RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA ACCEPTING BIDS; WAIVING COMPETITIVE
BIDDING REQUIREMENTS; AND AWARDING A
CONTRACTOR SERVICES AGREEMENT BETWEEN THE
CITY AND AZTEC LANDSCAPING, INC. TO PROVIDE ON-
CALL OPEN SPACE LANDSCAPING SERVICES
WHEREAS, the City requires landscape services in order to maintain the City open space
areas; and
WHEREAS, the City desires to procure qualified contractors to perform a variety of
landscape services; and
WHEREAS, on September 6, 2019, the City issued a Request for Qualifications (RFQ)
for On-Call Open Space Landscape Services; and
WHEREAS, the City received five (5) proposals from contractors interested in providing
on-call landscape services; and
WHEREAS, the City’s contractor selection committee completed its review of the
proposals and determined Aztec Landscaping, Inc. as one of four (4) firms to provide such
services; and
WHEREAS, the contractor selection process has been conducted in accordance with
Section 2.56.070.B.3 of the Chula Vista Municipal Code whereby the Purchasing Agent
approved applying a different purchasing process, as identified herein and in the agenda
statement hereto, as consistent with good purchasing practices; and
WHEREAS, the City may procure work on zero up to several projects of varying size and
complexity throughout the duration of the contractor agreement; and
WHEREAS, the contractor agreement will be a five-year contract and the combined total
of all assigned projects per the contractor agreement will not exceed $1,000,000 in the aggregate.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vist a
City that it accepts bids and waives competitive bidding requirements pursuant to Chula Vista
Municipal Code section 2.56.070.B.3 based on its finding that the City’s interests would be
materially better served by applying a different purchasing procedure approved by the
Purchasing Agent as being consistent with good purchasing practices.
BE IT FURTHER RESOLVED by the City Council of the City of Chula Vista that it
approves the City of Chula Vista Contractor/Service Provider Agreement with Aztec
Landscaping, Inc. to Provide On-Call Open Space Landscape Services, in the form presented,
with such minor modifications as may be required or approved by the City Attorney, a copy of
which shall be kept on file in the Office of the City Clerk and authorizes and directs the Mayor to
execute same.
