HomeMy WebLinkAboutcc min 2019/02/26 City of Chula Vista Meeting Minutes - Final Tuesday,February 26,2019 5:00 PM Council Chambers 276 4th Avenue,Building A Chula Vista,CA 91910 REGULAR MEETING OF THE CITY COUNCIL CALL TO ORDER A regular meeting of the City Council of the City of Chula Vista was called to order at 5:05 p.m. in the Council Chambers, located in City Hall, 276 Fourth Avenue, Chula Vista, California. ROLL CALL: Present: Councilmember Diaz, Councilmember Galvez, Councilmember McCann, Deputy Mayor Padilla and Mayor Casillas Salas Also Present: City Manager Halbert, City Attorney Googins, City Clerk Bigelow, and Deputy City Clerk Kansas PLEDGE OF ALLEGIANCE TO THE FLAG AND MOMENT OF SILENCE Councilmember McCann led the Pledge of Allegiance. Mayor Casillas Salas introduced scout Troop 5, sponsored by Corpus Christi Church, who was in attendance. SPECIAL ORDERS OF THE DAY A. 19-0063 OATHS OF OFFICE Madeleine Corbeil, Commission on Aging Michael McCabe, International Friendship Commission DeVonte Roberts, Cultural Arts Commission Taylor Ward, Cultural Arts Commission City Clerk Bigelow administered the oath of office to Commissioners Corbeil, McCabe, Roberts, and Ward, and Councilmembers Galvez and Diaz presented the certificates of appointment. B. 19-0036 PRESENTATION OF A PROCLAMATION TO THE CHULA VISTA ANIMAL CARE FACILITY PROCLAIMING FEBRUARY 2019 AS SPAY/NEUTER AWARENESS MONTH IN THE CITY OF CHULA VISTA Animal Care Facility Administrator Mills gave a presentation on the item. Deputy Mayor Padilla presented the proclamation to members of the Animal Care Facility team. C. 19-0067 PRESENTATION BY THE INTERNATIONAL FRIENDSHIP COMMISSION REGARDING THE ODAWARA PROGRAM AND NEWLY FORMED SISTER CITY SUBCOMMITTEES Cultural Arts Manager Tessitore and International Friendship Commission Vice Chair Akana gave a presentation on the item. Alan Contreras, former Chula Vista ambassador, spoke regarding his experience in the program. Recommended Action:Council approve the minutes. 2. 19-0071 ORDINANCE NO. 3452 OF THE CITY OF CHULA VISTA AMENDING VARIOUS SECTIONS OF CHULA VISTA MUNICIPAL CODE CHAPTER 2.52 TO ADJUST THE CAMPAIGN CONTRIBUTION LIMIT FOR ANY ELECTION HELD ON OR AFTER JANUARY 1, 2020 (SECOND READING AND ADOPTION) Recommended Action:Council adopt the ordinance. 3. 19-0058 INVESTMENT REPORT FOR THE QUARTER ENDED DECEMBER 31, 2018 Recommended Action:Council receive the report. Item 4 was removed from the Consent Calendar. Approval of the Consent Calendar ACTION: A motion was made by Councilmember McCann, seconded by Councilmember Galvez, to approve staffs recommendations on the above Consent Calendar items,headings read,text waived.The motion carried by the following vote: Yes: 5- Diaz, Galvez, McCann, Padilla and Casillas Salas No: 0 Abstain: 0 ITEMS REMOVED FROM THE CONSENT CALENDAR 4. 18-0424 RESOLUTION NO. 2019-029 OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ACCEPTING BIDS; REJECTING THE APPARENT LOW BID; AWARDING A CONTRACT FOR THE CONSTRUCTION OF BIKE LANE IMPROVEMENTS ON BROADWAY - PHASE 1 (STM0384) AND CLASS 2 BIKE LANES ON BROADWAY (STM0392) PROJECT TO TRI-GROUP CONSTRUCTION AND DEVELOPMENT, INC., IN THE AMOUNT OF $2,985,532.00; AND MAKING VARIOUS AMENDMENTS TO THE FISCAL YEAR 2018/19 CIP PROGRAM BUDGET AND APPROPRIATING FUNDS THEREFOR (4/5 VOTE REQUIRED) Director of Engineering Valle answered questions of the Council. The motion carried by the following vote: Yes: 5- Diaz, Galvez, McCann, Padilla and Casillas Salas No: 0 Abstain: 0 PUBLIC COMMENTS The following individuals expressed concern regarding commercial marijuana activities: -Terri Ann Hunt -Theresa Acerro, Chula Vista resident, and she also spoke on behalf of Joanna Ward, Chula Vista resident John Acosta, Chula Vista resident, expressed concern regarding issues related to homelessness. PUBLIC HEARINGS 5. 18-0577 RESOLUTION NO. 2019-030 OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ADOPTING AN AMENDMENT TO THE TRANSNET LOCAL STREET IMPROVEMENT PROGRAM OF PROJECTS FOR FISCAL YEARS 2018/19 THROUGH 2022/23 Notice of the hearing was given in accordance with legal requirements, and the hearing was held on the date and no earlier than the time specified in the notice. Mayor Casillas Salas opened the public hearing. There being no members of the public who wished to speak, Mayor Casillas Salas closed the public hearing. Staff answered questions of the Council. ACTION: A motion was made by Councilmember Diaz, seconded by Councilmember McCann, to adopt Resolution No. 2019-030, heading read, text waived. The motion carried by the following vote: Yes: 5- Diaz, Galvez, McCann, Padilla and Casillas Salas No: 0 Abstain: 0 ACTION ITEMS 6. 19-0070 PRESENTATION OF AN UPDATE REGARDING THE OTAY RIVER RESTORATION PROJECT Principal Planner Donaghe, Senior Planner Goddard, and Lindsay Teunis, consultant representing ICF, gave a presentation on the item. 7. 19-0073 PRESENTATION ON THE STATUS OF THE FRIENDSHIP PARK DECK PROJECT Director of Community Services Lamb, Senior Recreation Manager Farmer, and City Librarian Whatley gave a presentation on the item. City of Chula Vista Page 3 City Council Meeting Minutes-Final February 26,2019 CITY MANAGER'S REPORTS City Manager Halbert spoke regarding a recent meeting with wireless communications trade group, CTIA. In response to comments made by a public speaker, he clarified that the City employed eight code enforcement officers. MAYOR'S REPORTS Mayor Casillas Salas reported on her attendance at the following events: Meeting with Lynn Twork, owner of Kids on the Go; meeting with Mayor Kevin Faulkner regarding the possibility of forming a region-wide JPA for Community Choice Energy,- visit to the Sweetwater Union High School District student art competition display at the South Chula Vista library; unveiling of the police dispatch center relaxation room; opening of a new office of the South County Economic Development Council; Chamber of Commerce installation dinner, League of California Cities meeting; visit to Park View Little League field where a new irrigation system had been installed by Youth Sports Council volunteers, in conjunction with Measure P; Mayor's Cup Cyber Challenge, in which Castle Park Middle School was one of the finalists; and a South Bay Mayor's and Manager's lunch. COUNCILMEMBERS' COMMENTS Councilmember McCann reported on his attendance at the Chula Vista Chamber of Commerce installation event. He recognized outgoing Chamber President Dr. Escobedo and welcomed returning President Bill Hall. He stated he also attended the Third Avenue Village Association (TAVA) annual meeting and an Acadia Healthcare community meeting. Deputy Mayor Padilla congratulated returning President Bill Hall and the new officers of the Chula Vista Chamber. He spoke regarding his participation as a guest lecturer at Cal Western School of Law on land use and the Bayfront project. Councilmember Galvez reported on her attendance at the TAVA annual meeting and stated that Senior Council Aide Moreno had attended the Hispanic Chamber of Commerce mixer at Seven Mile Casino. She spoke regarding an annual robotics competition at Montgomery High School, as well as the library deck and Otay River restoration projects. CITY ATTORNEY'S REPORTS City Attorney Googins spoke regarding an upcoming community meeting regarding marijuana regulations and enforcement. He announced the hiring of a city prosecutor. CLOSED SESSION Pursuant to Resolution No. 13706 and Council Policy No. 346-03, Official Minutes and records of action taken during Closed Sessions are maintained by the City Attorney. City Attorney Googins announced that the Council would convene in closed session to discuss Items 8A and 9, and that Item 8B would be continued to a future date. Mayor Casillas Sales recessed the meeting at 6:25 p.m. The Council reconvened in Closed Session at 6:30 p.m., with all members present. The International Boundary & Water Commission, et al., United States District Court, Case No. 18cv00457-JM-LL Item 88 was not discussed and was continued to a future date. ACTION: Item 8A: No reportable action. 9. 19-0074 CONFERENCE WITH LEGAL COUNSEL--ANTICIPATED LITIGATION Initiation of litigation pursuant to Government Code Section 54956.9(d)(4): One [1 ] Case. City of Chula Vista and Chula Vista Redevelopment Agency Successor Agency v. Keely Bosler, in her official capacity as California State Director of Finance; Tracy M. Sandoval, in her official capacity as San Diego Auditor-Controller ACTION: No reportable action.
