RESOLUTION OF THE CITY COUNCIL GRANTING A MAJOR
USE PERMIT FOR AN AUTOMOBILE DISMANTLING
OPERATION AND A SCRAP OPERATION BOTH LOCATED AT
128 MACE STREET
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, a duly verified application for a conditional
use permit was filed with the Planning Department of the City of
Chula Vista on February 4, 1986 by Mary Reed, and
WHEREAS, said application requested the continuation of
existing scrap operations, and automobile dismantling facility
located at 128 Mace Street, within the M-58 Heavy Industrial
Zone, and
WHEREAS, the City Council set the time and place for a
hearing on said conditional use permit application and notice of
said hearing, together with its purpose, was given by its
publication in a newspaper of general circulation in the city and
its mailing to property owners within 300 feet of the exterior
boundaries of the property at least ten days prior to the
hearing, and
WHEREAS, the hearing was held at the time and place as
advertised, namely 7:00 p.m., June 24, 1986, in the Council
Chambers, 276 Fourth Avenue, before the City Council and said
hearing was thereafter closed, and
WHEREAS, the City Council requested the conditional use
permit distinguish between the two existing businesses as an
automobile dismantling operation and a scrap operation facility,
and
WHEREAS, the Council found that the projects would have
no significant environmental impact and adopted the Negative
Declarations issued on IS-86-31M, dated March 21, 1986 and May
29, 1986, and
WHEREAS, the City Council has considered the staff's
report and public testimony prior to the consideration of this
motion.

NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL
hereby approves the request for the Major Use Permit for the two
businesses identified as an automobile dismantling operation and
a scrap operations facility both located at 128 Mace Street and
owned by Mary Reed.
BE IT FURTHER RESOLVED that the Major Use Permit
approved for the portion of the property located at 128 Mace
Street now engaged in scrap operations which extends from the
eastern property boundary abutting Mace Street to the existing
fence bisecting the property 300 feet west be approved subject to
the following conditions:
1. The existing scrap operations use shall be
terminated no later than December 31, 1986. Any use proposed
after this time which involves the dismantling of automobiles or
scrap operations shall require approval of a new Major Use Permit.
BE IT FURTHER RESOLVED that the approval of the Major
Use Permit for the scrap operations facility be based on the
following findings:
1. The proposed use is the continuation of existing
facilities which provide for the storage and recycling of
inoperable vehicles for reuse by the community. The use is of a
short-term nature, to be terminated as of December 31, 1986.
2. Approval of the proposed use as conditioned for the
short time frame specified, will not result in impacts from noise
or aesthetic degradation that will adversely affect humans or
surrounding properties.
3. The proposed use complies with Zoning Ordinance
requirements governing the Montgomery annexation area for the
M-58 heavy industrial zone, with approval of a major use permit.
4. In granting continuation of an existing use for an
interim period pending completion of the Montgomery Specific
Plan, approval of the Major Use Permit will not adversely affect
the General Plan of the City of Chula Vista.
BE IT FURTHER RESOLVED that the Major Use Permit
approved for the portion of the property located at 128 Mace
Street now engaged in automobile dismantling operations which
extends from the western property boundary abutting Center Street
to the existing fence bisecting the property 300 feet east be
approved subject to the following conditions:

1. Requested auto dismantling use shall be approved for
twenty-four months or until sixty days after adoption of the
Montgomery Specific Plan whichever occurs sooner.
2. Perimeter fence at eight foot height shall be
repaired and maintained in good condition within thirty days
after approval of the Major Use Permit and shall be maintained in
good condition thereafter.
3. No auto dismantling shall be conducted outside the
perimeter fence. All storage, scrap or other articles shall be
kept behind and below the fence line so that it may not be seen
from outside the property. Trucks shall be tied down and cleaned
of debris on sight within the perimeter fence and shall not
conduct such activities within the right of way.
4. Operation of all equipment associated with the use
must comply with the performance standards outlined in Section
6300 of the Zoning Ordinance for operations within an M-58 zone.
Should noise levels exceed the performance standards, all
necessary measures shall be taken to achieve compliance with the
standards.
5. Interim dust control measures shall be instituted
along the Briton Avenue right of way for that period of time
prior to installation of paving and road improvements. Specific
design of interim measures shall be determined by the Engineering
Department with due consideration being given to accommodate the
size and weight of vehicles being used by the applicant. Plans
and schedules for the installation of temporary improvements are
subject to the approval of the Director of Planning.
6. That an agreement be entered into between the
applicant and the Director of Planning to the satisfaction of the
City Attorney's office. Said agreement would be for the purpose
of reasonable maintenance of the public street adjoining the
project site for the removal and disposal of abandoned cars and
scrap materials. Said agreement shall require that maintenance
occur on a weekly basis. This agreement shall be entered into
within thirty days from the granting of the Major Use Permit.
BE IT FURTHER RESOLVED that the approval of the Major
Use Permit for the automobile dismantling operations be based on
the following findings:
1. That the proposed use is a continuation of existing
facilities which provide for the storage and recycling of
inoperable vehicles for reuse by the community. The use is
compatible with several allied automotive related industries
located throughout the area.

2. Approval of the proposed use as conditioned will not
result in impacts from noise or aesthetic degradation that will
adversely affect humans or surrounding properties. The
conditions of approval of the Major Use Permit require that the
project adhere to performance standards outlined in the Zoning
Ordinance to control noise impacts and also require that the
operations be contained within an eight foot perimeter fence to
screen views of the use from surroundinf areas.
3. The proposed use complies with Zoning Ordinance
requirements governing the Montgomery annexation for the M--58
heavy industrial zone with approval of a Major Use Permit.
4. In granting continuation of an existing use for an
interim period pending completion of the Montgomery Specific
Plan, approval of the Major Use Permit will not adversely affect
the General Plan of the City of Chula Vista.
