HomeMy WebLinkAboutReso 2018-112RESOLUTION NO. 2018-112 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA WAIVING THE COMPETITIVE BIDDING REQUIREMENTS AND APPROVING AN EXTENSION TO THE LANDSCAPE MAINTENANCE CONTRACT BETWEEN THE CITY AND AZTEC LANDSCAPING, INC. FOR EASTLAKE MAINTENANCE DISTRICT ZONES A, B, AND D AND OPEN SPACE DISTRICT 31 IN THE AMOUNT OF $216,704; OPEN SPACE DISTRICTS 2, 18, AND 23 IN THE AMOUNT OF $87,072; OLYMPIC PARKWAY (I-805 TO SR125), EASTLAKE LANDSWAP, OLYMPIC PARKWAY (SR125 TO HUNTE PARKWAY), AND OTAY RANCH VILLAGE 2 SANTA VENETIA (CFD 13M) IN THE AMOUNT OF $255,197; APPROVING A CHANGE ORDER FOR REINSTATING SERVICES IN OPEN SPACE DISTRICT 7 AND ADDING SERVICES IN DIRECT ACCESS RAMP WEST IN AN AMOUNT NOT TO EXCEED $18,000 WHEREAS, the City is in the process of streamlining its contract management processes for Open Space maintenance contracts; and WHEREAS, the Public Works Department proposes to extend from July 1, 2018 through June 30, 2019 multiple Open Space landscape maintenance contracts which are due to expire on June 30, 2018 to assist in streamlining the City’s contract management processes; and WHEREAS, these extensions will align the bid and expiration dates of two batches of Open Space contracts thereby better utilizing the City’s resources and reducing contract management redundancies; and WHEREAS, the City entered into a contract (Contract) with Aztec Landscaping, Inc. to provide landscape maintenance services, for the following Open Space Districts and Community Facilities Districts (combined “the Districts”): D2, D18, D23, D31, Olympic Parkway, Village 2, ELMD Zone A, ELMD Zone B, ELMD Zone D, and EL Landswap; and WHEREAS, the term of the Contract was from October 1, 2014 to June 30, 2015 with the option to extend the Contract for three (3) one-year periods effective July 1, 2015; and WHEREAS, the Contract was extended for three (3) one-year periods – from July 1, 2015 to June 30, 2016, from July 1, 2016 to June 30, 2017, and from July 1, 2017 to June 30, 2018 respectively; and WHEREAS, the Contract cost was $513,835 for Fiscal Year 2014/2015 and with the application of yearly San Diego Consumer Price Index for Wage Earners (CPI-W) to the successive option-year renewals, the Contract cost increased to $542,692 for Fiscal Year 2017/2018; and DocuSign Envelope ID: 9C6DCBF6-B33E-4242-9B9F-2EECEE0C331A Resolution No. 2018-112 Page No. 2 WHEREAS, the proposed extension of the Contract would apply an additional 3% CPI- W increase for Fiscal Year 2018/2019 resulting in a Contract cost of $558,972.78; and WHEREAS, Staff recommends that City Council approve a Contract change order to reinstate maintenance in OSD7 and increase the scope of maintenance to include DAR West at an additional Contract cost not to exceed $18,000; and WHEREAS, the maintenance costs for OSD 7 will be funded by the District’s assessment revenues and the maintenance costs for DAR West will be funded by operating budget for the Department of Public Works; and WHEREAS, Chula Vista Municipal Code section 2.56.070.B.3 states, “[t]he City Council may waive the competitive bidding requirements if determined by resolution of the City Council that the competitive bidding requirements as applied to that contract are impractical, impossible or that City interests would be materially better served by applying a different purchasing procedure approved by the Purchasing Agent as being consistent with good purchasing practices”; and WHEREAS, Staff recommends that Council adopt a finding that the City’s interest would be better served by waiving the competitive bidding requirements and approving the Contract extension as doing so will provide City with the opportunity to establish streamlined contract management procedures which will substantially reduce contract management redundancies and staff time and costs associated therewith; and WHEREAS, the Purchasing Agent has approved the proposed extension of the Contract as consistent with good purchasing practices; and WHEREAS, Staff recommends that the City Council approve the extension of the Contract with Aztec Landscaping, Inc. and the proposed change order thereto. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista determines that the City’s interest would be materially better served by applying a different purchasing procedure for the extension of the landscape maintenance contract with Aztec Landscaping, Inc. and waives the competitive bidding requirements for the contract extension. BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista approves the extension of the open space landscape maintenance contract with Aztec Landscaping, Inc., from July 1, 2018 through June 30, 2019, for Eastlake Maintenance District Zones A, B, and D and Open Space District 31 in the amount of $216,704; Open Space Districts 2, 18, and 23 in the amount of $87,072; Olympic Parkway (I-805 to SR125), Eastlake Landswap, Olympic Parkway (SR125 to Hunte Parkway), and Otay Ranch Village 2 Santa Venetia (CFD 13m) in the amount of $255,197. BE IT FURHTER RESOLVED that the City Council of the City of Chula Vista approves a change order to the open space landscape maintenance contract with Aztec Landscaping, Inc. to reinstate maintenance services in OSD7 and add maintenance services for DAR West in an amount not to exceed $18,000.00.
