HomeMy WebLinkAboutReso 1986-12672· ' 1843 RESOLUTION NO. 12672 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ACCEPTING GRANT OF EASEMENT FOR STREET PURPOSES IN LAS FLORES DRIVE SOUTH OF "D" STREET, DEDICATING SAID STREET TO PUBLIC USE AND OFFICIALLY NAMING SAID STREET "LAS FLORES DRIVE" The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, on March 17, 1986, Tentative Parcel Map 86-4 was conditionally approved by the Engineering and Planning Departments, and WHEREAS, among the conditions of approval was the requirement that the owner obtain an easement for access purposes to provide adequate access to the subject property, and WHEREAS, the adjacent property owner has agreed to dedicate right-of-way in Las Flores Drive to provide the access required. NO%~, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that that certain grant of real property, made by easement, executed by Jacqueline Lazo, James B. Kelly and Reinaldo and Nancy Lazo, dated the 15th day of February, 1986, a copy of which is attached hereto and incorporated herein by reference as if set forth in full, be, and the same is hereby accepted and dedicated for street purposes. HE IT FURTHER RESOLVED that said real property is hereby officially named "Las Flores Drive". BE IT FURTHER RESOLVED that the City Clerk of the City of Chula Vista be, and she is hereby authorized to record said easement in the office of the San Diego County Recorder. The Grantor hereby further grants to Grantee all trees, growths (growing or that may hereafter grow), and road building materials within said right-of-way, including the right to take water, together with the right to use the same in such manner and at such locations as said Grantee may deem proper, needful or necessary, in the construction, reconstruction, improvement or maintenance of said public street. Lee Principal Planner City of Chula Vista Department of Planning 276 Fourth Avenue Chula Vista, California 92010 Subject: Parcel Map 86-4 - Lot Line Adjustment Dear Mr. Lee: On Friday 2-7-86 we met and discussed the reasons for denial on the above map, and agreed to the following solutions. A. Because an easement is required for our access into Lots 2, 3 & 4 through L~s Flores, it was decided that we would arrange for the 0wners of Assessor's Parcel #566-251-24 to dedicate that portion of their property within the proposed cul-de-sac on Las Flores to the City of Chula Vista. You will find the EASEMENT FOR STREET PURPOSES executed by the proper parties and attached. B. Because of the existing encroachment along the northerly adjacent lot on Minot Avenue, it was decided that a lot line adjustment would satisfy the City of Chula Vista. Therefore; we have attached a letter signed by all parties that the Owners promise to submit to the City of Chula Vista a lot line adjustment to allow a 3 foot set back from the structure located on Parcel 566-251-24 (184 Minot). This lot line adjustment process will commence immediately and shall be completed as a condition to the Final Map. Since the above items have now been resolved we hope to have the Tentative Map approved and those Conditions of Approval amended as indicated in your letter dated 12-31-85, file EP-045.
