RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA APPROPRIATING $55,000 TO PAY FOR
CONTRACTUAL SERVICES FOR TRANSPORTATION OF
CONTAMINATED SOIL; WAIVING THE FORMAL BIDING
PROCESS AND SUPPORTING AB 853
The City Council of the City of Chula Vista does hereby
resolve as follows:
%~HEREAS, in February, 1986, staff informed the City
Council of a leak in the underground fuel storage tank at Fire
Station No. 4, and
WHEREAS, the State of California's Underground Storage
Tank Regulations requires the City to notify the County Health
Department, Hazardous Materials Management Unit, of all
unauthorized releases of hazardous materials, and
WHEREAS, the leakage of fuel from an underground storage
tank is an unauthorized release of hazardous materials, and
WHEREAS, the mitigation of this hazardous condition
requires the removal and disposal of approximately 200 cubic
yards of dirt, and
~HEREAS, the removal of the contaminated soil must be
done in the shortest amount of time possible due to additional
storage costs and the need to remove hazardous materials as
quickly as possible, and
WHEREAS, staff has contacted three contractors who are
licensed to do the type of removal and disposal of contaminated
soil that is required by this situation.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista hereby appropriates ~55,000 from the
unappropriated balance of the General Fund to pay for the cost of
removal and disposal of approximately 200 cubic yards of
contaminated soil.
BE IT FURTHER RESOLVED that based upon the staff report
presented to the Council and the need to expeditiously remove the
contaminated soil, the Council hereby waives the formal bid
process as permitted under Chula Vista Municipal Code Section
2.56.170.

BE IT FURTHER RESOLVED that the Council hereby supports
the adoption of AB 853 relating to state reimbursement of city
expenses which result from hazardous waste clean up.
BE IT FURTHER RESOLVED that the City Manager or his
designee is hereby authorized to enter into a contract for the
disposal of the contaminated soil as indicated in the staff
report.
