HomeMy WebLinkAboutReso 2003-099RESOLUTION NO. 2003-099 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING A PERFORMANCE BOND GENERAL INDEMNITY AGREEMENT AND AUTHORIZING THE CITY MANAGER TO EXECUTE SAID AGREEMENT WHEREAS, to facilitate the construction of the Salt Creek Gravity Sewer Interceptor, the City of Chula Vista was granted a permit by the Army Corps of Engineers; and WHEREAS, this permit was granted with several conditions, and one of the conditions stipulated that the City had to post a bond in the amount of the cost for grading, planting, and irrigation and five years of maintenance and monitoring of the wetland mitigation; and WHEREAS, the bond (performance bond) is required by the Corps to guarantee the successful implementation of the wetland mitigation construction, maintenance and monitoring; and WHEREAS, the Environmental Review Coordinator has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and determined that the activity is not a "Project" as defined under Section 15378 of the State CEQA Guidelines; therefore, pursuant to Section 15060 (c) (3) of the State CEQA Guidelines the activity is not subject to CEQA, thus no environmental review is necessary. NOW, THEREFORE, BE IT RESOLVED the City Council of the City of Chula Vista does hereby approve a Performance Bond General Indemnity Agreement and authorizes the City Manager to execute said agreement.
