RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING AND AUTHORIZING THE EXECUTION OF THE JOINT EXERCISE OF POWERS AGREEMENT CREATING THE SAN DIEGO REGIONAL COMMUNITY CHOICE ENERGY AUTHORITY Monday, September 9, 2019 Dear Mayor Casillas Salas and City Council Members, Thank you for your ongoing and important leadership role in addressing the climate crisis in Chula Vista, especially moving our city forward tonight toward a historic decision for our region and a 100% clean energy future. Chula Vista Partners in Courage encourages you to vote YES on September 10 on Agenda Item #12 to establish Community Choice Energy (CCE) and join the San Diego Regional Community Choice Energy Authority as a founding member. Participation in the Regional JPA is an important opportunity. The economic and environmental benefits that we expect from CCE are greatly enhanced by participating in a larger scale program. Our risks are reduced through the JPA structure. Our regional leadership is increased. We are especially happy to see the recent changes in the JPA agreement that are in line with environmental justice values we promote. Language has been added about key policy provisions including prevailing wage, neutrality agreements, commitments to invest in frontline communities of concern, the exclusion of coal, higher rates of renewables, the development of a strategic plan, and commitment to form a Community Advisory Committee. These policies strengthen the health and well-being of our community. This important decision is time sensitive. If we do not move forward on September 10, we could lose the advantages of the regional program. The Staff Report enumerates possible effects of a delay, including loss of momentum to reach our clean energy goal, loss of cost saving and programs for residents, loss of the opportunity to have as many cities participate, and loss of regulatory influence and therefore representation for our residents and businesses. As the second largest city in San Diego county, our regional participation in Climate Action is essential. The Chula Vista Sustainability Commission and the Chula Vista City Staff recommend a YES vote on joining the Regional JPA. "PCE's achievement of an investment-grade credit rating speaks to the inherent strengths of the CCA business model in California, and the leadership role CCAs are playing in the state's efforts to lower greenhouse gas emissions and transition to cleaner energy resources," said Beth Vaughan, executive director of CaICCA. The benefits of a credit rating include the potential to negotiate lower energy prices and improved credit terms for future power purchasing needs, PCE noted in a May 6 news release. "This credit rating assures regulators and legislators that PCE's financial strength is sound and, in light of PG&E's bankruptcy filing, the CCA business model provides a stable framework for serving customers and advancing the state's low carbon energy future," PCE said. PCE provides Community Choice Aggregation (CCA) service to all cities and unincorporated areas in San Mateo County and is the second aggregator in California to be assigned a credit rating by Moody's in the past year. MCE, which serves 34 communities across four Bay Area counties (Napa, Marin, Contra Costa, and Solano), obtained a Baa2 Issuer Rating in May 2018. Moody's Issuer Rating is an independent assessment of the ability of entities to honor senior unsecured financial obligations and contracts. About CaICCA Launched in 2016, the California Community Choice Association (CaICCA) represents California's community choice electricity providers before the state Legislature and at regulatory agencies, advocating for a level playing field and opposing policies that unfairly discriminate against CCAs and their customers.
