HomeMy WebLinkAboutcc min 2018/04/10 HA 5:00 pm City of Chula Vista Meeting Minutes - Final Tuesday,April 10, 2018 5:00 PM Council Chambers 276 4th Avenue, Building A Chula Vista, CA 91910 SPECIAL MEETING OF THE HOUSING AUTHORITY MEETING JOINTLY WITH THE CITY COUNCIL OF THE CITY OF CHULA VISTA CALL TO ORDER A regular meeting of the City Council and a special meeting of the Housing Authority of the City of Chula Vista were called to order at 5:04 p.m. in the Council Chambers, located in City Hall, 276 Fourth Avenue, Chula Vista, California. ROLL CALL: Present: Councilmember Aguilar, Deputy Mayor Diaz, Councilmember McCann, Councilmember Padilla and Mayor Casillas Salas Councilmember Padilla arrived at 5:05 p.m. Also Present: City Manager Halbert City Attorney Googins, City Clerk Bigelow, and Deputy City Clerk Kansas Mayor Casillas Salas announced that Deputy Mayor Diaz would run the meeting. Mayor Casillas Salas announced, pursuant to AB23, that she and each Councilmember would receive $50 for their attendance at the Housing Authority meeting, which was held simultaneously with the City Council meeting. PLEDGE OF ALLEGIANCE TO THE FLAG AND MOMENT OF SILENCE Deputy Mayor Diaz led the Pledge of Allegiance. SPECIAL ORDERS OF THE DAY A. 18-0092 PRESENTATION OF QUARTERLY EMPLOYEE RECOGNITION RECIPIENTS Human Resources Director Chase recognized recipients of quarterly employee awards. B. 18-0122 EMPLOYEE SERVICE RECOGNITION HONORING STAFF WITH MILESTONE SERVICE ANNIVERSARIES City Manager Halbert recognized employees with milestone service anniversaries. C. 18-0106 PRESENTATION OF A PROCLAMATION TO PUBLIC WORKS DIRECTOR RICK HOPKINS, PROCLAIMING FRIDAY, APRIL 27, 2018 AS ARBOR DAY IN THE CITY OF CHULA VISTA Deputy Mayor Diaz read the proclamation and Councilmember McCann presented it to Public Works Director Hopkins. E. 18-0123 PRESENTATION OF A PROCLAMATION PROCLAIMING APRIL 8 THROUGH APRIL 14, 2018 AS NATIONAL PUBLIC SAFETY TELE-COMMUNICATORS WEEK IN THE CITY OF CHULA VISTA, POLICE DISPATCHER SARAH MC DONALD ACCEPTING ON BEHALF OF THE TELECOMMUNICATION OPERATORS Deputy Mayor Diaz read the proclamation and Mayor Salas presented it to Police Dispatcher Sarah McDonald. CONSENT CALENDAR (Items 1 - 2) 1. 18-0116 RESOLUTION NO. 2018-055 OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA AMENDING RESOLUTION 2018-004 TO REMOVE THE ELECTION OF MEMBER OF THE CITY COUNCIL, REPRESENTING DISTRICT 1, AND CITY ATTORNEY FROM THE JUNE 5, 2018 GENERAL ELECTION AND APPROPRIATING FUNDS THEREFOR (4/5 VOTE REQUIRED) Recommended Action: Council adopt the resolution. 2. 17-0560 A. RESOLUTION NO. 2018-001 OF THE HOUSING AUTHORITY OF THE CITY OF CHULA VISTA APPROVING MULTIFAMILY MORTGAGE REVENUE BOND POLICIES B. RESOLUTION NO. 2018-056 OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ADDING CHAPTER 19 (HOUSING AUTHORITY FEES) TO THE MASTER FEE SCHEDULE AND ESTABLISHING FEES RELATED TO HOUSING AUTHORITY BOND ISSUANCES Recommended Action: Authority adopt resolution A and Council adopt resolution B. Approval of the Consent Calendar ACTION: A motion was made by Councilmember McCann, seconded by Mayor Casillas Salas, to approve staffs recommendations on the above Consent Calendar items, headings read,text waived.The motion carried by the following vote: Yes: 5- Aguilar, Diaz, McCann, Padilla and Casillas Salas No: 0 Abstain: 0 ITEMS REMOVED FROM THE CONSENT CALENDAR There were none. City of Chula Vista Page 2 City Council Meeting Minutes-Final April 10, 2018 PUBLIC COMMENTS Richard Martinez, business owner and Chula Vista resident, and Robert Gunthorp, San Diego resident, expressed concern regarding illegal parking on the street in the area of their businesses. Barbara Gordon spoke in support of CEQA determination for marijuana production facilities. Kathleen Lippitt, Poway resident, expressed concern regarding legalizing commercial marijuana activities. Christine Brady, Chula Vista resident, expressed concern regarding potential impacts on areas around high-density complexes. PUBLIC HEARINGS 3. 18-0084 A. ORDINANCE OF THE CITY OF CHULA VISTA AMENDING CHULA VISTA MUNICIPAL CODE, SECTION 19.58.022 (ACCESSORY SECOND DWELLING UNITS); CHAPTER 19.04 (DEFINITIONS); CHAPTER 19.20 (AGRICULTURAL ZONE); CHAPTER 19.22 (RESIDENTIAL ESTATES ZONE); CHAPTER 19.24 (SINGLE-FAMILY RESIDENCE ZONE); CHAPTER 19.26 (ONE- AND TWO-FAMILY RESIDENCE ZONE); CHAPTER 19.28 (APARTMENT RESIDENTIAL ZONE); AND CHAPTER 19.48 (PLANNED COMMUNITY ZONE) WITH REGARD TO ACCESSORY DWELLING UNITS (FIRST READING) B. ORDINANCE OF THE CITY OF CHULA VISTA AMENDING CHULA VISTA MUNICIPAL CODE CHAPTER 3.32 (RESIDENTIAL CONSTRUCTION TAX) TO EXEMPT ACCESSORY DWELLING UNITS AND JUNIOR ACCESSORY DWELLING UNITS FROM THE RESIDENTIAL CONSTRUCTION TAX AND AMENDING CHAPTER 17.10 (PARKLANDS AND PUBLIC FACILITIES) TO WAIVE ASSESSMENT OF PARKLAND ACQUISITION AND DEVELOPMENT FEES FOR ACCESSORY DWELLING UNITS AND JUNIOR ACCESSORY DWELLING UNITS (FIRST READING) Notice of the hearing was given in accordance with legal requirements, and the hearing was held on the date and no eartier than the time specified in the notice. Development Services Director Broughton introduced Sr Planner Walker, Principal Planner Donaghe, and Sr. Civil Engineer Oberbauer who provided a presentation on the item. Sr. Planner Walker read revisions to proposed Ordinance A. Deputy Mayor Diaz opened the public hearing. Max Zaker, Chula Vista resident, submitted a request to speak but was not present when called. Tracy Morgan Hollingworth, San Diego resident, representing Pacific Southwest Association of Realtors, spoke in support of the item. Deputy Mayor Diaz closed the public hearing. City of Chula Vista Page 3 City Council Meeting Minutes-Final April 10,2018 Councilmember Aguilar proposed revising the ordinances to include public transit"stop." ACTION: A motion was made by Councilmember Aguilar, seconded by Mayor Casillas Salas, to place Ordinances A and B on first reading as amended by staff and Councilmember Aguilar, headings read, text waived. The motion carried by the following vote: Yes: 5- Aguilar, Diaz, McCann, Padilla and Casillas Salas No: 0 Abstain: 0 CITY MANAGER'S REPORTS There were none. MAYOR'S REPORTS Mayor Casillas Salas spoke regarding the April Stay Safe Chula Vista event which promoted pedestrian safety and she stated that she had attended the South Bay Earth Day event. COUNCILMEMBERS' COMMENTS Councilmember Aguilar spoke regarding the Stay Safe Chula Vista event, and pedestrian and bicyclist safety. Councilmember Padilla stated he participated as a judge in the International Brotherhood of Electrical Workers barbecue contest. Deputy Mayor Diaz spoke regarding his recent volunteer ministry service for inmates. Councilmember McCann thanked Ms. _Hollingworth of Pacific Southwest Association of Realtors for her attendance at the meeting. He reported on his attendance at the following events: Community Service Scout Fair at the Elite Athlete Training Center, Earth Day, a ground-breaking for the new VA medical clinic, and the Citizens Advisory Response Team(CAST)graduation. CITY ATTORNEY'S REPORTS City Attorney Googins provided updates on closures of illegal marijuana operations. City Attorney Googins announced that the Council would convene in closed session to discuss the item below and the items on the special 5:30 p.m. meeting agenda. Deputy Mayor Diaz recessed the meeting at 6:36 p.m. The Council reconvened in closed session at 6:40 p.m., with all members present. CLOSED SESSION Pursuant to Resolution No. 13706 and Council Policy No. 346-03, Official Minutes and records of action taken during Closed Sessions are maintained by the City Attorney. 4. 18-0140 CONFERENCE WITH LEGAL COUNSEL REGARDING EXISTING LITIGATION PURSUANT TO GOVERNMENT CODE SECTION 54956.9 (d)(1) City of Chula Vista Page 4 City Council Meeting Minutes -Final April 10, 2018 A.
