HomeMy WebLinkAboutReso 2019-107RESOLUTION NO. 2019-107 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THE 2019/2020 U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT ANNUAL ACTION PLAN FOR THE COMMUNITY DEVELOPMENT BLOCK GRANT, HOME INVESTMENT PARTNERSHIPS ACT GRANT AND THE EMERGENCY SOLUTIONS GRANT; AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO EXECUTE AGREEMENTS WITH EACH SUBRECIPIENT; AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO EXECUTE ANY AND ALL HUD DOCUMENTS RELATED TO THE GRANTS; AND APPROVING A TENANT-BASED RENTAL ASSISTANCE PROGRAM AND AUTHORIZING THE DEVELOPMENT SERVICES DIRECTOR TO EXECUTE ALL DOCUMENTS NECESSARY FOR PROGRAM ADMINISTRATION WHEREAS, as a Department of Housing and Urban Development (HUD) entitlement community, the City of Chula Vista receives grant funds under the Community Development Block Grant (CDBG), Emergency Shelter Grant (ESG), and the Home Investment Partnerships Program (HOME); and WHEREAS, Staff has prepared the Fiscal Year 2019/20 Annual Action Plan (“Action Plan”) using the goals set forth in the 2015-2019 Consolidated Plan (“Consolidated Plan”) and per HUD Rules and Regulations; and WHEREAS, the City will receive a Fiscal Year 2019/20 CDBG entitlement of $2,289,117; a HOME entitlement of $850,160; and an ESG entitlement of $194,238; and WHEREAS, the City has $168,362 in CDBG and $1,514,100 in HOME unencumbered, prior year funds to reallocate to eligible projects; and WHEREAS, the City followed its Citizen Participation Plan and held public hearings on housing and community needs in January and May of 2019, at which time public testimony was received and considered by the City Council with respect to the Fiscal Year 2019/20 Action Plan; and WHEREAS, Staff has determined that the proposed activities are eligible for CDBG, ESG, and HOME funding; and WHEREAS, each CDBG project and program meets national objectives to benefit primarily low/income households or aid in the elimination of slums and blight; and DocuSign Envelope ID: BC8150BA-2B64-425C-9862-58602E3F0F43 Resolution No. 2019-107 Page No. 2 WHEREAS, Staff has determined that the subrecipients identified in the Fiscal Year 2019/20 Action Plan and Attachment A (attached hereto) are experienced and staffed in a manner such that they can prepare and deliver the services required by the City; and WHEREAS, in the event that HUD withdraws the City’s CDBG funding, the City is not obligated to compensate the sub/recipients/contractors for program expenditures; and WHEREAS, the City Council of the City of Chula Vista does hereby approve the implementation of a Tenant Based Rental Assistance Program, and authorizes the Development Services Director, or their designee, execute all documents necessary for processing. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista, that it approves the Fiscal Year 2019/20 Annual Action Plan (“Action Plan”) for the Community Development Block Grant (CDBG), Home Investment Partnership Act (HOME), and the Emergency Solutions Grant (ESG) Programs. BE IT FURTHER RESOLVED by the City Council of the City of Chula Vista, that it authorizes the City Manager or his designee to execute any and all agreements and necessary amendments for the management and implementation of the Fiscal Year 2019/20 Action Plan, Administration and Public Services programs between the City of Chula Vista and each subrecipient, identified in the Fiscal Year 2019/20 Action Plan, and it further authorizes the City Manager or his designee to make such minor modifications as may be approved or required by the City Attorney. BE IT FURTHER RESOLVED by the City Council of the City of Chula Vista, that it authorizes the City of Chula Vista Development Services Department Director to enter into Memorandums of Agreement, in substantially the form presented, for the management and implementation of the Fiscal Year 2019/20 Action Plan Capital Improvement and Park Improvement projects, with the Directors of Engineering and Capital Projects, Public Works, and Community Services, and it further authorizes the City Manager or his designee to make such minor modifications as may be approved or required by the City Attorney. BE IT FURTHER RESOLVED by the City Council of the City of Chula Vista, that it authorizes the City Manager to execute the HUD Funding Approval Agreements and any other related documents necessary to obtain the HUD grants. BE IT FURTHER RESOLVED by the City Council of the City of Chula Vista, that it authorizes funding the 2019/20 HUD Annual Action Plan activities detailed in the Agenda Statement in the amount of $5,015,977.
