ROLL CALL: Present: Councilmember Diaz, Councilmember Galvez, Councilmember McCann, Deputy Mayor Padilla and Mayor Casillas Salas Deputy Mayor Padilla left at 6:01 p.m. Also Present: City Manager Halbert, City Attorney Googins, City Clerk Bigelow, and Deputy City Clerk Turner PLEDGE OF ALLEGIANCE TO THE FLAG AND MOMENT OF SILENCE Mayor Casillas Salas led the Pledge of Allegiance. SPECIAL ORDERS OF THE DAY A. 19-0202 OATH OF OFFICE Adriana Guevara Gluyas, Sustainability Commission City Clerk Bigelow administered the oath of office to Commissioner Gluyas, and Councilmember Diaz presented her with a certificate of appointment. B. 19-0065 PRESENTATION OF QUARTERLY EMPLOYEE RECOGNITION RECIPIENTS Benefits Manager Abalos recognized recipients of the quarterly employee awards. C. 19-0195 PRESENTATION ON THE CITY OF CHULA VISTA POLICE DEPARTMENT INNOVATION AWARD, SMART CITY BLUE PRINT AWARD AND PROCLAMATION PROCLAIMING APRIL 15 -19, 2019 AS SMART CITIES WEEK IN THE CITY OF CHULA VISTA Mayor Casillas Salas read the proclamation and Councilmember Galvez presented it to Police Chief Kennedy and Chief Sustainability Officer Gakunga who spoke regarding the Chula Vista Police Department Innovation Award and the Smart City Blue Print Award, respectively. E. 19-0196 PRESENTATION OF A PROCLAMATION PROCLAIMING APRIL AS ARTS, CULTURE, AND CREATIVITY MONTH IN THE CITY OF CHULA VISTA Mayor Casillas Sa/as read the proclamation and Councilmember Galvez presented it to Cultural Arts Program Manager Tessitore. CONSENT CALENDAR (Items 1 - 7) Items 2 and 7 were removed from the Consent Calendar at the request of a member of the public and Councilmember Diaz, respectively. City Attorney Googins announced that revisions to Item 58 had been distributed to the Council and that action on the item would be with respect to the revised ordinance. 1. 19-0214 APPROVAL OF MINUTES of November 27 and 28, 2018. Recommended Action:Council approve the minutes. Item 2 was removed from the Consent Calendar. 3. 19-0200 ORDINANCE NO. 3454 OF THE CITY OF CHULA VISTA AMENDING CHAPTER 15.06 OF THE CHULA VISTA MUNICIPAL CODE (ADMINISTRATIVE PROVISIONS FOR THE TECHNICAL BUILDING CODES) TO COMPLY WITH STATE LAW (SECOND READING AND ADOPTION) Recommended Action:Council adopt the ordinance. 4. 19-0119 ORDINANCE OF THE CITY OF CHULA VISTA AMENDING CHULA VISTA MUNICIPAL CODE SECTION 2.60, LOST AND STOLEN PROPERTY, TO CHANGE THE TITLE, MINIMUM HOLDING PERIOD AND TO MAKE OTHER UPDATES (FIRST READING) Recommended Action:Council place the ordinance on first reading. 5. 19-0120 A. RESOLUTION NO. 2019-051 OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ADOPTING CITY COUNCIL POLICY 505-04 (STATEMENT OF GOALS AND POLICIES REGARDING ESTABLISHMENT OF COMMUNITY FACILITIES DISTRICTS) City of Chula Vista Page 2 City Council Meeting Minutes-Final April 9,2019 (iiiw B. ORDINANCE OF THE CITY OF CHULA VISTA ADDING CHAPTERS 3.60 AND 3.61 TO THE CHULA VISTA MUNICIPAL CODE RELATING TO COMMUNITY FACILITIES DISTRICTS GENERALLY AND THE BAYFRONT PROJECT SPECIAL TAX FINANCING DISTRICT (FIRST READING) Recommended Action: Council adopt the resolution and place the ordinance on first reading. 6. 19-0173 RESOLUTION NO. 2019-052 OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THE FIRST AMENDMENT TO THE AGREEMENT FOR ADMINISTRATION OF TAXICAB AND OTHER FOR-HIRE REGULATIONS BETWEEN THE SAN DIEGO METROPOLITAN TRANSIT SYSTEM AND THE CITY OF CHULA VISTA Recommended Action:Council adopt the resolution. Item 7 was removed from the Consent Calendar. Approval of the Consent Calendar ACTION: A motion was made by Mayor Casillas Salas, seconded by Councilmember McCann, to approve staffs recommendations on the above Consent Calendar items,headings read,text waived.The motion carried by the following vote: Yes: 5- Diaz, Galvez, McCann, Padilla and Casillas Salas No: 0 Abstain: 0 ITEMS REMOVED FROM THE CONSENT CALENDAR 2. 19-0199 ORDINANCE NO. 3453 OF THE CITY OF CHULA VISTA AMENDING VARIOUS SECTIONS OF THE CHULA VISTA MUNICIPAL CODE (CVMC) TO CLARIFY PROVISIONS REGARDING ILLEGAL COMMERCIAL CANNABIS CONDUCT AND PENALTIES, INCLUDING CVMC SECTIONS 1.04.010, DEFINITION OF RESPONSIBLE PARTY, 1.41.110, CIVIL PENALTIES, 5.19.020, DEFINITIONS, AND 5.19.280, ENFORCEMENT AND PENALTIES (SECOND READING AND ADOPTION) Scott Chipman, representing San Diego for Safe Neighborhoods, spoke in support of the item and distributed written communications. Judy Strang, Chula Vista resident, spoke in support of the item. ACTION: A motion was made by Councilmember Diaz, seconded by Councilmember Galvez, to adopt Ordinance No. 3453, heading read, text waived. The motion carried by the following vote: Yes: 5- Diaz, Galvez, McCann, Padilla and Casillas Salas No: 0 Abstain: 0 City of Chula Vista Page 3 City Council Meeting Minutes-Final April 9,2019 Deputy Mayor Padilla left at 6:01 p.m. 7. 19-0174 RESOLUTION NO. 2019-053 OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING UPDATED DESIGN STANDARDS FOR SMALL WIRELESS FACILITIES WITHIN THE CITY'S RIGHT-OF-WAY AND DELEGATING AUTHORITY TO APPROVE FUTURE DESIGN STANDARDS TO THE CITY MANAGER OR DESIGNEE Director of Engineering Valle answered questions of the Council. ACTION: A motion was made by Councilmember Diaz, seconded by Councilmember Galvez, to adopt Resolution No. 2019-053, heading read, text waived. The motion carried by the following vote: Yes: 4- Diaz, Galvez, McCann and Casillas Salas No: 0 Abstain: 0 PUBLIC COMMENTS Carolyn Scofield, Chula Vista resident, representing Partners In Courage, spoke regarding Community Choice Aggregation (CCA) and submitted written documentation from other Chula Vista residents in support of CCA. CITY MANAGER'S REPORTS City Manager Halbert provided updates on the Friendship Park/Civic Center Library deck and City solar projects, and the Smart Cities efforts. MAYOR'S REPORTS Mayor Casillas Sa/as spoke regarding the following recent events: Fire Station 10 groundbreaking, ribbon cutting ceremony for new fire engines 54 and 56, First Friday Breakfast, San Diego Regional Chamber delegation visit to Mexico City to advocate for a third border crossing, Pints for Paws event, CAST graduation, Earth Day, and the ribbon cutting ceremony for the new basketball courts at Rohr Park. COUNCILMEMBERS' COMMENTS Councilmember McCann spoke regarding the following recent events: National Vietnam Veterans Day event at the Chula Vista Veterans Home, Pints for Paws, CAST graduation, Fire Station 10 groundbreaking, and the ribbon cutting ceremony for new fire engines 54 and 56. Councilmember Diaz reported on communications he had received expressing concem regarding fees for accessory dwelling units. At the request of Councilmember Galvez, there was consensus of the Council to make a referral to staff to propose an ordinance for Council consideration related to the upkeep and maintenance of privately owned newspaper stands and kiosks. Councilmember Galvez spoke regarding the following recent events: Broadway Business mixer, meeting with Parks and Recreation regarding off-leash dog parks, the Day of the Child, and the Sound the Alarm event hosted by the American Red Cross. City of Chula Vista Page 4 City Council Meeting Minutes-Final April 9,2019 8. 19-0210 COUNCILMEMBER GALVEZ: RESOLUTION NO. 2019-054 OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA DESIGNATING TALL SHIP BILL OF RIGHTS THE OFFICIAL TALL SHIP OF THE CITY OF CHULA VISTA AND AUTHORIZING IT TO FLY THE CITY'S FLAG ON ITS MAST Councilmember Galvez gave a presentation on the item. Susan Johnson, Chula Vista resident, spoke in support of the item and commended the City on its efforts related to the arts. ACTION: A motion was made by Councilmember Galvez, seconded by Mayor Casillas Salas, to adopt Resolution No. 2019-054, heading read, text waived. The motion carried by the following vote: Yes: 4- Diaz, Galvez, McCann and Casillas Salas No: 0 Abstain: 0 CITY ATTORNEY'S REPORTS City Attorney Googins spoke regarding his attendance at the 31st Annual National Conflict Resolution Center Peacemaker Gala and Awards ceremony. CLOSED SESSION City Attorney Googins announced that the Council would convene in closed session to discuss the item listed below. Mayor Casillas Salas recessed the meeting at 6:29 p.m. The Council reconvened in Closed Session at 6:32 p.m., with all members present except Deputy Mayor Padilla. Pursuant to Resolution No. 13706 and Council Policy No. 346-03, Official Minutes and records of action taken during Closed Sessions are maintained by the City Attorney. 9. 19-0184 CONFERENCE WITH LEGAL COUNSEL REGARDING EXISTING LITIGATION PURSUANT TO GOVERNMENT CODE SECTION 54956.9 (d)(1) Name of case: Leilani Kaloha v. City of Chula Vista, San Diego Superior Court, Case No. 37-2018-00004635-CU-PO-CTL. ACTION: Reportable action is pending finalization of settlement agreement.
