In November 1978 the City Council established the MHP - Exclusive Mobile Home Park Zone to provide appropriate locations for mobile home parks and to insure that the properties zoned MHP could not be used for other land uses unless the property were rezoned. 2. Since the adoption of the MHP zone, the staff has embarked on a program to review, on a time available basis, the various mobile home parks. Thus far, six parks have been rezoned to MHP. As a continuation of the program, three additional mobile home parks, located at 701 "D" Street, 100 Woodlawn, and 708 "H" Street, were considered by .the Planning Commission on June 11 , 1980. Two of the parks (Jade Bay, 701 "D" Street and Bison, 708 "H" Street) contain less than the required five acre minimum for mobile home parks and action on those parks cannot occur until an amendment to the code is approved permitting parks to be less than five acres in-.size. On July 9th the Planning Commission recommended that the City Council amend the code to allow for parks less than .five acres in size; that amendment will be forwarded to the Council for consideration in August. The third mobile home park,, Baywood Trailer Park, which contains 7.81 acres, is ready for Council action at this time. 3. The proposed rezoning is not considered a project under the criteria established by CEQA since it does not result in any physical change, and therefore, it is not subject to environmental review. RECOMMENDATION: Adopt ordinance rezoning .the subject 7.8 acres from R-3 to MHP. PLANNING COMMISSION RECOMMENDATION: On .June 11 , .1980 the Planning Commission, by a vote of 5-1 , with. one member absent, recommended that the City Council enact an ordinance to rezone 7.81 acres located at 100 Woodlawn Avenue and developed as the Baywood Trailer Park, from R-3 to MHP. DISCUSSION 1 . The mobile home park under consideration is located at the southwest corner of Woodlawn Avenue and "D" Street and is bounded by the S.D.A.& E. railway on the west. The park was built prior to. 1958 and contains 126 spaces on 7.81 acres, a density of 16 units to the acre. The park has a recreation building and a swimming pool and has been well maintained even though itis over 20 years old. Many of the coaches are older, single wide units, but they also are well maintained. 2. At the Planning Commission meeting a representative of the owners of the property indicated that they were opposed to the rezoning because the lease on the mobile home park, due to expire in two years,. will not- be renewed and the site is to be redeveloped. _ If the proposed zone change is approved the owner of the property would have to request ,and have approved zoning other than MHP prior to the redevelopment. of the property. BY: ��' RLJULU I lUIV IVU. r UL-OU-II k L J . 1 RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL THE CHANGE OF ZONE -FOR 7.81 ACRES AT 100 WOODLAWN AVENUE FROM R-370 MHP WHEREAS, Ordinance No. 1845, adopted by the City Council on November 28, 1978, established the MHP (mobile home park) zone, and WHEREAS, it was deemed expedient to consider designating various mobile home park sites to the MHP zone, and WHEREAS, the proposed rezonings will not result in any physical change, and are not considered "projects" under CEQA and therefore not subject to environmental review, and WHEREAS, the City Planning Commission set the time and place for a hearing on said zone change, and notice of said hearing, together with its purpose, was given by the publication in a newspaper of general circulation in the City at least 10 days prior to the date of said hearing, and WHEREAS, a hearing was held at the time and place as advertised, namely 7:00 p.m. , June 11 , 1980, in the City Council Chambers before the Planning Commission and said hearing was thereafter closed. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1 . From facts presented to the Commission, the Commission finds that public necessity, convenience, general welfare and good zoning practice require the change of zone from R-3 to MHP for approximately 7.81 acres, located at 100 Woodlawn Avenue and developed as the Baywood Trailer Park. 2. The findings of fact in support of said determination are as follows : a. The establishment of the MHP zone on the subject site recognizes the existing land use and will require further Council action in order to approve a change in land use. b. The General Plan designates the site as Residential , 13-26 DU/acre; the MHP zone does not specify a density so there is no conflict between the zone and the General Plan. 3. The Planning Commission recommends to the City Council that said change of-zone be granted. 4. . That this resolution be transmitted to the City Council and a copy be transmitted to the owner of the property. Southern Pacific Land Company is owner of the land at 100 Woodlawn Avenue which is effected by this change . As owner of the property located at the above address , we would like to express to the council our desire to have the pro- perty remain R-3 zoning. The subject property is presently leased to Merle F. Palmer and Edythe J . Palmer for use as a trailer park. It is the intent of Southern Pacific Land Company not to renew the existing lease when it expires in June 1983 • Should the council ignore the wishes of the land owner and permit the MHP zone to take effect , we believe it will give those persons living in the park a false sense of security . We have informed our lessee that in all probability, the premises would have to be vacated at the expiration of the lease . It •is our intent to utilize the property under it ' s existing zoning of R-3 which .we feel is the highest and best use . Should the council take action to down zone the property, it will create additional expense and problems to have the property rezoned R-3 for his- intended use . Page 2 , Southern Pacific Land Company respectfully requests the City Council of Chula Vista to consider carefully it ' s decision concerning the down zoning of the subject property from R-3 to MHP, and we ask that you remove the land at 100 Woodlawn Avenue from the proposed MHP zone .
