VISTA (1) RATIFYING THE PROCLAMATION OF A LOCAL
EMERGENCY DECLARED ON MARCH 13, 2020 BY THE DIRECTOR
OF EMERGENCY SERVICES OF THE CITY OF CHULA VISTA AS A
RESULT OF THE COVID-19 VIRUS; (2) EXTENDING SAID
PROCLAMATION UNTIL MAY 12, 2020 AT 5:00 PM; (3) DIRECTING
AND AUTHORIZING THE CITY DIRECTOR OF EMERGENCY
SERVICES TO OBTAIN ANY AND ALL LOCAL, COUNTY, STATE,
AND FEDERAL AID TO ASSIST IN ADDRESSING THE
AFOREMENTIONED STATE OF EMERGENCY; AND (4)
AUTHORIZING THE CITY MANAGER AND PURCHASING AGENT TO
MAKE PURCHASES, AS NEEDED, PURSUANT TO CHULA VISTA
MUNICIPAL CODE SECTION 2.56.100 [EMERGENCY PURCHASES]
WHEREAS, there exists the COVID-19 virus, which represents a serious public
health threat; and
WHEREAS, on January 30, 2020, United States Health and Human Services
Secretary Alex M. Azar II declared a Public Health Emergency for the United States to
aid the nation’s health care community in responding to the COVID-19 virus; and
WHEREAS, on February 14, 2020, the San Diego County Health Officer
declared a Local Health Emergency as a result of the COVID-19 virus, which was
subsequently ratified by the Board of Supervisors on February 19, 2020; and
WHEREAS, on March 4, 2020, the State of California declared a State of
Emergency as a result of the COVID-19 virus (https://www.gov.ca.gov/wp-
content/uploads/2020/03/3.4.20-Coronavirus-SOE-Proclamation.pdf); and
WHEREAS, on March 13, 2020, the President of the United States declared a
national emergency as a result of the COVID-19 virus; and
WHEREAS, the number of COVID-19 virus cases are increasing, with many
cases in the State of California (https://www.cdc.gov/media/releases/2020/s-0303-
Additional-COVID-19-infections.html); and
WHEREAS, Government Code section 8630 authorizes local agencies to
proclaim a Local Emergency when such events occur, as defined by Government Code
section 8558(c), including an epidemic such as the COVID-19 virus; and
WHEREAS, the City of Chula Vista has hereby determined:
1. That conditions of extreme peril to the safety of persons and property have arisen
within the City of Chula Vista caused by the COVID-19 virus (which has also
been declared a Global Pandemic by the World Health Organization
(https://www.who.int/dg/speeches/detail/who-director-general-s-opening-
remarks-at-the-media-briefing-on-covid-19---11-march-2020)); and
2. That the COVID-19 virus may be transmitted through contact with exposed
persons and through “community spread”
(https://www.cdc.gov/coronavirus/2019-ncov/about/transmission.html.); and
3. That these conditions are likely to be beyond the normal capacity and control of
the services, personnel, equipment, facilities, and resources of the City of Chula
Vista; and
4. That the City, as a result of those conditions, has convened its Disaster Council
and opened its Emergency Operations Center and is taking steps to address the
COVID-19 virus; and
5. That City staff has taken and continues to take appropriate action(s) to meet the
conditions presented by the COVID-19 virus; and
WHEREAS, the City of Chula Vista Director of Emergency Services issued a
Proclamation declaring a Local Emergency, as authorized by Government Code section
8630 and Chula Vista Municipal Code section 2.14.080(a), on March 13, 2020 as a result
of the COVID-19 virus.
NOW, THEREFORE, based on the facts and circumstances set forth above, the
City Council of the City of Chula Vista hereby resolves as follows:
1. The Proclamation of Local Emergency issued by the Chula Vista Director of
Emergency Services is hereby ratified and that the City Council also adopts
findings and determinations made by the Director of Emergency Services in
support of said Proclamation.
2. The aforementioned Proclamation of Local Emergency is hereby extended and
shall expire on May 12, 2020 at 5:00 pm, unless otherwise lawfully extended, or
terminated earlier by the Director of Emergency Services.
3. That the Director of Emergency Services, or their designee, is directed and
authorized to address any and all impacts and conditions caused by the COVID-
19 virus and to obtain any and all aid and assistance from local, county, state, or
federal agencies, including but not limited to aid and assistance pursuant to the
California Disaster Assistance Act (“CDAA”).
4. That the City Manager and Purchasing Agent, as a result of this Resolution
ratifying the Proclamation of Local Emergency, is also hereby authorized to make
purchases of supplies, equipment, or contractual services in the open market at
the lowest obtainable price as set forth in and in compliance with Chula Vista
Municipal Code section 2.56.100(A) and (B) [Emergency Purchases].
