HomeMy WebLinkAboutcc min 1979/10/25 MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF CHULA VISTA, CALIFORNIA Held Thursday - 4:00 p.m. October 25, 1979 An adjourned regular meeting of the City Council of Chula Vista, California, was held on the above date beginning at 4:00 p.m. in the Council Conference Room, City Hall, 276 Fourth Avenue. ROLL CALL Councilmen present: Mayor Hyde, Councilmen Gillow, Cox, McCandliss, Scott Councilmen absent: None Staff present: Acting City Manager Asmus, Assistant City Attorney Harron, Development Services Administrator Roberts, Director of Building and Housing Grady, Zoning Enforcement Officer Hedge 1. PP~SENTATION BY THE Acting City Manager Asmus stated that on the tour of the DIRECTOR OF BUILDING City on September 1, 1979, the Council expressed some AND HOUSING ON RECREATIONAL concern over the number of recreational vehicles illegally VEHICLE PARKING IN parked or abandoned in the residential areas. RESIDENTIAL AREAS On September 7, 1979, the City Attorney wrote a memo to the Council outlining the course of action for enforcement of these infractions. The Council then directed that this matter be set for a review at this Council Conference. Presentation by Director Mr. Eugene Grady, using flip charts, detailed the provisions of Building and Housing of the Municipal Code pertaining to parking restrictions on private property. A copy of Chapter 10.84 of the Code was submitted to each Councilman. Mr. Grady stated that his department has never used the zoning enforcement section (10.84.030) because if the Zoning Enforcement Officer issues a citation, he may have to be designated as a Peace Officer. Mr. Grady noted the areas of jurisdiction for the enforcement of the front yard setbacks, parkway areas, and the public rights-of-way by the Zoning Enforcement Officer, the Police Officers and the Public Works Department. Extensions of driveways Using a mock-up of a typical house lot, Mr. Grady discussed the area which he described as an extension of an existing approved driveway which the residents use, at times, to park these vehicles. Because it is considered an extension of the driveway, his department has allowed parking in these areas. Zoning Enforcement Officer In answer to Council's queries, Zoning Enforcement Officer Hedge remarked that residents have been parking their vehicles in this area "all over town, not specifically with Planning Department approval, but as long as it is done in good taste, and it is a nice area, we have not pursued it..." Mayor Hyde added that legally, the property owners are not supposed to pave it and/or use it for parking without it being designated and approved by the Planning Department. As to why these violations are not cited, Mr. Hedge answered that "he is just one person and this is quite a large city, and if it is done in good taste," he does not cite them. Council discussion Discussion followed with Mr. Grady and Mr. Hedge noting the legal requirements for parking in this particular area, the responsibilities of the enforcing parties and criteria for approval established by the Planning Department (it was noted that no representative of the Planning Department was present). Held Thursday - 4:00 p.m. - 2 - October 25, 1979 Mr. Asmus commented that the section of the Code which covers this particular area of discussion is quite general and vague and needs "tightening up." Repair of vehicles Mr. Grady noted the Code requirements allowing for minor and major repairs of vehicles on private properties - 48 hour maximum within the setback areas. If the repairs are made in the rear yard (enclosed with a 6 Soot fence), then major repairs are allowed and no time limit is imposed. Statistics Mr. Grady recited the following statistics for the period January 1, 1979 through October 25, 1979. Inoperable vehicles: By complaint - 38; zee observation - 30. Trailers, Campers, etc. in the front setback areas: By complaint - 4. In answer to Councilwoman McCandliss' question, Mr. Grady stated that the zee does not have any specific time schedule of investigating these violations. In a report being prepared for the Council (November 6 meeting), Mr. Grady said he will address this problem. Question remaining Mayor Hyde noted that the question remains as to what criteria, if any, there may be for granting approval of paving the areas of the front yard setbacks for the purpose of parking recreational vehicles. Motion to continue It was moved by Councilman Cox, seconded by Mayor Hyde and matter unanimously carried that this item be continued until such time as the report that Mr. Grady made reference to be presented to the Council. Perhaps later in November or December, this item be rescheduled (for a Council Conference), and at that time, Mr. Grady, the Zoning Enforcement Officer, Police Department and Planning Department have representatives here:so that everything can get pieced together. Mayor Hyde suggested the City Manager be directed to analyze the situation as it is, including the ordinances, determine the conflicts, deficiencies, gaps, etc. which might exist and come forth with a recommendation as to what the Council should do to (1) define areas where parking is approved (and where it is not); and (2) determine what needs to be done in terms of enforcement; and (3) address the problem of st~ffing. Councilman Cox stated this was thc intent of the motion and that further, representatives of the various departments be present at the meeting to provide input. 2. REPORT ON THE REQUEST FOR Acting City Manager Asmus explained that on July 14, 1979, INCREASING THE SENIOR Mr. Edwin Storm, representing the Senior Citizen's Council CITIZEN'S UTILITY USER'S on Aging, requested an increase in the income limitations TAX EXEMPTION for the senior citizen's exemption on utility user's taxes from the present maximum household income of $7,500 to $12,000. Mr. Asmus commented that the Director of Finance has recommended that the Council maintain the present $7,500 maximum limitation and the staff concurs. Motion to approve It was moved by Councilman Scott.and seconded by Mayor Hyde staff recommendation that this recommendation be approved. Notification of person In answer to the Council's query, the City Clerk stated that making request Mr. Storm was not notified oS the meeting today. Held Thursday - 4:00 p.m. -3 - October 25, 1979 Substitute motion It was moved by Councilman Scott and seconded by Mayor to continue Hyde that this item be held over for a regular City Council meeting (and Mr. Storm be notified). Discussion of motion Councilwoman McCandliss said she felt the Council was looking at this item in terms of revenue and what other cities have done; however, other elements to be looked at are (1) need in the community; (2) is the $12,000 figure a net figure (before taxes); (3) why did the State establish the $12,000 income figure; (4) does the $12,000 include only senior citizens and perhaps the Council should also look to the impact of the young families of four that have limited income. Motion carried The motion carried by the following vote, to-wit: AYES: Councilmen Scott, Hyde, Gillow, Cox Noes: Councilwoman McCandliss Absent: None 3. CITY HALL REMODELING In a memo to the Council dated October 18, 1979, the City Manager listed the two phases of remodeling the City Hall: (1) first phase would be the renovation of the south end of the building after which time the departments (City Attorney, City Manager, City Clerk and Council) would temporarily move there while the north end of the building is being remodeled. Report accepted It was moved by Councilman Scott, seconded by Councilman Gillow and unanimously carried that the report be accepted. 4. ACTING CITY b~NAGER'S REPORT None. 5. MAYOR'S REPORT a. Selected Flood Control Mayor Hyde noted the letter received from the Army Corps Plan for Telegraph of Engineers regarding the public meeting scl~eduled on Canyon Creek November 29, 1979 at 7:30 p.m. at Harborside Elementary School, 681 Naples Street. He stated that he has asked the City Manager to have a staff member give the Council a briefing on this item at a Council meeting prior to this public meeting. b. Council assignments A memo was forwarded to the City Council, via the City Manager, to staff from Development Services Administrator Robens concerning the difficulties encountered by the staff when Council directs that a report be brought back the following week. Mr. Roberts requested that all reports that are not "time sensitive" be brought back in a minimum of two weeks, and that further, Council check directly with the City Manager to see if a request for a report back in one week is a reasonable one. Mayor Hyde indicated the Council needs to be reminded of this from time to time. c, Model Transportation Mayor Hyde noted the letter received from Richard Huff, Ordinances ~ CPO Executive Director of the Comprehensive Planning Organization, regarding CPO's strategies for cities to implement that would tend to reduce the air pollution problems in the area. Motion to refer to staff It was moved by Mayor Hyde and seconded by Councilman Scott that these ordinances be referred to staff and that they bring them back to the Council, one at a time, with their analysis and recommendations with respect to city ordinances. Held Thursday - 4:00 p.m. - 4 - October 25, 1979 Discussion of motion Councilman Scott questioned having them brought back "one at a time" inasmuch as a few of them could be brought back at one time. Wording deleted Mayor Hyde agreed and deleted the words "one at a time" from the motion. Motion carried Councilman Scott, as the second, agreed to the deletion and the motion carried unanimously. d. Plaque for Public Mayor Hyde submitted a sketch of a plaque he would propose Services Building be put on the Public Services Building which he remarked is the same type as that on the Police facility. Motion for plaque format It was moved by Councilman Scott, seconded by Councilman Gillow and unanimously carried that the plaque for the Public Services Building be the same format as that on the Police Facility. e. Boards and Commissions Mayor Hyde asked the Council for some input into this dinner Banquet which will take place on November 8, 1979. Any ideas are to be submitted to him or the City Clerk. f. Group Picture At Council's concurrence, the City Clerk was directed to set up the date of November 8, 1979 at 3:30 p.m. (prior to the Council Conference) for a group picture to be taken of the Council. 6. COUNCIL CO~MENTS Councilwoman McCandliss said she was pleased to see the Telegraph Canyon Creek plan "resurrected" as she remembered being appointed to this committee five or six years ago and no actions were taken at that time. ADJOURNMENT Mayor Hyde adjourned the meeting at 4:50 p.m. to the meeting scheduled for November 6, 1979 at 7:00 p.m.
