HomeMy WebLinkAboutReso 1986-12618 Revised 8/1/86 RESOLUTION NO. 12618 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A ELECTION TO BE HELD IN SAID CITY ON TUESDAYt NOVEMBER 4~ 1986~ FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED ELECTORS OF CHULA VISTA, A VOTE ON THE OFFICE OF MAYOR AND THE OFFICE OF THE CITY COUNCIL SEAT NO. 3, TWO PROPOSITIONS AMENDING THE CHARTER OF THE CITY OF CHULA VISTA, AND CONSOLIDATING SAID ELECTION WITH THE GENERAL ELECTIONS TO BE HELD ON THE SAME DATE The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, pursuant to the provisions of Section 5 of Article XI of the Constitution of the State of California and the Elections Code of the State of California, the City Council of the City of Chula Vista, being the legislative body thereof, hereby proposes and submits to the qualified electors of said City at a consolidated municipal election to be held in said City on November 4, 1986 a vote on the office of Mayor and the office of City Council Seat No. 3, and two propositions or measures relating to the amendment of the City Charter as hereinafter set forth. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CHULA VISTA~ CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That pursuant to the requirements of the State Constitution and the Elections Code of the State of California, there shall be and there is hereby called and ordered, held in said City on Tuesday, November 4, 1986, a consolidated municipal and general district election for the purpose of submitting to the qualified electors of said City a vote on the office of Mayor and the office of City Council Seat No. 3, and two propositions amending the Charter of the City of Chula Vista. Section 2. That said City Council, pursuant to its right and authority so to do, does hereby determine that there shall be and there is hereby ordered submitted to the qualified electors of said City at said special municipal election the following questions to-wit: -1- An amendment to the Charter of the City YES of Chula Vista amending Article III, Section 311(d) to read that the City Council may by a four-fifth's vote enact an emergency ordinance to take effect NO immediately to protect the general welfare. An amendment to the Charter of the City of Chula Vista amending Article IX, YES Section 900 to consolidate the municipal elections to City Council with the NO statewide general elections in November. Section 3. That the ballots to be used at said election shall be, both as to form and matter contained therein, such as may be required by law to be used thereat. Section 4. That the City Clerk of said City is hereby authorized, instructed and directed to procure and furnish any and all official ballots, notices, printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct said election. Section 5. That the polls for said election shall be open at seven o'clock a.m. of the day of said election and shall remain open continuously from said time until eight o'clock p.m. of the same day when said polls shall be closed, except as provided in Section 14301 of the Elections Code of the State of California. Section 6. That in all particulars not recited in this Resolution, said election shall be held and conducted as provided by law for holding municipal elections in said City. Section 7. That notice of the time and place of holding said election is hereby given and the City Clerk is hereby authorized, instructed and directed to give such further or additional notice of said election, in time, form and manner as required by law. Section 8. That the City Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the book of original Resolutions of said City; and shall make a minute of passage and adoption thereof in the records of the pro- ceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
