Comments are limited to three minutes. ACTION ITEMS The item(s) listed in this section of the agenda will be considered individually by the Subcommittee and are expected to elicit discussion and deliberation. If you wish to speak on the item(s), please fill out a “Request to Speak” form and submit it to staff prior to the meeting. 1. APPROVAL OF MINUTES of August 5, 2019 Recommended Action: Subcommittee approve the minutes. 2. CONSIDERATION OF BOARD AND COMMISSION MEMBERS’ RESPONSES TO REQUEST FOR EXPLANATION, PURSUANT TO CVMC 2.25.105(D), "REMOVAL FOR CAUSE," FOR POTENTIAL RECOMMENDATIONS TO THE CITY COUNCIL At the meeting of August 5, 2019, following the review of annual attendance and training records, and reports submitted, the Subcommittee directed staff to contact specified members and request an explanation of their situations. Recommended Action: Subcommittee review the responses to the request for explanation and provide direction to staff as appropriate. OTHER BUSINESS 3. SUBCOMMITTEE MEMBERS’ COMMENTS ADJOURNMENT Materials provided to the subcommittee related to any open-session item on this agenda are available for public review in the City Clerk’s Office during normal business hours. Page 1 | Board and Commission Member Conduct Subcommittee Minutes August 5, 2019 MINUTES OF A MEETING OF THE BOARD AND COMMISSION MEMBER CONDUCT SUBCOMMITTEE OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA A meeting of the Board and Commission Member Conduct Subcommittee of the City Council of the City of Chula Vista was called to order at 4:00 p.m., in the Executive Conference Room, located in City Hall, 276 Fourth Avenue, Chula Vista, California. ROLL CALL Present: Mayor Casillas Salas and Deputy Mayor Padilla PUBLIC COMMENTS There were none. ACTION ITEMS 1. REVIEW AND DISCUSSION OF ANNUAL BOARD AND COMMISSION MEMBER ATTENDANCE AND TRAINING RECORDS, AND REPORTS, PURSUANT TO CVMC 2.25.105(D), "REMOVAL FOR CAUSE," FOR POTENTIAL RECOMMENDATIONS TO THE CITY COUNCIL Mayor Casillas Salas and Deputy Mayor Padilla reviewed the board and commission member attendance and training records, and reports. The subcommittee directed staff to: - Send an ethics training compliance reminder to all members who were out of compliance; - Contact the following members with a notice of potential recommendation to the City Council for removal for cause and allow the members two weeks to submit an explanation for the subcommittee and Council’s consideration: Lileana Robles, Ana Ruth Robles, Diana Velo, and Jennifer Bustamante; and - Contact the following member to express concern regarding meeting attendance: Maria Garcia-Lopez. Unfortunately, our committee has not been able to make quorum and the meetings have been cancelled constantly. That is not my doing, please make a note of it. Also, I am currently an ex-officio member and have requested to be a voting member in the past, but I have not received any response. Please let me know how I can best achieve this. I am copying Ms. Leilani Hines who is the staff lead for our Commission, and Mr. Sergio Quero, our current Chair. As reflected in the report to the City Clerk’s Office, the Housing Advisory Commission has had an on-going issue with quorum due to a difficult to fill vacancy (senior tenant rep) and an on-going attendance issue with the other tenant representative. With consistent cancellation of meetings due to this issue, members can become very disheartened or assume that meetings will be canceled. Additionally, Ms. Bustamante is in an ex-officio role. Therefore, her position carries no vote and would not impact quorum. In this past year, staff has noted Ms. Bustamante’s attendance at Planning Commission meetings and Council meetings as a citizen to advocate for housing. Ms. Bustamante did attend the last meeting of the HAC on July 24, 2019 and actively participated in the discussions. At this meeting, while no formal vote was taken, the HAC membership expressed their support for Ms. Bustamante moving into a voting role on the HAC. As staff to the HAC, I would put forth this general support of the HAC’s request and provide Ms. Bustamante the benefit of the doubt. Should attendance become an issue, the HAC Chair Segio Quero has committed to speak individually with members to express concern and the importance of the work the HAC is doing in light of housing crisis and issues the State is facing.
