HomeMy WebLinkAboutReso 1986-12675 RECOrDInG REQUE$~E~ cl /4O/j/ ?tD/a ssozu'r o NO. 12675 VISTA ESTABLISHING AN UNDERGROUND UTILITY DISTRICT NO. 118 ON FOURTH AVENUE (HERMOSA AVENUE) FROM ORANGE AVENUE '['O MAIN STREET AND AUTHORIZING THE EXPENDITURE OF Ai,LOCAT ION FUNDS TO SUBSIDIZE THREE SINGLE-FAMILY RESIDENTIAL SERVICE LATERAL CONVERSIONS The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, by Resolution NO. 12572, a public hearing was called for 7:00 p.m. on Tuesday, the 12th day of August, 1986, in the Council Chambers of the City of Chula Vista at 276 Fourth Avenue in said City, to ascertain whether the public health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication or similar or associated service within that certain area of the City more particularly described as follows: Ail that property lying along Fourth Avenue (Hermosa Avenue) from Orange Avenue to Main Street and enclosed within the boundary as shown on the plat attached hereto as Exhibit "A" of Underground Utility District No. 11~ and WHEREAS, notice of such hearing has been given to all affected property owners as shown on the last equalized assessment roll, and to the utility companies concerned in the manner and for the time required by law, and WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard, and WHEREAS, the City of Chula Vista by this resolution hereby creates an underground utility district identified as Underground Utility District No. 118 along Fourth Avenue (Hermosa Avenue) from Orange Avenue to Main Street, and WHEREAS, C.P.U.Co Decision 82-01-18 provides that upon request of a local governing body, the utility will pay up to 100 feet of the customer's service lateral and the City of Chula Vista hereby requests SDG&E to expend Tariff Rule 20.A and Pacific Bell to expend Tariff Rule 32.A allocated funds for existing customers within established Underground Utility District No. 118 and for which specific addresses are listed in Exhibit "A", and -1- 1859 WHEREAS, C.P.U.C. Decisio~ 82-01-18 gives authority to usc allocated funds for customers' service laterals, and WHEREAS, the customers' conversion of their service equ~pm,~t will not be part of any 20.A or 32.A allocated funds to be disbursed, al]d %~HEREAS, the utility companies will pay for, but not ~nstall, up to 100 feet of service lateral, and WHEREAS, the list of customers involved is attached hereto as Exhibit 'A" incorporated herein by reference as if set forth in full, and WHEREAS, the utility companies will make only one payment to the City which will represent the total amounts agreed upon for the customers' service laterals listed in the exhibit, and WHEREAS, the City will set a limit for the amount of allocations to be applied to each service lateral which will be stated in the exhibit. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista hereby finds and determines that the public health, safety and welfare requires the removal of poles, overhead wires and associated structures, and the underground installation of wires and facilities for supplying electric, communication or similar associated services, the above-described area is hereby declared an Underground Utility District, and is designated as such in the City of Chula Vista. Attached hereto, marked Exhibit "A', and incorporated herein by reference is a map delineating the boundaries of said District. BE IT FURTHER RESOLVED that the City Council shall, by subsequent resolution, fix the date on which affected property owners must be ready to receive underground service, and does hereby order the removal of all poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication or similar associated service within said Underground Utility District. BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to notify all affected utilities and all persons owning real property within said Underground Utility District of the adoption of this resolution within fifteen days after the date of said adoption. Said City Clerk shall further notify said property owners of the necessity that, if they or any person occupying such property desires to continue to receive electric, communication or other similar or associated service, they, or such occupant shall, by the date fixed in a subsequent resolution provide all necessary facility changes on their premises so as to receive such service from the lines of the supplying utility or utilities at a new location, subject to the applicable rules, la6O regulatio.s an,] tariffs of the respective utility or utilities on file witl] the Public Utilities Commission of the State of California as of the date of adoption of this resolution. Such ~otification shall be made by mailing a copy of this resolution to affected property owners as shown on the last equalized assessment roll and to the affected utility companies. BE IT FURTHER RESOLVED that the City Council hereby finds that the Underground Utility District herein created is in the general public interest for the following reasons: 1. That the undergrounding to be accomplished will avoid or eliminate an unusually heavy concentration of overhead distribution facilities. 2. That the streets, roads or rights-of-way in the District are extensively used by the general public and carry a heavy volume of pedestrian or vehicular traffic. BE IT FURTHER RESOLVED as follows: 1. The City of Chula Vista elects to establish a limit of $300 per service lateral which represents the total cost or subsidy to help offset the cost of such service laterals, up to 100 feet in length. The amount per customer shall be specified in Exhibit "A'. 2. The customer's conversion of their service equipment will not be considered part of the service lateral and therefore will not be allocated any 20.A and 32.A funds. This would be in conformity with C.P.U.C. Decision 82-01-18. 3. A service lateral, for the purpose of definition, shall mean: trench, backfill, and any necessary conduJt from the customer's property line to the underground sweep at the base of the customer's termination facility. In those cases where the service conduit enters the customer's building, the service lateral will terminate at the point where the conduit enters the building. 4. When all customers have satisfactorily backfilled the trench, and passed City inspection for the conversion of their electric metering equipment to receive underground service, the utility companies will pay the City of City Vista ~255 which represents an amount equal to the total cost of all service laterals specified in Exhibit A. ohn P.
