HomeMy WebLinkAboutReso 1986-12427 1197 RESOLUTION NO. 12427 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA GRANTING EASEMENT ON LOT 7 OF THE TOWN CENTRE FOCUS AREA TO CENTRE CITY ASSOCIATES, LTD. The City Council of the City of Chula Vista does hereby resolve as fol 1 ows: WHEREAS, the Redevelopment Agency of the City of Chula Vista approved the design for construction of a 94 unit residential project on Lot 8 of Subdivision Map #10505; and WHEREAS, said design was conditioned upon the developer obtaining an easement from the City of Chula Vista for the use of a portion of the adjacent Lot 7 for landscaping and parking purposes; and WHEREAS, the developer of said project has requested an easement on Lot 7 in accordance with provisions set forth in the project's conditions of approval; and WHEREAS, the City Council of the City of Chula Vista desires to encourage redevelopment of said Lot 8 and finds that said easement as proposed will not adversely effect the health, safety, or welfare of the City. THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista as follows: Section 1. City of Chula Vista hereby grants an easement on Lot 7 to Centre City Associates Ltd. for paving and landscaping purposes as more particularly set forth in the easement document attached hereto as Exhibit "A". Section 2. The City Clerk of the City of Chula Vista is authorized to record said easement document in the office of the County Recorder of the County of San Diego.  Approved as to form by Paul G. ", 1199 EXHIBIT "A" WHEN Ri,CORDED, MAIL TO: ~ CENTRE CITY ASSOCIATES 315 FOURTH AVENUE CHULA VISTA, CA 92010 Assessor's Parcel No. 568-270-25 GRANT OF EASEMENT FOR PARKING AND LANDSCAPING PURPOSES FOR A VALUABLE CONSIDERATION, receipt of which is hereby acknowledged, the City of Chula Vista, a municipal corporation, does hereby grant to Centre City Associates, Ltd., a limited partnership, their successors and assigns, an easement for parking and landscaping, together with the right to construct and maintain concrete curbs, paving, fencing, landscaping and irrigation systems in accordance with conditions of approval set forth in Exhibit A to the Redevelopment Agency of the City of Chula Vista Resolution No. 638, dated October 17, 1985, upon that certain real property in the City of Chula Vista, County of San Diego, State of California, described as follows: That portion of Lot 7 of Chula Vista Tract No. 81-1, according to map thereof No. 10505 filed in the Office of. the County Recorder of San Diego County, October 22, 1982, described as follows: Beginning at a point on the easterly line of Lot 8 of said Map No. 10505 distant thereon 52.00 feet northerly of the southeast corner of said Lot 8; thence NTl°22'28"E 8.00 feet, thence N18°28'42"W 161.48 feet to the point of tangency of. a 150 foot radius tangent curve concave southwesterly; thence northerly and westerly along the arc of said curve 235.34 feet through a central angle of 89°53'42"; thence S?1°25'00"W 124.63 feet to a point on the westerly line of said Lot 7; thence S18°30'O3"E 17.00 feet to the southwesterly corner of Lot 7, thence easterly and southerly along the southerly and westerly boundary of Lot 7 to the point of beginning. Said easement shall be appurtenant to Lot 8 of said Map 10505. The Grantee, their successors and assigns, agree to hold the City of Chula Vista, its officers and employees, harmless from any claims arising from the Grantor's use of said easement. WPC 2181H ' 1200 EXHIBIT A TO AGENCY RESOLUTION NO. 638 October 17, 1985 Lot 8 of the Town Centre Focus Area CONDITIONS OF APPROVAL 1. The applicant shall simplify the window pattern on the top level of the structure and present the revised elevations to the Design Review Committee for approval. 2. The parking space at the northwest corner of the property should be deleted and the landscaped area expanded to provide a more attractive secondary entrance to the project. 3. Approval of the Redevelopment Agency shall be required to encroach within the commercial parking structure lot with parking. Appropriate easements will be required. 4. The entry drive at the northwest corner of the site shall be widened to 24 feet. 5. Center Street shall be widened to 24 feet from curb to curb and the intersection of Garrett Avenue shall be redesigned subject to approval of the City Engineer. 6. The turning radius for the turnaround at the easterly entry shall be approved by the City's Traffic Engineer. 7. Appropriate pedestrian lighting shall be provided for the pedestrian park way area. 8. All landscape and irrigation plans shall be closely coordinated with the City's Landscape Architect and appropriate agencies where utility easements are involved. 9. The applicant Shall install landscaping and a sidewalk within the pedestrian walkway in accordance with a landscape plan provided by the Redevelopment Agency. · lO. Details and materials of the proposed masonry walls shall be submitted to the Planning Department for approval prior to approval of building permits. 11. A trash enclosure shall be located near each entry site subject to approval of the Planning Department. Masonry materials used throughout the project shall be utilized on trash enclosures in addition to solid gates. 12. The 6 foot high wrought iron fence proposed along the pedestrian park way and adjacent to Memorial Park shall be coordinated with the landscape plans an~-finished contours of the grading plan. 13. The Developer coordinate the Lot 8 landscaping with existing landscaping along the adjacent parking structure, redesign the existing irrigation system for said landscaping to tie into Lot 8 irrigation system, and the owner of Lot 8 be responsible for the maintenance of all landscaping between Lot 8 and the parking structure. Developer shall ~gree to pay any costs accruing to the Agency for maintenance of the subject landscaping in the event that developer fails to adequately maintain said landscaping in the sole opinion of the Agency. 14. Developer will be required to contribute 1% of the project valuation to the Town Centre Fine Arts fund at the time the building permit is issued. 15. No building permit or other construction approval shall be issued or approved unless the developer makes contributions to both the Chula Vista City School District and the Sweetwater Union High School District to mitigate adverse effects of the project on the districts, and presents letters from said districts certifying that adequate school services will be provided to mitigate adverse effects of the development. No such letter shall be unreasonably withheld. This condition is intended for the benefit of said school districts, the developer, and the Agency and may be enforced by any of them in a court of law. 16. No building permit or other construction approval shall be issued or approved unless developer secures easements from the property owner and the leaseholder of Lot 7 of the Chula Vista Tract No. 81-1 Town Centre Townsite Tract No. 2, which contains the Focus Area Parking Structure for the purpose of providing parking for the Lot 8 residential project and in exchange for which the developer will effect Condition No. 13 above.
