Subject: Conditional Use Permit Planning Commission Continuance
On March 13, 2019, the Planning Commission voted to continue CUP16-0030. The applicant is
now presenting an updated proposal that attempts to address concerns raised by the PC on
March 13, 2019.
The Applicant has made changes to the proposed project, in order to address concerns raised
at the March 13, 2019 PC hearing. First, the hours of operation were initially between the hours
of 6 a.m. to 10 p.m., and are now proposed from 7:30 a.m. to 9 p.m. The hours have been
modified to avoid any overlap with early morning school traffic during drop-off (school start time
is7:15 a.m. during weekdays). Second, the Applicant
have only four to five lights on throughout the night to illuminate the entrance, middle and rear of
the project site. Previously, the entire site was to be illuminated throughout the night. Finally,
residents and Commission members found the project to have potential safety concerns, and as
such, the applicant has submitted a letter from a security expert that supports the site Security
Plan.
Planning Commissioners also wanted staff to clarify the Open Space designation of the site.
Open Space is a Special Purpose District within the Eastlake II Sectional Planning Area (SPA)
document intended for general agriculture, open space, public and quasi-public uses. For all
open space districts in the Eastlake II SPA, there is no lot size limitation and it is the intent that
these districts may be applied to a portion of a lot provided that the remainder of the lot meets
the requirements for which it is zoned.

The Open Space District is included in the Planned Community District Regulations to achieve
the following purposes:
1. To preserve open space for the conservation of natural resources;
2. Maintain the natural character of the land;
3. Provide for public/quasi-public and recreational uses;
4. Conserve areas of historic and community significance for the enjoyment of future
generations;
5. Provide for private use of land under limited development; and
6. Promote public health and safety.
The Open Space Zone in the Eastlake II SPA plan is a term with seven categories consisting of
various uses and intensities overlapping and some distinct to the open space zone, but all allow
for some form of development. For example, uses that are allowed within some open space
zones include conference facilities, country clubs, health club/spa(s), hotel/motel/lodging
facilities and public and quasi-public uses such as educational institutions.
Specifically, the site location is zoned OS-III. OS III allows the following types of land uses listed
in the table below. It is important to note that the OS-III designation does not permit any type of
permanent structure, whereas other OS zones in Eastlake II do allow permanent structures.

Within the Eastlake Community there are several Open Space zones with existing
developments. The OS-IV zone is developed with educational institutions, such as Eastlake
High School directly north of the project site and Olympic View Elementary directly east across
Eastlake Parkway. The existing Eastlake Country Club has been developed under the zoning
designation of OS-VI. These examples serve to show the Open Space zones as areas
facilitating compatible land uses and not strictly as preserve or green space. Staff has reviewed
the project for consistency with the Eastlake II SPA, and the Chula Vista Municipal Code
development standards and found the proposal to be consistent with the intent of the OS-III
zone.
