RESOLUTION NO. 12605
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA ACCEPTING GRANT OF EASEMENT FROM
HART AND SONS FOR DEDICATION OF RIGHT-OF-WAY
AT 916 FOURTH AVENUE
The City Council of the City of Chula Vista does hereby
resolve as follows:
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Chula Vista that that certain grant of easement
for dedication of right-of-way at 916 Fourth Avenue
executed by Hart & Sons, a partnership
dated the 16th day of May , 1986 , a
copy of which is attached hereto and by this reference made a
part hereof as though fully set forth herein, be and the same is
hereby accepted by the City of Chula Vista.
BE IT FURTHER RESOLVED that the City Clerk of the City
of Chula Vista be, and she is hereby authorized and directed to
record said easement in the office of the San Diego County
Recorder.

Easement for Street Purposes
do(es) hereby grant, convey and dedicate to the CITY OF CHULA VISTA,
State of California, the right of way and incidents thereto for a public
street upon, over and across that certain real property in the City of
Chula Vista, County of San Diego, State of California, described as
follows:
.~e Easterly 2.0 feet of the following described land:
All that portion of Lot 20 in Quater Section 146 of Chula Vista, Rancho De La
Nacion, in the City of Chula Vista, County of San Diego, State of California,
according to Map thereof No. 505, filed in the Office of the County Recorder
of said San Diego County, March 13, 1888, described as follows:
Beginning at the Northeasterly corner of said Lot 20; thence Southeasterly
along the Easterly line of said Lot, 290 feet, more or less, to the South-
easterly corner thereof; thence Southwesterly aloog the Southerly line of
said Lot, 356.56 feet to the Southeasterly corner of a Parcel of land conveyed
by Belle Emrick to James Yule and wife, by deed dated September 21, 1925 and
recorded in Book 1131, Page 107 of Deeds, in the Office of the County Recorder
of said San Diego County; thence Northwesterly along the Easterly line of said
Parcel so conveyed to Yule, 290.64 feet to the Northeasterly corner thereof,
being a point on the Northerly line of said Lot 20; thence Northeasterly along
the Northerly line of said Lot~ 356.56 feet to the Point of Beginning.
Excepting therefrom that portion lying Northerly of a line described as follows:
Beginning at a point on the Easterly line of the above described land, which
is distant 158 feet Southerly from the Northeast corner of said Lot 20; thence
Westerly 356.56 feet to a point on the Westerly line of said land, distant
Northerly 132.00 feet from the Southwest corner thereof.

The Grantor h~reby further grants to the City of Chula V~sta the' pri~i~e
and right to extend drainage structures and excavation and embankment slop~
beyond the limits of the herein described right-of-way where required for
the construction and maintenance of said public street. RESERVING unto
grantor Of the above described parcel of land, his successors or assigns,
the right to eliminate such slopes and/or drainage structures or portions
thereof, when in the written opinion of the City Engineer of Grantee, the
necessity therefore lis removed by substituting other protection,
support
and/or drainage facility, provided such substitution is first approved in
writing by said City Engineer.
The Grantor hereby further grants to Grantee all trees, growths (growing
or that may hereafter grow), and road building materials within said
right-of-way, including the right to take water, together with the right
to use the same in such manner and at such locations as said Grantee may
deem proper, needful or necessary, in the construction, reconstruction,
improvement or maintenance of said public street.
The Grantor, for himself, his successors and assigns, hereby waives any
claim for any and all damages to Grantor's remaining property contiguous
to the right-of-way hereby conveyed by reason of the location, constructior
landscaping or maintenance of said public street.
