A special meeting of the City Council of the City of Chula Vista was called to order at 3:06 p.m. in the
Executive Conference Room, located in City Hall, 276 Fourth Avenue, Chula Vista, California.

MEASURE A CITIZENS’ OVERSIGHT COMMITTEE
Interviews of all nominees will be held Tuesday, September 18, and
Thursday, September 20, 2018. Appointments will be made at the
conclusion of interviews at the September 20th meeting. No appointments
will be made on September 18th.
At the September 11th City Council Meeting, the following individuals
received two or more nominations to be interviewed for the At-Large
Member seats:

members present.

MAYOR’S REPORTS
Mayor Casillas Salas thanked staff on the Employee Appreciation Committee. She reported on her
attendance at the 20th anniversary celebration of the Joseph Casillas Elementary School and El Grito, the
Mexican Independence Day celebration.
COUNCILMEMBERS’ COMMENTS
Councilmember Aguilar reported on her attendance at the South County Economic Development Council
Summit and spoke regarding the importance of a four-year university in Chula Vista.
CITY ATTORNEY'S REPORTS
City Attorney Googins reported on his attendance at the South County Economic Development Council
Summit and informed Council of an upcoming Open Government and Ethics Training presentation.
City Attorney Googins announced that the Council would convene in closed session to discuss Items 9
and 10, listed below, and that Item 11 would be continued to a future date. He stated that he and Mayor
Casillas Salas would abstain and would not participate on Item 9A due to being named personally in the
subject lawsuit.
Mayor Casillas Salas recessed the meeting at 6:37 p.m. The Council reconvened in Closed Session at
6:44 p.m.

CALL TO ORDER
A special meeting of the City Council of the City of Chula Vista was called to order at 4:05 p.m. in the
Executive Conference Room, located in City Hall, 276 Fourth Avenue, Chula Vista, California.
ROLL CALL:

Interviews of all nominees will be held Tuesday, September 18, and
Thursday, September 20, 2018. Appointments will be made at the
conclusion of interviews at the September 20th meeting. No appointments
will be made on September 18th.
At the September 11th City Council Meeting, the following individuals
received two or more nominations to be interviewed for the At-Large
Member seats:

City Attorney Googins announced minor revisions to Items 2 and 4 had been distributed to the Council
and that action on these items would be with respect to the revised documents. He also stated that Item 7
required 4/5 vote of the Council.

AGREEMENT (ENA) WITH THE UNIVERSITY OF SAINT KATHERINE
AND REQUEST FOR INPUT FROM CITY COUNCIL ON CITY
MANAGER’S PENDING NINETY (90) DAY EXTENSION OF THE ENA
City Manager Halbert and Director of Economic Development Crockett provided information and answered
questions of the Council regarding the item.
Alan Hermiz, Chula Vista resident, spoke in support of the City pursuing California state institutions.
Deuel Woodward, Chula Vista resident, asked questions and spoke regarding University of Saint
Katherine's religious affiliation.
Dr. Frank Papatheofanis, President of University of Saint Katherine, responded to questions from
Councilmember Aguilar regarding students' eligibility for Cal Grants.
MAYOR’S REPORTS
Mayor Casillas Salas announced that the Chula Vista Police Department had received $5.9 million due to
assistance provided to the FBI in an investigation of Rabobank.

Mayor Casillas Salas spoke regarding the Measure A Citizens' Oversight Committee interviews and
appointments, and expressed gratitude for the collaboration of Council. She announced that the City had
been named the 3rd best place for immigrants to live and thrive by the New American Economy Research
Fund.
COUNCILMEMBERS’ COMMENTS
Councilmember McCann spoke regarding Bonitafest.
Councilmember Padilla expressed gratitude to Mayor Casillas Salas for her leadership.
At the request of Councilmember Aguilar, there was consensus of Council to make a referral to staff to
provide the Council with options to fund necessary Police Department overtime for City events.
Mayor Casillas Salas announced Voter Registration Day.

RECOMMENDED ACTION
Council adopt the ordinance.
SUMMARY
As required by Chula Vista Municipal Code section 2.52.040 (D), the City Clerk has adjusted the campaign
contribution limits for individuals and political party committees for any election occurring on or after
January 1, 2020. Adoption of the ordinance amends various sections of the Municipal Code to reflect the
adjusted limits.
ENVIRONMENTAL REVIEW
The Director of Development Services has reviewed the proposed activity for compliance with the
California Environmental Quality Act (CEQA) and has determined that the activity is not a “Project” as
defined under Section 15378 of the State CEQA Guidelines because it will not result in a physical change in
the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is
not subject to CEQA. Thus, no environmental review is required.

DISCUSSION
Chula Vista Municipal Code section 2.52.040 (D) requires the City Clerk to adjust the campaign contribution
limit every odd-numbered year to reflect any changes in the Consumer Price Index for the San Diego area
for the two-year period ending on December 31st of the previous year and requires these adjustments to
be rounded to the nearest $10.
The Consumer Price Index for the San Diego area for the periods ending December 2016 and December
2018 were 274.732 and 292.547, respectively, demonstrating an increase of 6.48 percent.

The contribution limits were previously set at $330 for individuals and $1,120 for political party
committees by Chula Vista Municipal Code section 2.52.040 (A) and (B), respectively. Applying the
percentage of change of the Consumer Price Index and rounding to the nearest $10, the City Clerk adjusted
the contribution limits to $350 for individuals and $1,190 for political party committees.
The City Clerk will publish the Notice of Campaign Contribution Limit Adjustment in the Star News as
required by Chula Vista Municipal Code section 2.52.040 (D). Additionally, the Federal Voting Rights Act,
together with an agreement between the U.S. Department of Justice and the San Diego County Registrar of
Voters, requires translation of all election-related materials and notices into covered languages
predominantly spoken by 10,000 voters or more in the County. Therefore, the City Clerk will cause the
notice to be translated into Chinese, Filipino, Spanish, and Vietnamese and published in language-specific
newspapers.
DECISION-MAKER CONFLICT
Staff has reviewed the decision contemplated by this action and has determined that it is not site-specific
and consequently, the 500-foot rule found in California Code of Regulations Title 2, section 18702.2(a)(11),
is not applicable to this decision for purposes of determining a disqualifying real property-related financial
conflict of interest under the Political Reform Act (Cal. Gov't Code § 87100, et seq.).
Staff is not independently aware, and has not been informed by any City Councilmember, of any other fact
that may constitute a basis for a decision maker conflict of interest in this matter.
CURRENT-YEAR FISCAL IMPACT
Adoption of the proposed ordinance has no impact on the general fund.
ONGOING FISCAL IMPACT
There is no ongoing fiscal impact.

ORDINANCE OF THE CITY OF CHULA VISTA AMENDING
VARIOUS SECTIONS OF CHULA VISTA MUNICIPAL CODE
CHAPTER 2.52 TO ADJUST THE CAMPAIGN
CONTRIBUTION LIMIT FOR ANY ELECTION HELD ON OR
AFTER JANUARY 1, 2020
WHEREAS, Chula Vista Municipal Code section 2.52.040 (D) requires the City Clerk to
adjust the campaign contribution limits every odd-numbered year to reflect any changes in the
Consumer Price Index for the San Diego area for the two-year period ending on December 31st
of the previous year, and requires these adjustments to be rounded to the nearest $10; and
WHEREAS, the Consumer Price Index for the San Diego area for the periods ending
December 2016 and December 2018 were 274.732 and 292.547, respectively, demonstrating an
increase of 6.48 percent; and
WHEREAS, the contribution limit for individuals, other than a candidate, was previously
set at $330 by Chula Vista Municipal Code section 2.52.040 (A), and the contribution limit for
political party committees was previously set at $1,120 by Chula Vista Municipal Code section
2.52.040 (B); and
WHEREAS, based on applying the percentage of change in the Consumer Price Index
and rounding to the nearest $10, the City Clerk adjusted the contribution limit to $350 for
individuals and $1,190 for political party committees; and
WHEREAS, the City Clerk will publish the Notice of Campaign Contribution Limit
Adjustment in the Star News, and will have the notice translated into Chinese, Filipino, Spanish,
and Vietnamese and published in covered language-specific newspapers as required by the
Federal Voting Rights Act.
NOW THEREFORE the City Council of the City of Chula Vista does ordain as follows:
Section I.The following sections in Chula Vista Municipal Code chapter 2.52 are
hereby amended and shall read as follows:
2.52.040 Campaign contribution limits.
A. No person, other than a candidate, shall make a contribution in excess of $350 to a
candidate for a single election contest. No candidate shall solicit or accept a contribution in
excess of $350 from a person for a single election contest. A candidate may receive up to $350
from a person in each of the general and special elections. The contribution limit in this
subsection shall be adjusted biannually pursuant to subsection (D) of this section.

B. No political party committee, as that term is defined in California Government Code
Section 85205, shall make a contribution in excess of $1,190 to a candidate for a single election
contest. No candidate shall solicit or accept a contribution in excess of $1,190 from a political
party committee for a single election contest. A candidate may receive up to $1,190 from a
political party committee in each of the general and special elections. The contribution limit in
this subsection shall be adjusted biannually pursuant to subsection (D) of this section.

2.52.050 Loans.
A. A candidate shall not personally loan to his or her campaign funds, with the intent to
receive repayment of those funds, an aggregate amount in excess of $5,000 for a single election
contest.
B. A loan or extension of credit shall be considered a contribution from the maker of the
loan or extender of credit and shall be subject to the contribution limit of $350 per person,
pursuant to CVMC 2.52.040. The $350 contribution limit does not apply to loans made to a
candidate for the purpose of a campaign by himself or herself or by a commercial lending
institution in the lender’s regular course of business on terms available to members of the general
public for which the candidate is personally liable.
2.52.100 Written solicitations by candidates.
Any candidate making a written solicitation for a contribution for his or her campaign for
City elective office shall include the following written notice in no less than six point type on
each such solicitation:
NOTICE
The City of Chula Vista Municipal Code limits contributions to campaigns for City
elective office to three hundred fifty dollars per person.*
*The dollar amount to be included in this notice shall be amended biannually to reflect any CPI
adjustment to the contribution limit made pursuant to CVMC 2.52.040(D).
Section II. Severability
If any portion of this Ordinance, or its application to any person or circumstance, is for
any reason held to be invalid, unenforceable or unconstitutional, by a court of competent
jurisdiction, that portion shall be deemed severable, and such invalidity, unenforceability or
unconstitutionality shall not affect the validity or enforceability of the remaining portions of the
Ordinance, or its application to any other person or circumstance. The City Council of the City of
Chula Vista hereby declares that it would have adopted each section, sentence, clause or phrase
of this Ordinance, irrespective of the fact that any one or more other sections, sentences, clauses
or phrases of the Ordinance be declared invalid, unenforceable or unconstitutional.

Section III. Construction
The City Council of the City of Chula Vista intends this Ordinance to supplement, not to
duplicate or contradict, applicable state and federal law and this Ordinance shall be construed in
light of that intent.
Section IV. Effective Date
This Ordinance shall take effect and be in force on the thirtieth day after its final passage.
Section V. Publication
The City Clerk shall certify to the passage and adoption of this Ordinance and shall cause
the same to be published or posted according to law.

2.52.040 Campaign contribution limits.

SUMMARY
Transmitted herewith is the City’s investment report for the quarter ended December 31, 2018. To meet
the reporting requirements set forth in the California Government Code Sections 53600 et seq. and the City
of Chula Vista Investment Policy and Guidelines, a separate report was distributed to the City Council in
January.
ENVIRONMENTAL REVIEW
The Development Services Director has reviewed the proposed activity for compliance with the California
Environmental Quality Act (CEQA) and has determined that the activity is not a “Project” in accordance
with Section 15378(b)(5) of the State CEQA Guidelines because it involves only acceptance of the Quarterly
Investment Report; therefore it is an organizational or administrative activity of government that will not
result in a direct or indirect physical change in the environment; therefore, pursuant to Section
15060(c)(3) of the State CEQA Guidelines the activity is not subject to CEQA. Thus, no environmental
review is necessary.

DISCUSSION
The total cash and investment portfolio held by the City as of December 31, 2018 was $290,041,070 and
total cash and investments held by the trustees was $114,658,097.
The cash and investments held by the City are composed of the following components: Managed
Investment Portfolio ($250,758,000), State of CA Local Agency Investment Fund ($1,689,482), County of
San Diego Pooled Investment Fund ($10,530,675), Cash/Time Deposits ($25,097,088), and accrued interest
on investment ($1,965,825). Cash and investments held by the City and the trustees continue to be

invested in accordance with the Government Code and the Council Investment Policy as adopted by
Resolution 2018-090 on May 22, 2018.
During the quarter, twelve investments matured totaling $39,070,000. In order to maximize investment
earnings, $23,000,000 was transferred from the County of San Diego Pooled Investment Fund to the Bank
of New York Mellon Custodial Cash Account and used to purchase higher yielding investments. An
additional $11,500,000 was transferred from the Bank of America checking account to Bank of New York
Mellon. The funds from the matured investments and transfers to Bank of New York Mellon were utilized
to purchase forty-one new securities. Those investment purchases include: eighteen certificates of deposit
($4,445,000); ten corporate notes ($30,009,000); seven federal agency bonds ($20,216,000); and six
municipal bonds ($19,130,000).
Finance staff continued to manage the portfolio and work with multiple brokers/dealers for investment
purchases throughout this quarter. Ongoing portfolio management activity will continue to be performed
in-house by the Director of Finance and finance staff. There is no further activity to report on other than
routine investments by the City’s Finance Department.
In December, the Federal Open Market Committee (FOMC) raised the federal funds rate target range by
0.25% to a new range of 2.25% to 2.50%. The Committee will continue to assess realized and expected
economic conditions in determining the timing and size of future adjustments to the target range for the
federal funds rate.
Two-year Treasuries yielding 2.81% at the beginning of the quarter ended lower at the end of the quarter
at 2.48%, which was a decrease of 33 basis points for the quarter.
As of December 31, 2018, the Weighted Yield to Maturity on the Managed Investment Portfolio was 2.53%,
which was an increase of 36 basis points from the previous quarter.
At the end of this quarter, the Weighted Average Maturity of the Managed Investment Portfolio was 1.98
years, which is an increase from 1.38 the previous quarter and is within the Council Policy.
DECISION-MAKER CONFLICT
Staff has determined that the action contemplated by this item is ministerial, secretarial, manual, or clerical
in nature and, as such, does not require the City Council members to make or participate in making a
governmental decision, pursuant to California Code of Regulations Title 2, section 18704(d)(1).
Consequently, this item does not present a conflict of interest under the Political Reform Act (Cal. Gov't
Code § 87100, et seq.).
Staff is not independently aware, and has not been informed by any City Council member, of any other fact
that may constitute a basis for a decision maker conflict of interest in this matter.

LINK TO STRATEGIC GOALS
The City’s Strategic Plan has five major goals: Operational Excellence, Economic Vitality, Healthy
Community, Strong and Secure Neighborhoods and a Connected Community. The investment portfolio
supports the Operational Excellence goal as it seeks to maintain the safety and liquidity of the City’s cash
while contributing investment earnings to the bottom line.
CURRENT-YEAR FISCAL IMPACT
Considering the projected timing of cash receipts and disbursements and the structure of the Pooled
Investment Portfolio, the City should be able to comfortably meet overall cash flow needs over the next six
months. There is no direct fiscal impact by this action.

SUMMARY
Bike Lanes on Broadway project (Project) consists of two City Capital Improvement Program (CIP)
projects, “Class Two Bike Lanes on Broadway” (STM0392) and “Bike Lane Improvements on Broadway -
Phase 1” (STM0384). The two projects were advertised as one combined project and are scoped to install
approximately four miles of bike lanes along Broadway from Main Street to C Street. STM0392 is an Active
Transportation Project (ATP) and includes $851,000 from state funds.
The project limits for STM0392 are along Broadway from Main Street to G Street and the limits for
STM0384 are along Broadway from G Street to C Street. The initial scope of the advertised projects
included street striping and markings, the installation of new traffic signs, and bicycle detection. STM0392
also included the removal and replacement of pavement (dig-outs) with a slurry seal pavement treatment
for Broadway between Main Street and G Street.
The City advertised the project on August 8, 2018, but received no bids. To increase bidding interest, the
project scope was revised to include “Smart City” and traffic items, and the project was re-advertised on
August 17, 2018.
On November 14, 2018, Engineering and Capital Projects Staff received two bids. Staff determined the
apparent low bidder, , Palm Engineering Construction Company, Inc. (Palm Engineering), failed to provide
documentation to demonstrate compliance with the qualification and experience requirements of the bid
and contract documents. Staff determined that the apparent second low bidder, Tri-Group Construction
and Development, Inc. (Tri-Group), was the lowest responsive bidder qualified to perform the work
described in the bid and contract documents. Staff recommends that the City reject the apparent low bid

submitted by Palm Engineering and award the project contract to Tri-Group in the amount of
$2,985,532.00. Staff recommends various adjustments to the FY2018/19 Capital Improvement Program
(CIP) and appropriations to cover the additional costs to complete the project.
ENVIRONMENTAL REVIEW
The Director of Development Services has reviewed the proposed Project for compliance with the
California Environmental Quality Act (CEQA) and has determined that the project qualifies for a Categorical
Exemption pursuant to State CEQA Guidelines Section 15301 Class 1 (Existing Facilities); Section 15303
Class 3 (New Construction or Conversion of Small Structures); and Section 15304 Class 4 (Minor
Alterations to Land) because the proposed project would not result in a significant effect on the
environment, create a cumulative impact, damage a scenic highway, or cause a substantial adverse change
in the significance of a historical resource. Thus, no further environmental review is required.

DISCUSSION

(STM0392) between Main Street and G Street. The two projects were advertised as one combined project
and are scoped to install approximately four miles of bike lanes along Broadway from Main Street to C
Street. STM0392 is an Active Transportation Project (ATP) and includes $851,000 from state funds.
The initial scope of the advertised project included street striping and markings, the installation of new
traffic signs, and bicycle detection for the entire length of Broadway. STM0392 (ATP project) also included
the removal and replacement of pavement (dig-outs) with a slurry seal pavement treatment for Broadway
between Main Street and G Street.
The City advertised the Project and received no bids on August 8, 20018. Prior to re-advertising design
modifications and changes to scope were made to include “Smart City” and traffic elements to attract
bidders. These changes include adding bicycle video detection in lieu of loops, expanding the limits of
pavement treatment and dig-outs to include the entire length of the project and, the installation of fiber
optic cable between Main Street and C Street.
The fiber optic line installation on Broadway will allow for the inter-connection of the 17 traffic signals
along the Broadway corridor and an expansion the City’s fiber network, which supports the City’s “Smart
City” objectives. This will also remove 12 leased telephone lines from the City’s recurring utility costs. This
project is piloting a micro-trench installation method for the fiber optic line installation.
On November 14, 2018, Engineering and Capital Projects Staff received two bids, the apparent low bid of
$2,685,869 submitted by Palm Engineering and the apparent second low bid of $2,985,532 submitted by
Tri-Group. The low bid by Palm Engineering was $423,103 higher than the Engineers Estimate of
$2,262,766.

After reviewing Palm Engineering’s bid package, Staff determined that Palm Engineering was unable to
provide evidence that they, or their subcontractors, had the requisite qualifications or experience for
installing fiber optic cable and micro-trenching, as required by the project bid and contract documents.
Fiber optics, as well as the micro-trenching, are relatively new technologies and require special training,
experience and equipment. Installation of fiber optic splices and terminations requires a high level of
expertise and diligence from the installer. Staff placed requirements in the bid specifications requesting a
minimum of two (2) years of experience by the contractor or its subcontractors in the successful micro-
trenching and the installation and termination of fiber optic cable systems. Tri-Group provided the
required documentation of previous work experience with micro-trenching and fiber optic cable
installation.
Staff recommends that the City reject the apparent low bid by Palm Engineering and award the contract to
Tri-Group in the amount of $2,985,532.00.
DECISION-MAKER CONFLICT
Staff has reviewed the property holdings of the City Council and has found that, Councilmember McCann
has real property holdings within 1,000 feet, but beyond 500 feet, of the boundaries of the property which
is the subject of this action. Staff has determined that, pursuant to California Code of Regulations Title 2,
sections 18700 and 18702.2(a)(8), this item does not present a disqualifying real property-related financial
conflict of interest under the Political Reform Act (Cal. Gov't Code § 87100, et seq.) for the above-identified
member.
LINK TO STRATEGIC GOALS
The City’s Strategic Plan has five major goals: Operational Excellence, Economic Vitality, Healthy
Community, Strong and Secure Neighborhoods and a Connected Community. The Bike Lanes on Broadway
project supports both the Healthy Community and the Connected Community goals as it seeks to improve
the City’s Bicycle network, connecting several bike routes and encourages bike riding in the western
portion of the City. The addition of fiber optics will support the Operational Excellence and Connected
Community goals.
CURRENT-YEAR FISCAL IMPACT
Approval of this resolution will transfer $741,279 in TransNet funds from STL0397 to STM0384, $800,000
in TransNet funds from SML0398 to STM0384, $850,000 in CIP funds from TRF0409 to STM0384,
appropriate $123,384 from the WTDIF fund to STM0384 to initiate the construction phase of STM0384 and
STM0392. Sufficient funds are available for said transfers and appropriation to award the contract and
complete the project.

TRANSNET LOCAL STREET IMPROVEMENT PROGRAM OF PROJECTS FOR FISCAL YEARS 2018/19
THROUGH 2022/23

SUMMARY
The San Diego Association of Governments (SANDAG) is accepting submittal requests for the 3rd
amendment to the Regional Transportation Improvement Program (RTIP). SANDAG provided its member
agencies with new financial projections for Fiscal Years 2018-19 through 2022-23. Staff recommends
several administrative adjustments and updating estimated allocations for all future fiscal years to conform
to these projections.
ENVIRONMENTAL REVIEW
The Director of Development Services has reviewed the proposed activity for compliance with the
California Environmental Quality Act (CEQA) and has determined that the activity is not a “Project” as
defined under Section 15378 of the State CEQA Guidelines because the activity consists of governmental
Regional Transportation Improvement Program/ TransNet funds activity, which does not involve any
commitment to any specific project that may result in a potentially significant physical impact on the
environment. Therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not
subject to CEQA. Thus, no environmental review is required. Although environmental review is not
required at this time, once the scope of potential individual projects has been defined, environmental
review will be required for each project and the appropriate environmental determination will be made.

DISCUSSION
The 2016 Regional Transportation Improvement Program (RTIP) includes a program of projects and
expenditures for Fiscal Years 2018-19 through 2022-23. The City participates in the Local Street
Improvement Program portion of the overall RTIP. On January 15, 2019, SANDAG provided the member

agencies with an updated TransNet Revenue Forecast – Local Street Improvement Program for Fiscal Years
2018-19 through 2022-23 (Attachment 1), which are conservative estimates for planning purposes.
The Fiscal Year 2018-19 TransNet fund allocation on this latest forecast remained constant from the
previous projection provided on February 6, 2018 in the amount of $6,076,000. At this time, only
Administrative Transfers (Attachment 2) need to be approved with this current amendment.
The projected revenues for each upcoming fiscal year have increased by approximately $100,000 (1.6%)
from the previous estimates. The estimated TransNet allocation for future fiscal years 2019-20 through
2022-23 have all increased to reflect the updated projected revenues (Attachment 3).
Staff will need to return to Council in fall 2019 for approval of Chula Vista’s portion of the 2018 RTIP. At
that time, the allocation of costs for the upcoming fiscal years will be revised. The allocations for Fiscal
Year 2019-20 will more closely approximate the proposals for the Fiscal Year 2019-20 CIP.
Administrative Transfers
This action is intended to either reallocate leftover funds allocated to Capital Improvement Program (CIP)
projects that have been completed or to transfer money from one CIP project to another within the same
SANDAG project number (MPO ID). These transfers will not affect the balance between Congestion Relief
and Maintenance projects. These transfers are strictly administrative to address SANDAG’s project
accounting. These funds have already been budgeted in the current Capital Improvement Program so no

DECISION-MAKER CONFLICT
Staff has reviewed the decision contemplated by this action and has determined that it is not site-specific
and consequently, the 500-foot rule found in California Code of Regulations Title 2, section 18702.2(a)(11),
is not applicable to this decision for purposes of determining a disqualifying real property-related financial
conflict of interest under the Political Reform Act (Cal. Gov't Code § 87100, et seq.).
Staff is not independently aware, and has not been informed by any City Council member, of any other fact
that may constitute a basis for a decision maker conflict of interest in this matter.
CURRENT-YEAR FISCAL IMPACT
There will be no current fiscal year impact, since this Council action pertains to revenue estimates for Fiscal
Years 2018-19 through 2022-23.
ONGOING FISCAL IMPACT
There will not be any ongoing fiscal impact, since these amounts are only estimates, which will not affect
the budget and will be amended in summer 2019.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA ADOPTING AN AMENDMENT TO THE
TRANSNET LOCAL STREET IMPROVEMENT PROGRAM
OF PROJECTS FOR FISCAL YEARS 2018/19 THROUGH
2022/23
WHEREAS, on November 4, 2004, the voters of San Diego County approved the San
Diego Transportation Improvement Program Ordinance and Expenditure Plan (TransNet
Extension Ordinance); and
WHEREAS, the TransNet Extension Ordinance provides that SANDAG, acting as the
Regional Transportation Commission, shall approve on a biennial basis a multi-year program of
projects submitted by local jurisdictions identifying those transportation projects eligible to use
transportation sales tax (TransNet) funds; and
WHEREAS, the City of Chula Vista was provided with an estimate of annual TransNet
local street improvement revenues for fiscal years 2019 through 2023; and
WHEREAS, the City of Chula Vista approved its 2018 TransNet Local Street
Improvement Program of Projects (POP) on June 26, 2018 and the City of Chula Vista desires to
make adjustments to its Program of Projects; and
WHEREAS, the City of Chula Vista has held a noticed public hearing with an agenda
item that clearly identified the proposed amendment prior to approval of the projects by its
authorized legislative body in accordance with Section 5(A) of the TransNet Extension
Ordinance and Rule 7 of SANDAG Board Policy No. 31.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista
that it requests that SANDAG make the changes to its 2018 POP (the “Amendment”) as
provided on Exhibit “A” which is attached hereto and incorporated herein: and
BE IT FURTHER RESOLVED by the City Council of the City of Chula Vista that
pursuant to Section 2(C)(1) of the TransNet Extension Ordinance, the City of Chula Vista
certifies that no more than 30 percent of its annual revenues shall be spent on local street and
road maintenance-related projects as a result of the Amendment.
BE IT FURTHER RESOLVED by the City Council of the City of Chula Vista that
pursuant to Section 4(E)(3) of the TransNet Extension Ordinance, the City of Chula Vista
certifies that all new or changed projects, or major reconstruction projects included in the
Amendment and funded by TransNet revenues shall accommodate travel by pedestrians and
bicyclists, and that any exception to this requirement permitted under the Ordinance and
proposed was clearly noticed as part of the City of Chula Vista’s public hearing process for the
Amendment.

BE IT FURTHER RESOLVED by the City Council of the City of Chula Vista that it
does hereby certify that all applicable provisions of the TransNet Extension Ordinance and
SANDAG Board Policy No. 31 have been met.
BE IT FURTHER RESOLVED by the City Council of the City of Chula Vista that it
continues to agree to indemnify, hold harmless, and defend SANDAG, the San Diego County
Regional Transportation Commission, and all officers and employees thereof against all causes
of action or claims related to City of Chula Vista’s TransNet funded projects.
BE IT FURTHER RESOLVED by the City Council of the City of Chula Vista that it
adopts the amendment to the TransNet Local Street Improvement Program of Projects for Fiscal
Years 2018/2019 through 2022/2023.
