HomeMy WebLinkAboutReso 1986-12545 RESOLUTION NO. 12545 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA AMENDING THE MASTER FEE SCHEDULE TO SPECIFY A $25 AND $50 VARIANCE FEE FOR SATELLITE DISHES The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, on July 15, 1985 and January 7, 1986, the City Council passed regulations governing the placement of satellite dish antennas as well as amortization provisions for non-conforming dishes, and WHEREAS, on January 15, 1986, the Federal Communications Commission issued a report and order regarding preemption of local zoning of receive-only satellite to earth stations, and WHEREAS, the FCC order states that local regulations are preempted unless such regulations "do not operate to impose unreasonable limitations on, or prevent, reception of satellite delivered signals by receive-only antenna or to impose costs on the users of such antenna that are excessive in light of the purchase and installation cost of the equipment", and WHEREAS, Chula Vista's ordinance allows for a variance filing where it can be demonstrated that it is not feasible to locate a dish in accordance with the ordinance guidelines and still receive a signal, and WHEREAS, the current variance fees are $175 where no public hearing is involved and $300 if there is a public hearing, and WHEREAS, in the case of satellite dishes, no notification of and testimony from neighboring residents as to visual impact and health or safety considerations is important and thus makes a public hearing more likely to occur, and WHEREAS, the $300 can be considered an unreasonable cost toward compliance with these regulations. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby amend Section 19.14.030 and Section 19.14.160 of the Master Fee Schedule to specify a $25 fee for a variance for satellite dihes not involving a public hearing and a $50 variance fee for satellite dishes involving a public hearing.
