HomeMy WebLinkAboutReso 2019-029RESOLUTION NO. 2019-029 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ACCEPTING BIDS; REJECTING THE APPARENT LOW BID; AWARDING A CONTRACT FOR THE CONSTRUCTION OF BIKE LANE IMPROVEMENTS ON BROADWAY - PHASE 1 (STM0384) AND CLASS 2 BIKE LANES ON BROADWAY (STM0392) PROJECT TO TRI- GROUP CONSTRUCTION AND DEVELOPMENT, INC., IN THE AMOUNT OF $2,985,532.00; AND MAKING VARIOUS AMENDMENTS TO THE FISCAL YEAR 2018/19 CIP PROGRAM BUDGET AND APPROPRIATING FUNDS THEREFOR WHEREAS, Chapter 2.56 of the Chula Vista Municipal Code authorizes the City to contract for public works; and WHEREAS, on August 17, 2018, the Department of Engineering and Capital Projects solicited bids for the combined advertisement of the “Bike Lane Improvements on Broadway - Phase 1” (STM0384) and “Class 2 Bike Lanes on Broadway” (STM0392) (Project) in accordance with Chula Vista Municipal Code section 2.56.160.A; and WHEREAS, on November 14, 2018, the Director of Engineering and Capital Projects received two (2) sealed bids for the Project; and WHEREAS, the apparent low bidder, Palm Engineering, Inc., failed to provide documentation to demonstrate compliance with the qualification and experience requirements of the bid and contract documents; and WHEREAS, the apparent second low bidder, Tri-Group Construction and Development, Inc., was the lowest responsive bidder qualified to perform the work described in the bid and contract documents; and WHEREAS, staff recommends rejecting the apparent low bid for the Project and awarding the contract to Tri-Group Construction and Development, Inc. in the amount of $2,985,532; and WHEREAS, due to the increased scope of work, staff recommends various adjustments to the Fiscal Year 2018/19 CIP and appropriations to cover the additional costs to complete the project. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that it accepts bids for the Bike Lane Improvements on Broadway - Phase 1 (STM0384) and Class 2 Bike Lanes on Broadway (STM0392) project. DocuSign Envelope ID: A5FD3945-B4E5-4692-A5FD-62B345C7C2A8 Resolution No. 2019-029 Page No. 2 BE IT FURTHER RESOLVED by the City Council of the City of Chula Vista that it rejects the apparent low bid submitted by Palm Engineering, Inc. for the Bike Lane Improvements on Broadway - Phase 1 (STM0384) and Class 2 Bike Lanes on Broadway (STM0392) project. BE IT FURTHER RESOLVED by the City Council of the City of Chula Vista that it awards the contract for the Bike Lane Improvements on Broadway - Phase 1” (STM0384) and “Class 2 Bike Lanes on Broadway” (STM0392) project to Tri-Group Construction and Development, Inc. in the amount of $2,985,532, authorizes and directs the Mayor to execute the project contract on behalf of the City, and directs a copy of the project contract to be kept on file with the Office of the City Clerk. BE IT FURTHER RESOLVED by the City Council of the City of Chula Vista that it authorizes the following: the transfer of $741,279 in TransNet appropriations from STM0397 to STM0384; the transfer of $800,000 in TransNet appropriations from STM0398 to STM0384; the transfer of $850,000 in CIP Fund appropriations from TRF0409 to STM0384; and the appropriation of $123,384 from the available balance of the WTDIF Fund to STM0384.
