HomeMy WebLinkAboutcc min 1979/12/13 MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA Held Thursday - 4:00 p.m. December 13, 1979 An adjourned regular meeting of the City Council of the City of Chula Vista, California, was held on the above date beginning at 4:00 p.m. in the Council Conference Room, City Hall, 276 Fourth Avenue. ROLL CALL Councilmen present: Mayor Hyde, Councilmen Gillow, Cox, McCandliss Councilmen absent: Councilman Scott Staff present: City Manager Cole, City Attorney Lindberg, Assistant City Manager Asmus, Development Services Administrator Robens, Director of Planning Peterson, City Engineer Lippitt, Director of Community Development Desroehers, Director of Policy Analysis and Program Evaluation Thomson 1. PROPOSED RAISED A video tape of the intersection of Third Avenue and "H" CURB MEDIAN ON THIRD Street was shown by the Traffic Engineer. AVENUE BETWEEN "H" AND 'T' STREET City Engineer Lippitt described the traffic pattern and the turning movements. He explained that in September, staff showed the Council a plan for a raised median between "It" Street and Shasta Street and another raised median up to ~itney. An alternative was to have a two-way left turn pocket which could be installed if no parking was allowed on the north side of this area. Safety Commission Mr. Lippitt referred to the recommendation of the Safety recommendation Commission to have a painted left turn pocket installed north- bound on Third Avenue as a sufficient barrier to left turn movements into the First Federal Savings and Loan Association. Staff favors a raised median because they feel there will be serious traffic problems at this intersection. The City Engineer then noted the driveways to the court com- plex, the parking structures and the parking lots, pointing out the left turn movements that will be allowed into the complex. Richard Schick Mr. Schick, Project Manager for the Regional Center, stated Capital Facilities they have no objection to prohibiting left turns into or out Planning of the main entrance to the complex. They would, however, request a turning lane into an entrance to the regional center of "H" Street - one that is separate from the parking area. This would be strictly for deliveries and/or trans- portation of the prisoners. Mr. Schick added that he would like to meet with staff on this to work out the details. C. C. Goodvin Mr. Goodvin stated that besides his own, there are several Realtor offices in this area and they definitely want to maintain Third and Whitney Street their on-street parking, and that they do object to having a raised median in this vicinity. Dan McGinty, Manager Mr. McGinty declared that they are opposed to any raised First Federal Savings medians on Third and "H" Street in the vicinity of their & Loan bank. He has talked to the property owners in this immediate Third and "H" Street vicinity and they, too, are opposed to the concrete islands, as well as the Chamber of Commerce. Mr. McGinty raised the question of the bus turn-outs along the west side of Third Avenue adjacent to the court complex. Held Thursday - 4:00 p.m. -2- December 13, 1979 Mr. Schick referred to the plat of the area and described the bus turn-in and turn-out movements, the traffic lanes, and the alternates to prohibiting left turns out of the regional center. Council discussion Council discussion followed with the staff answering questions pertaining to the prohibition of left turns; the feasibility of the median from Shasta to Whitney Streets; bus movements~ configuration of the parking lanes and parking lots; Safety Commission's recommendation; parking restrictions on the east side of Third Avenue; having a "pork-chop" or "Y" shaped island in lieu of the raised median out of the main entrance of the court complex (near Whitney Street); more information is needed before a decision can be reached. Motion to approve plans It was moved by Mayor Hyde and seconded by Councilman Gillow and set for future that the Council approve the staff recommendations for the Conference raised median islands between "H" and "I" Street on Third Avenue, as per staff's proposal, so that the approval of the plans at the State level can be processed; and that concur- rently, the staff work with the County to refine the median plans on Third Avenue and bring back for reconsideration the proposals for the medians at the Council Conference on the 24th of January for possible revision. Discussion of motion Councilwoman McCandliss suggested the word "includes" rather than "approve" be substituted in the motion as it relates to the median islands. Councilman Cox suggested the plans be approved "minus the medians" and that this can come back for reconsideration at the meeting in January. Mayor Hyde indicated that he is more convinced now (after viewing the video tape) that there may be a need for the median islands and, therefore, would leave his motion as it stands. Motion carried The motion carried by the following vote, to-wit: AYES: Mayor Hyde, Councilmen Gillow, McCandliss Noes: Councilman Cox Absent: Councilman Scott 2. CONDOMINIUM CONVERSION Director of Planning Peterson commented that in October, the STATISTICS Council asked for a report on the number of rental units which have been converted to condominiums, the number of units built as condominiums, and the percentage of occupancy. Number of condominiums Out of 11,828 multiple family dwelling units in the City, in the City 701 have been converted to condominiums, 927 are existing condominiums or authorized for development, making a total of 1,628 condominium dwelling units. The ratio of these units to the total multiple family dwelling units is less than 14% (13.8%). Renter/Owner Occupancy The Comprehensive Planning Organization (CPO) has issued a statement that nationally and statewide, approximately 55% of the units are occupied by the tenants. Mr. Peterson said that in Chula Vista the percentage is about 20%. Cost of units As to the cost, the statewide sampling shows that the convert- ed units are less expensive, whereas in the small sampling taken in Chula Vista, the staff could not reach this conclu- sion. Council discussion The Council questioned the requirements of the condominium ordinance noting it has slowed down the conversions; discussed the number of apartments being built which are now being con- structed to condominium standards; and noted the Mayor's Economic Advisory Committee recommendation of no change in the ordinance since they feel it is basically a good one. Held Thursday - 4:00 p.m. -3- December 13, 1979 Motion to accept report It was moved by Mayor Hyde, seconded by Councilwoman and schedule status McCandliss and unanimously carried by those present that report in 6 months the report be accepted and staff be directed to prepare a follow-up report of the number of actual existing apart- ments that are converted to condominiums - this status report due in June 1980. 3. DISCUSSION REGARDING City Clerk Jennie Fulasz asked whether or not the Council APRIL 8, 1980 GENERAL wished to have "signtures-in-lieu" for paying the candidates' MUNICIPAL ELECTION statements. At the last two elections, if a candidate collected 100 signatures, the City paid one-third the cost of the statement; 200 signatures - two-thirds of the cost and if the candidate collected 300 signatures, the City paid the entire cost. In the April 1978 election, the total cost of the statements, which included the Spanish translation, was $560.00 per candidate. For the April 8, 1980 election, the candidates' statements will be printed and mailed in English only with the Spanish translation available at no cost to anyone requesting a copy. The estimated cost for the statements, therefore, will be $350.00. The Registrar of Voters has informed the City Clerk that his office will be charging $1.40 to verify each signature. In this respect, with 300 signatures, the cost for verification would be $420.00 and plus the $350.00, the total cost to the City will be $770.00 per candidate statement if the signatures-in-lieu are approved. Council discussion Councilman Cox commented that both he and Councilwoman McCandliss were going to be candidates at the next election, and even though he does not favor having the signatures-in- lieu paid for by the City, he would abstain from voting on this because of a possible conflict of interest. Continued to December 18 Inasmuch as the City Attorney was not present at the meeting, meeting the Mayor asked that this item be put on the agenda for the December 18 meeting and that the City Attorney be prepared to rule on the conflict of interest issue. Question of placing City Clerk ,Jennie Fulasz referred to the League of California measure on the ballot Cities request for the cities to place on their ballot the advisory measure regarding the allocation of the state sales Motion to place measure It was moved by Mayor Hyde, seconded by Councilman Cox and on the ballot unanimously carried by those present that the City Attorney be directed to prepare a ballot proposition of an advisory nature which would ask the voters of the City of Chula Vista to vote on the question similar to the one submitted to the voters of San Diego on September 18, 1979. 3a. RESOLUTION NO. 9890 - Offered by Mayor Hyde, the reading of the text was waived ADOPTING REGULATION FOR by unanimous consent of those present, passed and adopted CANDIDATES FOR ELECTIVE by the following vote, to-wit: OFFICE PERTAINING TO MATERIALS SUBMITTED TO AYES: Mayor Hyde, Councilmen McCandliss, Gillow, Cox THE ELECTORATE AND COSTS Noes: None THEREOF FOR THE GENERAL Absent: Councilman Scott MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUES- DAY, THE 8TH DAY OF APRIL 1980 Held Thursday - 4:00 p.m. -4- December 13, 1979 4. CONSIDERATION OF City Manager Cole explained that the Metropolitan Transit METROPOLITAN TRANSIT District Board (MTDB) has contacted the City about the DISTRICT BOARD'S OFFER purchase of 14 duplexes (28 units) which they must move TO SELL DUPLEXES TO CITY off the site at "H" Street by March 1980. Director of Community Development Desrochers indicated it was a "gamble" at this time to purchase the buildings since ~1) the City must Find a site for them; (2) the cost has to be almost negligible because the units must be ~r~ught up to City standards; (3) the cost of moving the units will be high; (4) they can be used for low and moderate income housing; (5) there are monies available for this purpose. Motion for Council It was moved by Councilman Cox, seconded by Councilman interest in acquiring Gillow and unanimously carried by those present that the buildings staff contact the Metropolitan Transit District Board and express the interest on the part of the City of Chula Vista in acquiring the buildings provided it will be at a nominal cost; and further, the staff be directed to work with the County Honsing Authority to try to come up with the best type of plan which would utilize the buildings for low cost housing. Mayor Hyde asked that the staff report on this item be presented to the Council at the Conference scheduled for December 20, 1979. Executive Session with the concurrence of the Council, an Executive Session was called for personnel matters. The Council recessed to Executive Session at S:50 p.m. and reconvened at 6:00 p.m. ADJOURNMENT Mayor Hyde adjourned the meeting at 6:00 p.m. to the meeting scheduled for Tuesday, December 18, 1979 at 7:00 p.m.
