HomeMy WebLinkAboutReso 2019-136RESOLUTION NO. 2019-136 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA AMENDING CHAPTER 16 (DEVELOPMENT & IN-LIEU FEES) OF THE MASTER FEE SCHEDULE TO REMOVE THE TELEGRAPH CANYON DRAINAGE BASIN DEVELOPMENT IMPACT FEE WHEREAS, on August 7, 1990, the City Council adopted Ordinance No. 2384, establishing the Telegraph Canyon Drainage Development Impact Fee; and WHEREAS, the fee was established to provide drainage improvements within the Telegraph Canyon Drainage Basin to accommodate the surface and storm water runoff anticipated to result from new development; and WHEREAS, all properties that were subject to the Telegraph Canyon Drainage Basin Development Impact Fee have been charged; and WHEREAS, on July 23, 2019, the City Council passed the first reading of the ordinance to repeal Ordinance No. 2384; and WHEREAS, the second reading and adoption of the ordinance to repeal Ordinance No. 2384 is scheduled for City Council on August 6, 2019; and WHEREAS, adoption of the ordinance to repeal Ordinance No. 2384 will necessitate amending Chapter 16 (Development & In-Lieu Fees) of the Master Fee Schedule dated May 2017, which lists Telegraph Canyon Drainage Development Impact Fees as $4,579 per acre; and WHEREAS, the proposed amendment to Chapter 16 (Development & In-Lieu Fees) of the Master Fee Schedule shall become effective 30 days after the second reading and adoption of the ordinance to repeal Ordinance No. 2384; and WHEREAS, the activity is not a “Project” as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required. In addition, notwithstanding the foregoing, the “Project” also qualifies for an Exemption pursuant to Section 15061(b)(3) of the California Environmental Quality Act State Guidelines. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby amend Chapter 16 (Development & In-Lieu Fees) of the Master Fee Schedule as reflected on Exhibit A to this Resolution and removes the $4,579 per acre for Telegraph Canyon Drainage.
