BACKGROUND 1 . This item involves a request to zone approximately 3 acres of excess freeway right-of-way located at the southeast quadrant of I-805 and East "H" Street to P-C (Planned Community) zone. The property is presently unzoned. .2. Environmental Impact Report EIR-79-8, certified by the Planning Commission on October 10, 1979 included the subject property. The candidate CEQA findings which are are supplementary to that EIR are presented as an earlier agenda item. B. RECOMMENDATION: That Council : Enact an ordinance to zone the property as shown on Exhibit A to P-C (Planned Community) . C. PLANNING COMMISSION RECOMMENDATION On February 27, 1980 the Planning Commission voted 7-0 to recommend that the subject property be zoned P-C in accordance with Resolution PCZ-80-C. D. DISCUSSION 1 . Existing site characteristics. The subject property, part of the I-805 freeway right-of-way,. is located on the south side of East "H" Street and east of the northbound `H" Street offramp. The property has a width of 200 feet and an average depth of 640 feet (the southerly portion of the property being triangular in shape) . The site is approximately 50 feet lower than East ""H" Street and has 2:1 downslopes along the north and west sides of the property which constitute approximately 50% of the site. 2. Rice Canyon development. The developers of the Rice Canyon area have been netogiating with the State of California for the acquisition or lease of the subject property. In anticipation of acquiring the site, the developers have included the property in their development plans. The site would be filled and the southerly one acre used as a park-and-ride site. The northerly portion would be used as part of an auto park commercial development. The California State Department of Transportation has filed a letter with the City confirming the proposed sale and concurrence with the P-C zoning. E. ANALYSIS The proposed zoning i..s consistent with the zoning of the adjacent property. The location of the site dictates the need, to. coordinate its development with the adjoining Rice Canyon commercial.'. site. Should the site not be acquired by Watts Development Company, the staff would require the granting of necessary easements to guarantee access in accordance with approved plans. F. FISCAL IMPACT None. PCZ-80-C i RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL THE DESIGNATION OF P-C ZONING ON APPROXIMATELY 3 ACRES OF EXCESS RIGHT-OF-WAY AT THE SOUTHEAST CORNER OF I-805 AND EAST "H" STREET WHEREAS, the California Department of Transportation determined that approximately three acres of freeway right-of-way adjacent to the northbound offramp from I-805 at East "H" Street was in excess of their needs and proposed to sell the property, and WHEREAS, a proposal to designate P-C zoning for the property to conform with the adjoining area was initiated by the City, and WHEREAS, Environmental Impact Report EIR-79-8, certified by the Planning Commission on October 10, 1979, included this. three acre area, and WHEREAS, the City Planning Commission set the time and place for a hearing to consider the proposed zoning, and notice of said hearing, together with its purpose, was .given by the publication in a newspaper of-general circulation in the City at least. 10 days prior to the date of said hearing, and WHEREAS, a hearing was held at the time and .place as advertised, namely 7:00 p.m. , February 27, 1980, before the Planning Commission and said hearing was thereafter closed. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1 . From facts presented to the Commission, the Commission finds that public necessity, convenience, general welfare and good zoning practice require the designation of the P-C zone for approximately three acres at the southeast quadrant of I-805 and East "H" Street as shown on the attached Exhibit A. 2. The Planning Commission recommends to the City Council that said zoning be approved. 3. That this resolution be transmitted to the City Council .
