HomeMy WebLinkAbout2020-02-18 Item 13 Resolution RESOLUTION NO. __________ RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA SUPPORTING STATE SENATE BILL 723 (JONES), WHICH SEEKS TO CLARIFY STATE LAW AS IT PERTAINS TO INDIVIDUALS WHO ARE PROHIBITED FROM POSSESSING A FIREARM AND ASSOCIATED PUNISHMENTS WHEREAS, Senate Bill 723 would protect due process for legal gun ownership and implement needed criminal justice reform; and WHEREAS, existing law makes it a crime for a person to own or possess a firearm if the person has an outstanding warrant for a felony or one of several specified misdemeanors, and it makes these crimes inapplicable to a person who did not have knowledge of the outstanding warrant; and WHEREAS, Senate Bill 723 would expressly clarify that a crime is committed if the person has an outstanding warrant for a felony or specified misdemeanor and has knowledge of the outstanding warrant; and WHEREAS, on January 21, 2020, Senate Bill 723 was passed unanimously in the State Senate and was ordered to the Assembly. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista, that it supports Senate Bill 723 and its provisions to clarify state law as it pertains to individuals who are prohibited from possessing a firearm and associated punishments. BE IT FURTHER RESOLVED by the City Council of the City of Chula Vista, that it directs the City Clerk to send a copy of this resolution to Senator Brian Jones, and to the Honorable members of the State Assembly who represent the San Diego region, to demonstrate City Council’s support for Senate Bill 723.
