PROCLAIMING NOVEMBER 19, 1980 AS "HANDYTRANS' FIRST BIRTHDAY" Mayor Hyde read the proclamation and presented it to Joan Nicholson, Chairman of the Chula Vista Elderly and Handicapped Transportation Committee. b. OATHS OF OFFICE - NEWLY-APPOINTED COMMISSIONERS The City Clerk administered the Oath of Office to Clifford Roland, Board of Ethics and John Winkelman, Board of Appeals. 3. ORAL C~IUNICATIONS 4. W~I'I-L'~N C(~MDNICATIONS (None). RESOLUTIONS AND ORDINANCES, FIRST KEADING 5. RESOLUTION NO. 10311 GRANTING APPROVAL OF EXTENSION AND EXPANSION OF VARIANCE PCV-80-1 FOR EXEMPTION FROM THE WEST TO EAST DEVELOPMENT POLICY OF THE EL RANCHO DEL REY SPECIFIC PLAN On October 28, 1980 Council held the public hearing on this it~n and adopted a motion upholding the Planning Commission's approval of the extension of the variance and its expansion in area by 1.4 acres. This action is memorialized by the adoption of this resolution. RESOLUTION OFFERED by Councilwoman McCandliss, the reading of the text was waived by unanimous consent, passed and adopted by a unanimous vote. 6. REPORT ON THE REQUEST FROM NIEK SLIJK AND DON RITCHIE TO REDUCE THIRD AVENUE FROM FOUR LANES TO TWO LANES BETWEEN "F" AND "H" STREETS Don Ritchie (Town Centre Business and Professional Association) and Nick Slijk (private citizen) requested that Third Avenue be reduced to two travel lanes between "F" and "H" Streets and that the "Town Square" concept be included in the proposed improvements on Third Avenue between "F" and "G" Streets. In a written report, the City Engineer discussed the pro3ect in detail, including its history and status~ the impact on traffic and the financial impact. It was his conclusion that to narrow Third Avenue would (1) increase traffic congcstion on the major access route to the Town Centre area; (2) increase accidents; (3) result in possible loss of Federal grant monies; and (4) would be counter productive to the goals of increasing activity in the Town Centre area. Therefore, it was his recommendation that Third Avenue be maintained as a four lane street between "F" and "H". City Council Meeting -2- November 4, 1980 Niek Slijk, speaking on behalf of Don Ritchie, representing the Town Centre Business and Professional Association, urged the Council to continue this item to a Council Conference in order to give the businessmen on Third Avenue an opportunity to present their views concerning the Third Avenue improvement project. He said they are concerned about the character of the area, the traffic pattern and pedestrian walkway. Council discussion ensued concerning the timing of the request noting that the matter has been before the Council for public hearings and was discussed at a Council Conference. In response to a query from Councilman Scott, City Engineer Lippitt said there is a time limit and the contract must be awarded by November 18. Councilman Scott commented that much has been accomplished on Third Avenue because of the close cooperation of the businessmen. He agreed that if they wish to have input, a forum should be provided. MSC (Scott/McCandliss) that this item be held over until a week from Thursday to the Council Conference on November 13. The motion carried by a vote of 3 - 2 with Mayor Hyde and Councilman Cox voting "no." 6a. RESOLUTION ACCEPTING BIDS AND AW~MIDING CONTRACT FOR CONSTRUCTION OF STREET IMPROVEMENTS ON THIRD AVENUE FROM "G" TO "K" STREETS On September 24, 1980 bids were received for the project which includes construction of curbs, gutters, sidewalk, sidewalk ramps, driveways, asphalt concrete paving, drainage facilities, traffic signals, street lights, irrigation system, street trees and other work as required. The City Engineer recommended that the Council (1) accept the bids and award the contract to Daley Corporation (low bidder) in the amount of $1,667,805.05; and (2) authorize the additional expenditure of $31,500 from project GT-84 for water utilities relocation and State engineering services. Item 6a continued to November 13. See motion above. 7. ORDINANCE NO. 1926 ESTABLISHING SPEED LIMITS ON TELEGRAPH CANYON ROAD BETWEEN 1-805 AND PASEO LADERA - FIRST READING The speed limits were established after the street was constructed to four lanes with a median. They are reflective of traffic conditions and are functioning as intended, therefore, the City Engineer recommended the ordinance be adopted establishing the following speed limits: Telegraph Canyon Road beginning at 1-805 and ending at Pasco del Rey - 45 MPH; Telegraph Canyon Road beginning at Paseo del Rey and ending at Paseo Ladera - 50 MPH. IT WAS MOVED by Councilman Cox that the ordinance be placed on first reading and that the reading of the text be waived. The MOTION CARRIED by a unanimous vote. 8. REPORT(S) OF THE CIT~HANAGER a. City Manager Cole stated that the International Marathon Committee has requested members of the Council, if available, to attend a meeting of the committee at the Tijuana Chamber of Commerce on Wednesday, November 12, 1980 at 6 p.m. Mr. Cole added that Sergeant Hawkins, Police Department, and Jerry Foncerrada, Parks and Recreation Department, will be attending the meeting. Councilman Gillow expressed his concern about the involvement of the City in this marathon, which could include finances and staff time. MSUC (Gillow/Scott) that the staff report back within the next three to four months on what kind of involvement this would be. IlEPO~TS OF CITY OFFICERSANDDBPARTH~NTII~2)S 9. REPORT ON ENERGY CONSERVATION TEAM NEMBERS In a written report, the Director of Building and Housing said the Energy Conservation Program will be addressing many facets of energy conservation which will affect all segments of the community and will need a broad base of participation and support from all community groups, including the San Diego Gas & Electric Company. City Council Meeting -3- November 4, 1980 Mr. Grady stated one of the prime concerns addressed by the team will be how to optimize public participation; however, he recommended that the teem be limited to staff members only at the present time. In anser to a question from Councilman Gillcw, Mr. Grady said the committee would initially like to set up the groundwork - the process and method - and at a later date invite members of the community to participate. MSUC (Scott/Gillow) that the report be accepted. 10. REPORT ON PROPOSED AMENDMENTS TO THE CPO JOINT POWERS AGREEMENT The Board of Directors of the Comprehensive Planning Organization recently authorized the distribution of certain draft amendments to the CPO Joint Powers Agreement to member agencies for their review and execution. Director of Planning Peterson presented a written evaluation of the draft amendments and recommended that the City of Chula Vista support the proposed changes in the CPO Joint Powers Agreement. MS (Hyde/Cox) that the report be accepted. Councilman Scott expressed his concern regarding the amendment to the Joint Powers Agreement and questioned the name change. He stated it was not clear to him what could happen in the future and he felt it could result in a powerful layer of government between the City, County and the Legislature. Mayor Hyde discussed the functions of the CPO clarifying the reasons for the amendment. THE MOTION CARRIED by a vote of 4-1, with Councilman Scott voting "no." 11. REPORT ON REQUEST FOR SIGNING/STRIPING MODIFICATIONS ON THIRD AVENUE BETWEEN "E" AND "F" STREETS On September 16, 1980 the Council received a request from the Town Centre Business and Professional Association for modifications to the signing and striping on Third Avenue between "E" and "F" Streets to increase vehicle and pedestrian safety. After reviewing the request, both staff and the Safety Commission agreed the proposed modifications would not increase safety and may even have a detrimental effect. Therefore, it was recommended that the City not implement the modifications as suggested. Niek Sli~k, representing the Town Centre Business and Professional Association, discussed their concerns regarding traffic control and pedestrian safety on Third Avenue between "m" and "F" Streets. He explained their reason for recommending the center striping to channel traffic and provide an area for the "keystone cop" signs. In response to a question from Councilman Cox, City Engineer Lippitt stated the proposed "keystone cop" sign is not in compliance with the standard warning sign of the State of California and could be confusing to drivers. Assistant City Attorney Harron advised the City would be liable if any confusion resulting from the sign caused a traffic injury. MSUC (Cox/Hyde) that the staff report be accepted. Mr. Slijk said the problem is still not solved and asked that action be taken to correct the problem, suggesting that alternatives be proposed. MSUC (Scott/Cox) that this matter be referred to the Safety Commission for a study of the probl~n and report back to the Council. 12. REPORT ON REQUEST FOR ELIMINATION OF FIVE PARKING SPACES ON FOURTH AVENUE SOUTH OF DAVIDSON STREET On September 16, 1980, a written request was received from Niek $1ijk of the Chember of Commerce to eliminate the five parking spaces on the east side of Fourth Avenue south of Davidson Street. The request resulted from an accideut witnessed by Mr. Slijk at the intersection which he perceived to be attributable to the sight distance restriction created by vehicles parked in the subject spaces. The staff and Safety Commission agreed that no action should be taken at this time, but this matter should be re-examined when the County Courts relocate to the new facility at Third Avenue/"H" Street. City Council Meeting -4- November 4, 1980 MS (Hyde/McCandliss) that the staff report be accepted. Councilman Scott spoke against the motion stating the report indicates there is a problem, yet the parking spaces are needed. He said he felt there is adequate parking in the Civic Center area if it is properly used and that if an unsafe condition exists, it should be corrected. Mayor Hyde witbJrew his motion. Councilwoman McCandliss withdrew the second. MSUC (Scott/Gillow) that this be referred back to the staff for a report on how many parking spaces would need to be eliminated in order to have a safe sight distance according to the ordinance of the City of Chula Vista. 13. REPORT ON REQUEST FOR INSTALLATION OF STOP SIGNS OR A TRAFFIC SIGNAL AT HILLTOP DRIVE/QUINTARD STREET On July 15, 1980, the Council received a complaint from Mrs. C. J. Cypher of high speed traffic and many accidents at Hilltop Drive/Quintard Street. Both staff and Safety Commission agreed that no additional traffic control devices should be installed at this time, but that the intersection be re-exam~ned in three months to assess the impact of the completion of Orange Avenue between Hilltop Drive and Third Avenue on traffic conditions in the area. City Engineer Lippitt clarified that the report is not a denial of the request for traffic control, but the situation will be re-evaluated in three months. John Finch, 1414 Hilltop Drive, described vehicle accidents occurring in this area, including one involving his car and another where a tow truck crashed into his garage. He discussed the safety hazard in students crossing without a school crossing patrol and urged that action be taken to install a signal. In reply to a question from Councilwoman McCandliss, Traffic Engineer Hanson remarked that as people realize Orange Avenue is open to Third, it is anticipated traffic on Hilltop Drive will decrease from 9500 to about 6000 by January 1981. Loraine Cypher, 1404 Hilltop Drive, said this is not a matter of traffic control but of speed control. She presented a petition with 156 signatures asking that action be taken to correct this situation. May Paquette, 28 Quintard, agreed with the states, ChiS of Mr. Finch and Mrs. Cypher and asked that three-way stop lights or stop signs be installed. MSUC (Cox/Hyde) that the staff report be accepted as outlined and also add that staff monitor the speed of the vehicles over the next three months and report back to the Council at the end of the three-month period of time. l,~yor Hyde asked that the parties speaking on this issue be advised of the date when the report comes back to the Council which should be no later than February 1, 1981. 14. REPORT ON CONCERNS OF BONITA VERDE RESIDENTS At the City Council meeting of September 30, 1980, Councilman Cox reported that he had been contacted by residents of Bonita Verde about some concerns they had with possible flooding during the coming rainy season. Council requested that staff check out those concerns and report back. Development Services Administrator Robenm submitted a detailed written report on (1) potential flooding problems with Loveland Reservoir overflowimg into Sweetwater Dam; (2) erosion of the channel along Sweetwater Road; and (3) debris accumulated downstream from the Willow Street bridge. Mr. Roberts offered several suggestions to alleviate the problems. MSUC (Scott/Gillow) that the report be accepted. Mayor Hyde announced that he has appointed William (Bill) Wappes to the vacancy on the International Friendship Commission and asked for Council ratification. MSUC (Scott/Cox) that the appointment of Mr. Wappes be ratified. City Council Meeting -5- November 4, 1980 Mayor Hyde referred to the vacancy on the San Diego Transit Board. MSUC (Hyde/Cox) that the Council nominate Mr. Joe Dordahl to be the candidate to fill this position. Mayor Hyde discussed the annual Christmas Tree Lighting Ceremony and said a suggestion has been made to purchase artificial snow to attract and encourage citizen participation and to solicit the support of civic organization to share the expense. MSUC (Scott/McCandliss) that the whole problem be brought forth for the approval of the Council at the next Council meeting and this suggestion be included. In response to a question from Mayor Hyde, City Manager Cole said he has asked staff to prepare a summary of the tour to Orange County (to review the inclusionary housing programs) with staff reactions to be included. This will be presented at the next Council meeting. CODNClL Councilman Scott referred to the shopping center in National City (Bonita) and said he understands there is a road to come in from Spring Valley, through Sweetwater Road, into the shopping center. He indicated the City would be involved in the traffic situation if such a road is constructed. MSUC (Scott/Gill~) that the staff investigate and report if there is in fact going to be a road from the east and if so, what the development phase is, etc. ADJO~T at 7:15 p.m. to the meeting scheduled for Thursday, November 13, 1980 at 4:00 p.m. and to the Council Tour on November 15, 1980 at 8:00 a.m. JENNIE M.
