DearResident: RE:CommercialVehicles AsamemberoftheEastLakeIIICommunityAssociation,weappreciateyouworkinghardtokeep thecommunityanattractiveandenjoyableplacetolive.Wearewritingtoaskforyourassistance withanitemthatrecentlycametoourattention. IthasbeennotedthatyouareparkingacommercialvehicleonthestreetsoftheEastLakeIII CommunityAssociation.PleasetakenoteofCC&R’sSection10.6below: 10.6Vehicles.Notrailer,camper,boat,recreationalvehicle,commercialvehicle orsimilarequipmentshallhereafterbepermittedtoremainupontheCoveredProperty, unlessplacedormaintainedwithinanenclosedgarage,norpermittedtobeparkedother thantemporarilyforpurposesofloading,unloadingorcleaning,onanystreet,whether publicorprivate,alley,orCommunityCommonAreaorProjectCommonAreawithinthe CoveredProperty.Temporaryparkingshallmean(a)parkingforlessthantwenty-four(24) hoursforvehiclesbelongingtoguestsorOwners,(b)parkingdeliverytrucks,servicevehiclesand othercommercialvehiclesbeingusedinthefurnishingofservicestotheCommunityAssociation ortheOwnersand(c)parkingofvehiclesbelongingtoorbeingusedbyOwnersforloadingand unloadingpurposes.TheCommunityBoardmayadoptguidelinesdefiningwhatvehicles constituterecreationalvehiclesandcommercialvehicles,whatconstitutestemporaryparkingand rulesforregulationoftheadmissionandparkingofvehicleswithintheCoveredPropertyorany publicorprivatestreetswithintheCoveredProperty,includingtheassessmentofchargesto Ownerswhoviolateorwhoseinviteesviolatesuchrules.Noautomobile,recreationalvehicleor equipment,commercialvehicleoranyothermotorizedvehiclemaybedismantled,rebuilt, repaired,servicedorrepaintedontheCoveredPropertyunlessperformedwithinacompletely enclosedgarageorotherstructurelocatedinaResidencewhichcompletelyscreensthesightand soundofsuchactivityfromstreets,CommunityCommonAreaandneighboringResidences.Any chargessoassessedshallbeanEnforcementAssessment.Anyfenceorscreenrequiredunderthis SectionshallcomplywithanystandardspromulgatedbytheCommunityBoardorArchitectural Committeeastosize,color,orothercriteriaforpermittedfencesorscreens.Golfcartsandsimilar vehiclesshallbeoperatedwithintheCoveredPropertyonlypursuanttotheCommunity AssociationRules.Theforegoingrestrictionshallnotbedeemedtopreventtemporaryparking forwashingandpolishingandthoseactivitiesnormallyincidenttowashingandpolishingof vehicles. Additionally,theEastLakeIIICommunityAssociationCommunityHandbookParkingGuidelines states: A.ParkingGuidelines(PleaserefertotheCC&Rs,Article10,Section10.6) 1.TheapplicablePublicAgencyshallbeallowedtoimposeandenforceallprovisionsof theapplicableCaliforniaVehicleCodesectionsorlocalordinancesonanyprivatestreets containedwithintheProperties. 2.ProhibitedvehiclesasdefinedpertheCC&Rs,Article10,Section10.6,arenotallowed inanydrivewayorotherexposedareas,oranystreet(publicorprivate),exceptforthe purposesofloading,unloading,makingdeliveries,oremergencyrepairs. a.CommercialVehiclesarevehicles,otherthanstandardpassengervehiclesor pickuptruckswithamanufacturer’sratingorpayloadcapacityofonetonorless thatareusedinatradeorbusinessorareofatypethatistypicallyusedina tradeorbusiness.Notwithstandingtheforegoing,pickuptrucksorvansthat havebeenmodifiedforuseinatradeorbusiness(e.g.,bytheadditionofladder racks,extensiveadvertisingorsignage,equipmentracks,largestorage compartmentsorotherequipment)areCommercialVehiclesforthepurposes oftheserules.Publicsafetyvehicles(i.e.police,borderpatrol,firemarshal,etc.) arepermissible. 3.Vehiclesowned,operatedorwithinthecontrolofanOwner,orofaresidentofsuch Owner’sLotandCondominium,mustbeparkedinthegaragetotheextentofthemaximum designedcapacityofsuchgarageorparkingspace. 4.DrivewaysmaynotbeusedforparkingpurposesiftheOwner’sgarageisnotutilizedto themaximumdesignedcapacityfortheparkingofauthorizedvehicles,oriftodoso obstructsfreetrafficflow,constitutesanuisance,violatestheCommunityHandbook,or otherwisecreatesasafetyhazard.
