNTY share at such time as CITY executes agreement with consultant and one-half when CITY accepts final report from consultant. 9. A. The COUNTY, its agents, officers and employees shall not be held liable for any claims, liabilities, penalties, fines, or for damage to any goods, properties or effects or any person whatsoever, nor for personal njurles to, or death of anyone caused by or resulting from any negligent acts or omissions of CITY, or its agents, employees, or representatives including liability resulting from the acts or omissions of the CITY, its agents, employees, or representatives, which may occur by reason of any work specified in this Agreement. B. The CITY further agrees to defend and indemnify, and save free and harmless COUNTY and its authorized agents, officers and employees against negligent acts or omissions of the CITY, its agents or employees, alleged to have occurred by reason of any work specified in this Agreement, and any cost and expenses incurred by the COUNTY on account of any claim therefor. 10. This indemnity agreement is not limited in any way by the extent of any insurance policy currently in force and held by either party. -3- 11. This agreement may not be modified, amended or otherwise changed unless by an amendment, in writing, executed by both parties. 12. This Agreement shall terminate after the Sweetwater Area Traffic Study has been completed and the COUNTY has contributed $30,000 to the CITY for its share of the costs. IN WITNESS WHEREOF, this Agreement is executed by the COUNTY of San Diego pursuant to action taken by the Board of Supervisors, and by the CITY of Chula Vista pursuant to action taken by the City Council.
