RESOLUTION NO. 12398
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
DECLARING THE PUBLIC NECESSITY FOR THE ACQUISITION OF REAL
PROPERTY FOR THE CONSTRUCTION OF THE TELEGRAPH CANYON CREEK
FLOOD CONTROL PRO3ECT AND AUTHORIZING THE CITY ATTCRNEY TO
COMMENCE EMINENT DOMAIN PROCEEDINGS TO ACQUIRE REAL
PROPERTIES f~ INTERESTS THEREIN FOR SAID PROJECT
WHEREAS, it is proposed that the City of Chula Vista, State of
California, will acquire the hereinafter described real properties for the
purpose of constructing the Telegraph Canyon Creek Flood Control Project; and
WHEREAS, pursuant to its Charter, the City Council of Chula Vista may
exercise the right of eminent domain to acquire real property or interest
therein necessary to carry out any of the powers or functions of the City; and
WHEREAS, the County of San Diego has entered into an Agreement with
the City of Chula Vista, dated January 21, 1986, which provides that the
County will provide professional service to the City and requiring the County
to acquire the properties in the name of City of Chula Vista for use as a
drainage facility; and
WHEREAS, on July 23, 1985, the Director of Planning of the City of
Chula Vista found the proposed location, purpose and extent of the Telegraph
Canyon Creek Flood Control Project to be in conformity with the City of Chula
Vista General Plan; and
WHEREAS, the real properties or interests therein sought to be
acquired for the proposed Telegraph Canyon Creek Flood Control Project are
located within the territorial limits of the City of Chula Vista; and
WHEREAS, the real properties or interests therein sought to be
acquired are necessary for the proposed project; and
WHEREAS, the Real Property Management Division of the County of San
Diego on behalf of the City established the amount which it believes to be the
just compensation for the hereinafter described real properties or interests
therein sought to be acquired, and
WHEREAS, said County acting as the agent for the City of Chula Vista
has offered to the owners of said real properties or interests therein the
full amount established as just compensation for said real properties or
interests therein sought to be acquired; and

WHEREAS, said County provided said owners of said real properties or
interests therein a written statement of the summary of the basis for the
amount established as just compensation for the real properties or interests
therein sought to be acquired; and
WHEREAS, the owners have rejected the offers of the amounts
established by said County as just compensation and have not entered into
contracts to acquire the properties and a reasonable length of time has
expired since the date of the offers to the owners of the real properties or
interests therein sought to be acquired, it now becomes necessary to proceed
with the filing of suits under eminent domain in order to accomplish the
improvement of the Telegraph Canyon Creek Flood Control Project; and
WHEREAS, pursuant to the provisions of California Code of Civil
Procedure Section 1245.235, the owners of the real properties or the interests
therein sought to be acquired whose names and addresses appear on the current
equalized County assessment roll have been sent a Notice of Intention to Adopt
a Resolution declaring public necessity and have been provided with an
opportunity to appear and be heard on the matters referred to in California
Code of Civil Procedure Section 1240.030.
NOW, THEREFORE, BE IT RESOLVED that this Council finds and determines
based upon the Statement of Facts, attached hereto as Exhibit "A", and hereby
declares that:
The public interest and necessity as evidenced by the Statement of
Facts, require the acquisition and construction by the City of Chula Vista of
the proposed Telegraph Canyon Creek Flood Control Project in order to
alleviate the loss of property and the disruption of daily activities when
flooding occurs.
The proposed Telegraph Canyon Creek Flood Control Project is planned
and located in a manner which will be the most compatible with the greatest
public good, the least private injury, and the most efficient operation for
controlling flood waters. This finding is supported by the evidence in the
Statement of Facts.
The real properties or interests therein hereinafter described in
this resolution are necessary, as stated in the Statement of Facts, for the
proposed Telegraph Canyon Creek Flood Control Channel due to its size which is
based upon the appropriate geometric design for the project.
The proposed Telegraph Canyon Creek Flood Control Project is a matter
of public necessity in that the construction of the project will not occur
without the acquisition of the necessary property.
The use of all and each and every part of said hereinafter described
real properties or interests therein for the use and purpose of the Telegraph
Canyon Creek Flood Control Project is a public use and a use authorized by law.
The public interest and necessity require that permanent easements
and temporary construction easements be taken as described in the parcel
descriptions attached hereto and marked Exhibit

The properties will be acquired in the name of the City of ~hula
Vista.
The offer required by Section 7267.2 of the Government Code has been
made to the owner or owners of record.
BE IT FURTHER RESOLVED by this Council that the City Attorney of the
City of Chula Vista be and is hereby authorized and empowered and directed in
the name of the City of Chula Vista:
To acquire by donation, purchase or condemnation, in accordance with
the provisions of the Code of Civil Procedure of the State of California
relating to eminent domain, the hereinafter described interests in real
property.
To prepare and prosecute in the name of the City of Chula Vista such
suit or suits in the proper court having jurisdiction thereof as are necessary
to condemn, take and acquire said hereinafter described real properties or any
part thereof for the Telegraph Canyon Creek Flood Control Project, and to that
end, to make or cause to be made at the expense of said City whatever title
searches are necessary to do or cause to be done such other work as is
necessary to acquire real property or interests therein hereinafter described.
To make an application to said court for an order determining the
amount of money to be deposited as security for the payment of the just
compensation which will be made for the taking of the real properties or any
part thereof or interests therein necessary for Telegraph Canyon Creek Flood
Control Project and any damage incident thereto and to make application to
said court for an order permitting the City to take immediate possession of
and to use said real properties, any part thereof or interest therein sought
to be condemned for the Telegraph Canyon Creek Flood Control Project.
To make deposit for such security for such real properties out of
proper funds under control of the City, in the amount determined by the court
in the manner directed by the court.
To incur on behalf of the City all reasonable and necessary expenses
in the prosecution of a suit or suits to condemn said real property.
BE IT FURTHER RESOLVED by this Council that the City Attorney of said
City of Chula Vista, be and is hereby authorized to execute contracts for the
employment of expert valuation witnesses when said City Attorney determines
that the prosecution of the acquisition so requires.
The real property referred to above in this resolution is situated in
the City of Chula Vista, County of San Diego, State of California, and is
particularly described in the parcel descriptions attached hereto and marked
Exhibit

STATEMENT OF FACTS
SUPPORTING FINDINGS IN RESOLUTION OF NECESSITY
FOR THE TEL£GRAPH CANYON CREEK FLOOD CONTROL PROJECT
1. The Public Interest and Necessity Require the Project
This project includes the construction of (1) a 0.7 mile-long rectangular
concrete-lined channel from a point about 500 feet upstream from Fourth
Avenue to 0.3 miles upstream from Interstate 5; (2) a 0.3 mile-long
section consisting of double 10 x 12 foot boxes of covered channel
connecting the rectangular channel to the existing 0.2 mile culvert under
Interstate 5, which will be incorporated into the project; (3) a 0.3 mile
long concrete trapezoidal channel downstream from Interstate 5; and (4) a
0.1 mile long earth bottom trapezoidal channel leading into the San Diego
Bay. The attached resolution of condemnation is for the acquisition of
right of way to construct the project. These facilities will provide
protection from a 100 year flood to urban developments along about 1.6
miles of the Telegraph Canyon Creek.
The widespread flood control that will accrue to the property owners,
occupants and motorists in the area greatly outweigh the relatively minor
inconvenience and property cost caused by the right of way acquisition and
construction activities.
2. The Proposed Project is Planned and Located in the Manner that Will be
~ompatible with the Greatest Public Good and Least Private Injury
The project alignment generally follows the existing natural bed of the
Telegraph Canyon Creek. The recommended improvements were selected to
accommodate both Engineering requirements and public input. Citizen
participation has been an important ingredient in the formulation of the
project. The Telegraph Canyon Creek Citizen Advisory Committee was formed
on September 20, 1972 to assist the Corps of Engineers in the development
of alternative solutions to the flood problems on Telegrpah Canyon Creek.
Several public hearings were held between 1972 and 1975. Subsequent to
these meetings the advisory committee recommended a combination
structural and non structural solutions. The solution selected for
construction is based on the advisory committee recommendations and is the
result of an assessment and evaluation of detailed plan alternatives
conducted by the Corps of Engineers. The evaluation included factors such
as: cost, type, location, extent, environmental considerations and social
effects associated with the construction of each alternative studied. The
study is summarized in the Detailed Project Report (DPR) for the project
and the accompanying Final Environmental Impact Statement (EIS) dated
duly 1983.

3. The Property Described in the Resolution is Necessary for th~
Proposed Project
Right of way requirements for the project are based on the geometric
design of the drainage improvements and the existing development
restraints. The majority of the right of way to be acquired is located
within the Telegraph Canyon Creek natural bed. The location of the
improvements required that access (temporary) easements be obtained to
provide reasonable construction areas to the contractor.
The right of way plans were prepared by the Corps of Engineers and
approved by both the County of San Diego Public Works Department and the
City of Chula Vista Engineering Division. In addition, the Chula Vista
Planning Department on July 23, 1985 completed a review of the location,
purpose and extent of the proposed project and determined that its
location, purpose and extent are in conformity wi th the goals, objectives
and policies of the Chula Vista General Plan.
