BACKGROUND
This item is a request to rezone approximately 3700 sq. ft. of property located immediately
south of Sea Vale Street from R-1 to C-O. (See locator)
RECOMMENDATION:
Concur with Planning Commission recommendation.
PLANNING COMMISSION RECOMMENDATION:
1 . On February 13, 1980 the Planning Commission adopted the Negative Declaration
issued on IS-80-39 which is forwarded herewith.
2. The Planning Commission unanimously recommended (7-0) that the City Council enact
an ordinance to rezone the subject property from R-1 to C-0 in accordance with
Resolution PCZ-80-D.
DISCUSSION
1 . Adjacent zoning and land use:
North R-1 Single family dwelling
South R-3-P-12 Vacant
East R-1 Single family dwellings
West C-0 Commercial offices
2. Subject property.
The area proposed for rezoning is currently part of an 11 ,947 sq. ft, parcel located
at 315 Sea Vale Street in the R-1 zone. . The owner of this parcel has agreed to sell the
southerly triangular shaped 3,696 sq. ft. to the applicant. The R-1 parcel would retain
8,251 sq. ft. of lot-area which exceeds the 7000 sq. ft. minimum lot size of the R-1 zone.
By the acquisition of the property,-the depth of the commercial lot immediately to the
south of the R-1 parcel would be increased to a depth of 110 feet, the same as the adjac-
ent commercial lot to the west which is also owned by the applicant. The present depth
of the affected commercial property varies from 67 feet to 93 feet.
3. Proposed zone change.
The purpose of this request is to adjust the zone boundary to coincide with the
proposed lot line adjustmentbetween properties. The increase in lot depth will result
in a more effective use of the existing commercial property which is, at best, marginal .
The proposed rezoning is consistent with the goals and objectives of the General Plan.

A. Project Setting r
The project involves a 32,5,48 sq. ft. lot located at the northwest,
corner of Seavale .S.t. and..Third Ave. The 'lot is currently vacant
and adjacent land uses include ;vacant property and s. single- family
dwelling. to the north, a commercial office building .to the west,
Third Ave. and vacant property to the south-, and Seavale St. and
single- family -dwellings to the east;.
The site is generally void of any- significant vegetation 'or wildlife
and there are no significant natural- or man-made resources present.
The project site is subject -to liquefaction and the potential of
landslides is present. Expansive soils are also present on the site.
Special Report 123, published by the Calif. Div. of Mines & Geology
indicates that an inferred earthquake fault may be present within the
project vicinity. Property to .the north' of. this site, where the
northeasterly extension of the fault is inferred, was . investigated
for .physical evidence of �displacement, however, no evidence of
faulting was uncovered.
B. Project Description
The applicant proposes to construc.t' a two -story, 7809 sq. ft.
building for retail sales. of , plant's and related products: .
Permanent .landscaping will cove-r 15 ,OOO . sq. ft . of the property..
Twenty three parking; spaces will also be provided.
The building will. abut the existing slo a on the north side of the
property and will reinforce slope' stabi ity. A drainage Swale
will be provided. adjacent to the building and ,wa11 to allow runoff
to a drainage catch basin.
C. Compatibility with zoning and .plans .
The site is currently zoned for commercial . office us. es. but- the C-0
zone allows a retail plant nursery through approval of a Conditional
Use Permit. This review will ensure compatibility .with the Zoning
Ordinance and the General Plan.

D. fdentification of environmental effects
Geology
The project siteds subject to potential landsliding in addition
to li-:iuefactic>nIn view ofthese adverse conditions along with
the potential earthquake hazard nearby, an investigation to verify
existing slope stability should be taken prior to project approval.
Methods to retard erosion and siltation should also be included
in the recommendations' of the consulting soils engineer.
Soils
Expansive soils have been identified in the project vicinity which
could affect proposed construction. All site preparation should be ,
conduced in conformance with the recommendations of the soils
engineer.
Flooding
The most western portion of the project site is subject to. potential
inundation in the event of a 100 year flood. The finished floor
level of the proposed structure will be 8 ft. above the 100 year
flood elevation, thereby preventing the potential for flood hazards
within the commercial structure.
E. Mitigation necessary to avoid significant impact
l.. A detailed soils & geotechnical report shall be prepared
. with recommendations of the soils engineer and/or geologist
incorporated, into the project.
F. Findings of insignificant impact
1. The project site is void of significant vegetation and
wildlife. Impacts due to adverse soil conditions and the
inferred earthquake. fault suspected of lying just north of
the subject property can be mitigated to a level below that
of significant.
2 . The applicants proposal is in general conformance with
the General Plan land use element and is not anticipated to .
achieve short term to the disadvantage of long term environ-
mental goals .
3 . Potential impacts can be mitigated and are not anticipated
to interact to result in any substantial cumulative effect on
the environment.
4 . The proposed plant nursery is not expected to cause a
significant generation of vehicle traffic nor are any sub-
stantial emission or noise anticipated to result. .

RESOLUTION NO. PCZ-80-D
RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING
TO THE CITY COUNCIL THE CHANGE OF ZONE FOR PROPERTY AT
THE NORTHWEST CORNER OF THIRD AVENUE EXTENSION AND SEA
VALE STREET FROM R-1 TO C-0
WHEREAS, a duly verified application for rezoning of property was filed
with the Planning Department by Peter's Home and Garden Center on January 17,
1980, application No. - PCZ-80-D, and
WHEREAS, said application requested a change of zone for property located
at the northwest corner of Third Avehue Extension and Sea Vale. Street from R-1
to C-0, and.
WHEREAS, an Initial Study, IS-80-39, was conducted .by the Environmental
Review Committee on January 17, 1980, which concluded that there would be no
significant adverse environmental impact as the result of the rezoning and
issued a draft Negative Declaration, and
WHEREAS, the City Planning Commission set the time and place for a hearing
on said zone change, and notice of said hearing, together with its purpose, was
given by the publicat ion in a newspaper of general circulation in the City at
least 10 days prior to the date of said hearing, and
WHEREAS, a hearing was held at the time and place as. adyertised, namely
7:00 p.m. , February 13, 1980, before -the Planning Commission and said hearing
was thereafter closed.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1 . The Commission finds that. in accordance with the Negative Declaration
on IS-80-39 and the findings stated therein, this rezoning will not have a
significant adverse environmental impact, and certifies that the Negative
Declaration was prepared in .accordance with CEQA, 1970, as amended.
2. From facts presented to the Commission, the Commission finds that public
necessity, convenience, general welfare and_.good zoning .practice require the
change of zone for property at the northwest corner of Third Avenue Extension
and Sea Vale Street from R-1 to C-0.
3. The Planning Commission recommends to the City Council that said change
of zone be approved.
4. That this resolution be transmitted to the City Council and a copy be
transmitted to the applicant.
