The applicant, Treetops Unlimited, is. re'questing :a change of zone from R-1 to P-C Planned Community for 1 .5 acres -of surplus colle9e- property located at the southeasterly corner of the Southwestern Community College-(see. locator).; 2. On. July 9, 1,980 the Planning Commission adopted the -Negative Declaration on IS-80-59 which is forwarded herewith. RECOMMENDATION: Adopt ordinance rezoning the pro;perty.Jrom R-1 to P-C. PLANNING COMMISSION RECOMMENDATION On July 9, 1980 the Planning Commission voted 6-0 to recommend that Council approve the change of zone in accordance with Resolution. PCZ-80-I. DISCUSSION_ 1 . Existing .site characteristics. The subject. property is a relatively level triangular parcel which will be essentially landlocked once it is .severed from the college property. The site is vacant, as is the adjoining property to the south. and :west. . The northerly property line -of the site is approximately parallel to and 190 feet distant from a parking area on the college property. The 190 foot strip of land is also vacant. 2. Proposed development: The applicant is in .the proces's 'of.acquirin,g -the subject. property from the,college and also 'owns. the property which abuts the site`. A.'Sectional Planning ,Area Plan and tentative subdivision map were recently approved by the Planning Commission and City Council for the development 'of' a 260 unit residential complex on the approximately 40.. acres. The applicant intends to incorporate the subjec t.property- into this residential development by filing a .precise plan and tentative map ,on the 1 .5 acre parcel . ANALYSIS 1 . Once the: subject. property is .separated -from the college', it. should be developed with the adjoining property -.to -the south and east 16-order to: insure:"proper access. 2. City of Chula Vista 276 4th Ave. Chula Vista CASE NO. IS-80-59 DATE: April 18 , 1980 A. Project Setting The proposed 1 . 5 acre project site is located south of the most southerly parking facilities for Southwestern College (see attachment) The project site is undeveloped and vegetation consists of introduced grasses resulting from previous clearing. and grading operations . The project site has an average natural slope of 5% , sloping down from south to north. Parking facilities for the college are . located north and west of the property. A 256 unit condominium development is planned for the vacant property south and east of the project site (Charter Point, EIR-80-4) . . Geologic studies conducted on the site south and east of the project have indicated the presence of faulting activity in the area, although there has been no indication of recent activity (EIR-80-4) . Expansive soils have been identified in the project vicinity. B. 'Project Description The project involves three discretionary acts ; 1) acquisition of the property, 2 ) an amendment to the General Plan from Public and Quasi-Public, to Medium Density Residential (6-10 du/ac) on the El Rancho del- Rey Specific Plan , and 3) a rezoning of the project site from R-1 (Single family Residential) to P-C (Planned Community) . Further environmental review will be required for the consideration of development plans for the project site. Funds from the Bayfront/Town Centre Tax Allocation Low & Moderate Income Housing Fund will be used for purchase of the project site . Primary access to the site will be provided from Apache Drive via an access easement which will be constructed as part of the Charter Point Condominiums , to the south and east. The purpose is to provide housing for low to moderate income families . C. Compatibility with zoning and plans The proposed project involves rezoning and amending the General Plan 1 i IS-80-59 -2- to assure compatibility. Review of future development plans for, compliance with codes will ensure compatibility with zoning and the General Plan. D. Identification of environmental effects The following environmental effects will not occur as a result of the proposed project but rather may through future development of the project area which will be authorized by the proposed actions. Prior to the consideration of any specific development proposal , additional environmental review will be required. 1. Geology The geotechnical report for EIR-80-4 (Charter Point) identified a minor fault trace on property located immediately east of the project site. This fault trace , however, was not identified in further trenching activities on that site (south of this proposal) . A geotechnical report shall be prepared on the subject project site prior to any development, and recommendations shall be incorporated into future development plans . 2 . Soils The presence of expansive soils on the project may result in excessive cracking of any proposed foundations and structures . A soils report shall be prepared and recommendations incorporated into future plans prior to any development of the project. 3 . Schools The local junior high and high schools are currently operating in excess of their designated capacity/attendance noted. Parks ti The subject property is located in Park District No. 13 which contains a total of 22 . 0 acres of developed parkland. Development of the subject property will require the payment IS-80--59 -3- ,of in-lieu fees for park purposes, however the City Council may waive all or part of the required in-lieu fees for low and moderate income housing projects. E. Findings of insignificant impact 1. Since the proposed actions will not result in any physical change, no natural resources. nor hazards will be affected. Prior to the subdivision or development of the project site, additional environmental review will. be required and the extent of any physical damage to the environment fully evaluated. 2 . The subject property is being sold as excess school property by adjacent Southwestern College and is designated as Public and Quasi-Public on the General Plan. The proposed General Plan change and E1 Rancho del Rey Specific Plan change to a residential density of 6-10 dwelling units per acre is precisely the same General Plan designation as property adjacent to both the south and east property lines which serves as the lone access to the subject property. The project will not achieve short term to the disadvantage of long term environmental goals . 3. All effects on schools and parks will be neglible until a specific development plan is proposed. No substantial impacts are anticipated which could interact to create a substantial cumulative effect on the environment. 4. The project will not result in any physical change and therefore not result in any hazard which could prove detrimental to human beings. F. Consultation . City of Chula Vista D. J. PCZ-80-I RESOLUTION OF THE CITY ,PLANNING COMMISSION RECOMMENDING TO THE -CITY COUNCIL THE CHANGE OF-ZONE FOR 1..5 ACRES AT 900 ' OTAY LAKES ROAD FROM-R-1_ TO P-.0 WHEREAS, a duly verified application for rezoning of .property was ;fil-ed_ with the Planning Department .by Treetops Unlimited on ,June 9, 1980, , application No. PCZ-80-I; and WHEREAS, said .application, requested a. change of zone for 1 .5 acres located at 900 .0tay Lakes Road. from R-1 to P-C, and WHEREAS, `an Initial -Study, IS. 80-591 was conducted by ,the .Environmental Review Committee on Apr.il' 18, :1980, which-concluded that there..would be no significant.adverse environmental impact from, the proposed acquisition of. the property,;-amendment to the General Plan, and rezoning of the site from R-1 to , P=C,. and issued -a draft Negative Declaration, and ' WHEREAS, thee:City 'Planning Commission set the- time-and place fora hearing on said zone. ch and notice of said hearing, together with its purpose, was .given by: the publication in a..newspaper of general circulation in the. City at least 10. days -prior. to the. date..of said hearing,,'and WHEREAS,. a. hear.ing was held at the time and place as. advertised, namely. 7:00 p.m. , July 9; 19809 before the Planning Commission -and said'. hearing .was thereafter closed. NOW, THEREFORE ' BE: IT 'RESOLVED AS FOLLOWS: 1 . The Commission finds that in accordance with the Negative Declation on IS-80-59 and the findings stated .therein, this rezoning will' not have a significant adverse..environmental impact and adopts the Negative :Declaration. 2. From-facts presented to the Commission, the Commission finds that public necessity; convenience, general Welfare and good zoning practice- require- the change of zone. for 1 .5 acres at.-900. Otay ,Lakes Road from R-1: to P-C subject to the provision that a. residential- density range of 6 to 10 dwelling units per gross acre be established for the subject property in accordance. with the 'El ,Rancho del Rey Specific Plan for'.the South College Sectional Planning Area. 3.
