RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CHULA VISTA AUTHORIZING A CONTRACT WITH
GERALD S. KIBBEY & ASSOCIATES FOR THE APPRAISAL
OF PROPERTY LOCATED AT 228, 232, 281 AND 287 CNURCH AVENUE
AND APPROPRIATING FUNDS THEREFORE.
The City Council of the City of Chula Vista does hereby resolve as follows:
WHEREAS, the Town Centre Project Area Committee has
determined that is is necessary to provide more off-street parking places for
shoppers and employees in the downtown area; and
WHEREAS, in order to provide more off-street parking spaces
it is necessary to acquire additional parcels for conversion to off-street
parking lots which are under the jurisdiction of the Parking District in the
Downtown area; and
WHEREAS, the parcels located at 228, 232, 281 and 287
Church Avenue has been identified as potential acquisition sites for
additional parking; and
WHEREAS, the Town Centre Project Area Committee has
requested that the City Council authorize appraisals for these four
properties; and
WHEREAS, Gerald S. Kibbey & Associates has proposed to
appraise the subject parcels for the sum of $3,000; and
WHEREAS, Gerald S. Kibbey & Associates is a firm
experienced in the appraisal of properties.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chula Vista that the contract with Gerald Kibbey & Associates for the
appraisal of property located at 228, 232, 281, and 287 Church Avenue for the
sum of $3,000, attached hereto and incorporated herein as though fully set
forth, is hereby approved.
BE IT FURTHER RESOLVED that funds are hereby appropriated
from the unappropriated reserve of the Parking Meter Fund.
BE IT FURTHER RESOLVED that the Mayor of the City of Chula
Vista is hereby authorized to execute said agreement on behalf of the City.

3. Appraiser agrees to deliver 3 copies of said re~rt to client within 45 days after

the the delivery date in the event that unforseen difficulties are encountered in
~ini~ ~le ~ket data or for o~r rea~ns ~t ~y ~y re~rt ~livery.

4. Should additional services of the appraiser be requested by the client, his agent,
his attorney, or the court, such as pre-trial conferences, ~urt appearances, court
pre, ratio, etc., ~ client ~r~s to ~n~te ~e a~rai~r at t~ rate of $1200
~r day for ~rald S. Kibbey ~d $800 to $1200 ~r day for ass~iates, provided such
~ditio~l ~rvi~s are ~rfor~ wi~in o~ ~ar after ~livery of ~id re,rt. In
the event that such services shall ~ required more than one year after delivery of
~id r~rt, t~ ~n~tion shall ~ at the ~stom~y ~r diem rate charg~ by ~id
a~raiser as of that date.
5. The cost of preparing exhibits for court, photo enlargements, maps, etc., shall be
~rne by the client, and the appraiser shall, in addition to his compensation, ~
rei~ur~ ~ ~ client for s~h ~ts ~v~ ~ ~ a~raiser.
6. Pay~nt for such ~itional ~rvi~s shall ~me due ~n r~ipt of state~nt ren-
der~ ~ ~ a~raiser.
7. It is furt~r ~erst~ ~ ~r~ ~t if ~y ~rti~ of t~ a~ve ~ti~ or
costs due to the appraiser ~come delinquent, the client agrees to pay interest
t~r~f at t~ rate of 18% ~r ~um on ~id ~t from t~ due date ~til ~id, ~
f~r ~r~s to ~y all ~sts of ~ll~ti~ ~r~f, i~l~i~ rea~n~le attorney's
fees, ~urt costs, etc..
8. In retu~ for ~id ~rvi~s, ~ client ~re~ ~r~s ~ ~sate_~ a~rai~r in
t~ a~t of $3,000, ~y~le as follows:

submission in accordance with F~B Memorandum R-4~, an additional fee will ~

9. In the e~ent that the client desires to cancel this authorization, written notice
t~r~f s~ll ~ deliver~ to ~ a~rai~r, ~ it is ~r~ ~at the a~rai~r shall
r~i~ ~ti~ from ~e cli~t for all ~rvi~s re~er~ at ~ rate of $400 ~
$800 ~r day for the time actually s~nt prior to receipt of written notice to stop
