Due to issues related to SPA Plan conformance and a recently enacted amendment to CPF land uses,
staff recommends that the Planning Commission continue this item to July 8, 1998. The Applicant
has been apprised of this matter and agrees to the continuance.

Public Hearing: Public Hearing: PCZ-98-01; request to rezone from R1
(Residential Single Family) to CT (Commercial Thoroughfare) to bring the
property located at 619 East Manor Drive, into conformance with Zoning
Ordinance prior to the processing of Adjustment Plat No. 97-08.
The City was approached by the applicant, Mrs. Joyce Curren, in January of this year with a lot
line adjustment application. After review of the application, it was recommended by staff that she
apply for a rezone to bring the parcel more into conformity with City codes.
This subject property was zoned R1 (Single Family Residential) until 1989 when this was split
zoned as R1 (along East Manor Drive) and CT on the Broadway frontage. This parcel as well
as several others in the 600 block of Broadway were subject to the 1989 Rezoning action.
The land use activity on the subject parcel has for many years been a combination of a parking
lot for tire business (Discount Tires) at the comer of Broadway A venue and I Street. As we\1 as
a single family residence which faces East Manor Drive. Approximately 80% of the parcel is in
the R1 Zone, therefore, the parking lot exists on both R1 and CT zoned land (See Attachment 1
and 2, Locator Map and proposed Adjustment Plat No. 97-08).
The Environmental Review Coordinator has concluded that the project is categorica\1y exempt
from CEQA as a Class 5 exemption.
RECOMMENDATION:
That the Planning Commission adopt attached Resolution No. PCZ-98-01 recommending that the
City Council approve the rezoning in accordance with the attached draft City Council Ordinance
No._.
DISCUSSION:
1. Site Characteristics
The site area is relatively flat and contains approximately 22,650 sq. ft. The site is one parcel
with separate zones indicated as Parcel A and Parcel B on the adjustment plat map (refer to
Attachment 2). Parcel A, 619 East Manor Drive, consists of7,840 sq. ft. while Parcel B consists
of 14,814 sq. ft.
There is a narrow access drive located to the northeast rear portion of the project site which feeds
into the parking lot of Discount Tire. The project site is fenced on the sides with a garden wall
and wooden fence. The grass area to the rear of the residence is fenced with a combination of

wooden fence, chain link fence and access gate. In general, the residential properties to the south
contain similar types of fencing with the exception of some limited block wall treatments.
The property is bounded to the north, south and west by Rl zoning and existing small single
family residences. The property to the northeast is zoned CT and contains an active tire business,
Southern California Discount Tires. Remaining properties to the east are zoned CT and developed
with businesses either in strip commercial centers or separate commercial buildings.
Discount Tires building is located at the corner of Broadway and I Street. The parking lot, to the
south side facing Broadway, includes a portion of the residential lot. The westerly portion of the
parking lot is in the R1 Zone.

Rezone a portion of the tire business parking lot in the Rl Zone to CT Zone to make the zoning
consistant with how the property is being used.
4. Analysis
During review of the Adjustment Plat No. 97-8 application, prior to the Planning Department
signing off on the lot line adjustment, a rezone of the property would be required in order to bring
the property into conformance with the land use that currently exists on the area to the northeast
of the "new lot line"; Discount Tire business. Since this parcel as well as adjacent parcels are

already split zoned with residential and commercial land uses existing, staff supports the rezone.
Many of the adjacent commercial land uses in the CT Zone date back many years. Thus the zone
change for this parcel from R1 would not alter what has been preexisting land uses and such
action would allow the commercial activity to continue with no new impact.

RESOLUTION OF THE CITY OF CHULA VISTA PLANNING COMMISSION
RECOMMENDING APPROVAL TO REZONE FROM R-l TO CT TO BRING
PROPERTY INTO CONFORMANCE WITH ZONING ORDINANCE FOR PROPERTY
LOCATED AT 619 EAST MANOR AND 600 BROADWAY AVENUE.
WHEREAS, a duly verified application for a rezone was filed with the City of Chula Vista Planning
Department on March 13, 1998 by property owner, Joyce Curren; and,
WHEREAS, said application requests approval to rezone a portion of the land area from R-1 to CT
for purposes of conformance with Zoning Ordinance prior to processing parcel map; and
WHEREAS, this application wi!! bring the property into compliance with Title 19, and amend the
Zoning Map, Section 19.18 (Exhibit A); and
WHEREAS, this application is in conformance with the General Plan and Landuse designations; and
WHEREAS, the Environmental Review Coordinator has determined that the proposed project is a
Class 5 exemption under CEQA; and,
WHEREAS, the Planning Director set the time and place for a hearing on said tentative subdivision
map application and notice of said hearing, together with its purpose, was given by its publication in a
newspaper of general circulation in the city and its mailing to property owners and residents within 500 feet
of the exterior boundaries of the property at least 10 days prior to the hearing; and,
WHEREAS, the hearing was held at the time and place as advertised, namely June 24, 1998 at 7:00
p.m. in the Council Chambers, 276 Fourth Avenue, before the Planning Commission and said hearing was
thereafter closed; and
WHEREAS, the Planning Commission considered all reports, evidence, and testimony presented at
the public hearing with respect to subject application.
NOW, THEREFORE, BE IT RESOLVED THAT THE PLANNING COMMISSION does hereby
recommend that the City Council approve Rezone application PCZ-98-01 in accordance with the findings and
subject to the conditions contained in the attached City Council Ordinance.
BE IT FURTHER RESOLVED THAT a copy of this resolution be transmitted to the City Council.

THE ZONING MAP OR MAPS ESTABLISHED BY SECTION 19.18.010 OF THE CITY
OF CHULA VISTA MUNICIPAL CODE BY REZONING A PORTION OF PARCEL
LOCATED AT 619 EAST MANOR AVENUE AND 600 BROADWAY A VENUE FROM
R-l (SINGLE FAMILY RESIDENTIAL) TO CT (COMMERCIAL THOROUGHFARE)

WHEREAS, a duly verified application for a rezone was filed with the City of Chula
Vista Planning Department; and
WHEREAS, said application requests approval to rezone a portion of a parcel from R1 to
CT for purposes of incorporating said areas to bring into comformance with the Zoning
Ordinance and Zoning Map, Chapter 19, Section 19.18, prior to processing parcel map as
depicted on Exhibit A attached hereto; and
WHEREAS, the Environmental Review Coordinator has determined that the proposed
project is a Class 5 exemption; and
WHEREAS, on June 24,1998 the City Planning Commission voted to recommend

WHEREAS, the City Clerk set the time and place for a hearing on said rezoning

newspaper of general circulation in the city and its mailing to property owners within 500 feet of
the exterior boundaries ofthe property at least ten days prior to the hearing; and
WHEREAS, the hearing was held at the time and place as advertised, namely on
1998, at 7:00 p.m. in the Council Chambers, 276 Fourth Avenue, before the City Council and

NOW, THEREFORE, the City Council of the City of Chula Vista does hereby find,
determine, and ordain as fo!!ows:
SECTION I: the City Council hereby finds that the rezoning provided for herein is
consistent with the City of Chula Vista General Plan and that the rezoning is supported by public
necessity, convenience, general welfare and good zoning practice.
SECTION II: that the portion ofland areas at 619 East Manor, as shown on Exhibit A is
hereby rezoned from Rl to CT.
SECTION III: this Ordinance shall take effect and be in full force the thirtieth day from
its adoption.

Public Hearing: PCA-98-06; application to amend Chula Vista Municipal
Code Section 19.62.100 to change "Temporary" parking from six months
to 12 months and include parking pavement standards for private vehicular
areas into the Zoning Text.
Nearly a decade ago, the City of Chula Vista developed temporary and permanent paving
requirements for private parking lots. After adoption as policy by the Planning Commission, it
was made into an INFORMATION HANDOUT (includes Pavement Standards for Private
Vehicular Areas and Parking Table) for public distribution at the Planning Department counter
(see Attachment 1). This handout was an accessory to the Zoning Ordinance, Chapter 19, Section
19.62.100 Pavement Standards for Private Vehicular Areas. The Parking Table is not being
revised in this amendment. In a memo dated November 5, 1997, the Engineering Division
updated the paving standards to bring them into conformance with environmental requirements
(Attachment 2). See Attachment 3 for the amended text to Chapter 19.62.
The Environmental Review Coordinator has concluded that the project is categorically exempt
from CEQA as a Class 5 exemption.
RECOMMENDATION:
That the Planning Commission adopt attached Resolution No. PCA-98-06 recommending that the
City Council approve the amended text to Chapter 19.62 - Off-Street Parking and Loading, of the
Zoning Ordinance, in accordance with the attached draft City Council Ordinance.
DISCUSSION:
1. ~
According to the Public Works/City Engineer's Department several issues needed to be addressed
in the Pavement Standards for Private Vehicular Areas:
. First, the materials used (cut -back asphalt) and design standards had long been outdated
and were environmentally undesireable. The cut-back asphalt had been replaced by
emulsion composites.
. Second, the local design standards were long outdated. In order to update these standards,
local agencies had the option to adopt the "Green Book", Standard Specifications for
Public Works Construction, which the City of Chula Vista adopted.

. Third, because of problems related to the time frame for "temporary parking," which is
currently set at six months, staff is proposing that the time limit be extended to 1 year.
This would allow temporary parking standards to coincide with the minimum Conditional
Use Permits of 1 year.
The handout was revised in 1997 but never incorporated into the City Zoning Ordinance. The
primary purpose of the revision was to meet State regulations regarding air pollution and
hazardous material composites in pavement base and implement the use of state-of-the-art design
standards.
The meanings of the following materials and standards used in the Zoning Text Amendment,
Attachment 1, are:

2. Proposal
The proposal is to amend the Chula Vista Municipal Code, Chapter 19, Section 19.62.100, by
incorporating portions of the INFORMA nON HANDOUT, previously adopted by the Planning
Commission as policy, with changes regarding Paving Standards and Temporary Parking.
3. Analysis
The existing standards call for two inches of compacted decomposed granite with the top one inch
treated with SC-25- asphalt road oil. However the use of SC-250 liquid asphalt, a solvent based
"cutback" oil was phased out several years ago by the Air Pollution Control District. The

previous substances were hazardous to the environment because they put volatiles into the air;
"cutback materials". The new substances consist of emulsion materials which contain water as
part of the asphalt solution, which is less hazardous to the atmosphere.
Additionally, in reviewing the standards for semi-permanent and permanent use pavements which
is limited to six months, the City staff determined such standard is also outdated. Therefore, staff
has recommended the paving standards time frame be consistent with Conditional Use Permits
which are authorized for a minimum of 1 year.
Conclusion
It is staff's opinion that this Zoning Amendment will bring the code up to date regarding
temporary parking and paving standards and provide clarity and conformance with local and State
regulations for the general public.

PAVEMENT STANDARDS FOR PRIVATE VEHICULAR AREAS
Areas upon pri vate property whi ch are requi red to be paved per the vari ous
City regulations, or pursuant to conditional approval of the Planning
Commission shall be paved in accord with the requirements contained herein and
with the standard speci fi cati ons of the Ci ty. Such requi rements shall apply
to all areas to be paved for the movement, parking or storage of vehicles
except as specifically noted.
1. TEMPORARY USE (maximum of one year). Temporary pavement shall
consist of two (2) inches of compacted decomposed granite, the top one inch of
which has been treated with SC-250 asphalt road oil to form a water-resistant
and dust free wearing surface. Penetrants shall be applied at such rates or a
sufficient number of times to produce the specified wearing surface. A weed
ki 11 er shall be appl i ed in accord wi th the manufacturers i nstructi ons to the
entire area to be paved.
2. SEMI-PERMANENT USE (maximum of five years). Semi-permanent pavement
shall consist of two inches of asphalt concrete pavement with seal coat placed
upon native soil. Asphalt concrete shall be Type "8" per Section 8 of the
Standard Specifi cati ons except that it shall be permi ss ibl e to use 40-50
penetration grade asphalt binder as an alternate to 60-70 penetration asphalt
binder. A Type "A" seal coat per Subsection 8-08 of the Standard
Specifications shall be applied to the entire paved surface.
Nati ve soi 1 to recei ve pavement shall be graded and compacted pri or
to installation of paving material. A weed killer shall be applied in accord
with the manufacturers instructions to the entire prepared native base.
3. PERMANENT USE. Permanent pavement shall consist of a minimum of two
inches of asphalt concrete pavement with seal coat, as described under
"Semi -Permanent Use" above, appl i ed over a four inch aggregate base (Cl ass 2A)
per Section 7 of the Standard Specifications. Native subgrade shall be graded
and compacted prior to application of the structural section.
Permanent areas for the storage only of passenger type vehicles may
be paved as specified under semi-permanent use. This reduction shall apply
only to the specific storage areas and does not include areas designated for
parking or movement of vehicles.
4. DRIVEWAYS FOR ALL SINGLE-FAMILY, ATTACHED AND DUPLEX RESIDENCES.
Driveways for all single-family, single-family attached, and duplex residences
shall be paved with a minimum of four inches (4") of concrete of a five sack
mix. The Director of Planning may authorize the use of other "permanent
pavement", as specified above, when it can be determined that concrete paving
would be unnecessary or impractical. Guidelines for such variance would be:

In all instances, pavement grades shall be designed and constructed so as to
prevent ponding of water upon or adjacent to the paved surface.
Pavement shall be maintained in serviceable condition at all times. Patching,
sealing and/or repenetration shall be undertaken as necessary to maintain a
usabl e surface. .
Materials and construction methods shall be adequate to accomplish the
intended 1 ife and purpose of the specified cl ass of pavement. The City
Engineer shall have the authority to deny final inspection and utility
approval for any property upon which such materials and methods are inadequate.
These specifications establish minimum acceptable standards. Higher Quality
materials as approved by the City Engineer may be substituted in all cases.
DESIGN FOR UNUSUAL CIRCill~STANCES
Special design efforts are justified in all cases where:
1. Native soil is expansive, poorly drained or has a high clay content.
2. Traffic volumes are high.
3. Unusually heavy vehicles are expected to utilize the pavement.
Relative to the paving of multiple, commercial and/or industrial properties,
the City Engineer may require the submission of a pavement design to
accommodate any unusual circumstances. Upon approval of the design by the
City Engi neer, such desi gn shall supersede the bl anket requi rements contai ned

This is in response to your memorandum of October 27, 1997 regarding temporary parking paving
requirements. The existing standards call for two inches of compacted decomposed granite with
the top one inch treated with "SC-250 asphalt road oil". However, the use of SC-250 liquid
asphalt, a solvent-based "cutback" oil, was phased out several years ago by the Air Pollution
Control District. We have also reviewed the standards for semi-permanent and permanent use
pavements and have determined that they are also outdated.
Therefore, the Engineering Division recommends that the "Pavement Standards for Private
Vehicle Areas" be revised as follows:
Areas upon private property which are required to be paved per the various City
regulations or pursuant to conditional approval of the Planning Commission shall
be paved in accordance with the requirements contained herein and with the
Standard Specifications for Public Works Construction ("Greenbook") and any
amendments or supplements thereto, including the San Diego Regional Supplement
Amendments and the City of Chula Vista Standard Special Provisions. Such
requirements shall apply to all areas to be paved for the movement, parking or
storage of vehicles, except as specifically noted.
1. TEMPORARY USE (Maximum of one year): Temporary pavement shall
consist of two (2) inches of compacted disintegrated granite, the top one
inch of which has been treated with CRS-2 or CMS-2 asphalt emulsion to
form a water-resistant and dust-free wearing surface. The asphalt emulsion
shall be applied at such rates or a sufficient number of times to produce the
specified wearing surface. A weed killer shall be applied to the entire area to be paved in accordance with the manufacturer's recommendations.
As an alternative for pavements which will be used exclusively for the
movement and parking of heavy trucks, processed miscellaneous base,
included recycled asphaltic concrete base, may be substituted for
disintegrated granite.

2. SEMI-PERMANENT USE (Maximum of Five Years): Semi-permanent
pavement shall consist of two inches of asphaltic concrete pavement with
seal coat placed upon native soil. Asphaltic concrete shall be Type III,
Class B2 or Class C2, as specified in Section 400-4.3 of the "Green Book" ,
except that it shall be permissible to use AR-2000 asphalt cement as an
alternate to AR-4000 asphalt cement. A seal coat in conformance with
Section 302-5.10 of the San Diego Regional Supplement Amendments
using an RS-1 or equivalent high viscosity asphalt emulsion shall be applied
to the entire paved surface.
Native soil to receive pavement shall be graded, scarified, and compacted
to 95% minimum relative compaction per ASTM D-1557 to a minimum
depth of six inches prior to installation of paving material. A weed killer
shall be applied to the entire prepared native soil in accordance with the
manufacturer's recommendations.
3. PERMANENT USE: Permanent pavement shall consist of a minimum of
two inches of asphaltic concrete pavement with seal coat, as described
under "SEMI-PERMANENT USE" above, applied over a four inch-thick
Class II aggregate base or better. Aggregate base shall comply with
Section 400-2 of the San Diego Regional Supplement Amendments and
shall be compacted to 95 % minimum relative compaction per ASTM D-
1557. Native subgrade shall be graded, scarified, and compacted to 95 %
minimum relative compaction per ASTM D-1557 to a minimum depth of
six inches prior to application of the asphaltic concrete structural section.
Permanent areas for the storage only of passenger-type vehicles may be
paved as specified under "SEMI-PERMANENT USE". This reduction in
structural section shall apply only to the specific storage areas and does not
include areas designated for parking or movement of vehicles.
Please note that temporary pavement is recommended for a maximum of one year, although the
municipal code specifies a timeframe of six months. Also, processed miscellaneous base, which
includes recycled asphaltic concrete base material, is not being recommended for general parking
under "TEMPORARY USE" due to potential roughness and variations in surface texture, which
could cause significant trip and fall injuries compared to a smooth wearing surface.

There shall be provided, at the time any building or structure is erected or is enlarged or increased in
capacity, or any use is established, off-street parking spaces for automobiles in accordance with the
requirements herein; provided, however, that when an addition is made to an existing building, only the
square feet in the addition need be used in computing the required parking. (Ord 1212 91 (part), 1969; prior

Size and access requirements.
Size and access of off-street parking and loading facilities shall be as follows:
A. No parking area, except for a single-family or duplex residence, may be located so as to require or
encourage the backing of automobiles or other vehicles across any street lot line, to effect egress from
the places of parking.
B. Access to parking spaces for a single-family dwelling may be not less than nine feet in width
throughout and paved in accordance with engineering specifications as adopted by the planning
commission.
C. Driveways used to serve two to four dwelling units shall be not less than twelve feet if the furthest
unit is eighty feet or less from the front property line, and a minimum of fifteen feet if the distance is
over eighty feet long. Driveways used to serve five or more dwelling units shall be not less than
fifteen feet for one single lane entrance; the combination of two separate driveways (an entrance and

RESOLUTION PCA-98-06
RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CHULA VISTA
RECOMMENDING THE CITY COUNCIL AMEND MUNICIPAL CODE TITLE 19, SECTION
19.62.100 TO AMEND TEMPORARY AND PERMANENT PARKING STANDARDS AND
INCLUDE PAVEMENT STANDARDS FOR PRIVATE VEHICULAR AREAS INTO THE
MUNICIPAL CODE.
WHEREAS, a City-initiated report regarding current temporary and permanent parking
standards was presented to the Planning Commission for review pursuant to a recommendation
regarding possible changes to the current Zoning Ordinance, Section 19.62.100; and,
WHEREAS, the Environmental Review Coordinator determined that the Project is a Class
5 Categorical Exemption pursuant to the California Environmental Quality Act; and
WHEREAS, the Planning Director set the time and place for a public hearing on said report
and notice of said hearing, together with its purpose, was given by its publication in a newspaper of
general circulation in the city for a minimum often (10) days prior to the hearing of the Planning
Commission; and,
WHEREAS, the hearing was held at the time and place as advertised, namely June 24, 1998
at 7:00 p.m. in the Council Chambers, 276 Fourth Avenue, before the Planning Commission and said
hearing was thereafter closed; and
WHEREAS, since that date and with recent changes to the temporary parking and paving
standards the Zoning Ordinance is proposed to be amended so as to properly provide continuity,
simplification and conformance with State regulations on pavement and composite materials,
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission does hereby recommend
that the City Council approve the amendment to Chapter 19.62.100(a) and (b) Pavement Standards
for Private Vehicular Areas in accordance with the findings and subject to the conditions contained
in the attached City Council Ordinance.
BE IT FURTHER RESOLVED THAT a copy of this resolution be transmitted to the City Council.

THE PAVEMENT STANDARDS FOR PRlV ATE VEHICULAR AREAS INTO
CHAPTER 19, SECTION 19.62.100
WHEREAS, the City initiated this proposal of the Zoning Code text amendment of
Chapter 19.62.100, addressing Temporary Parking time limitation from six months to 12 months
and inclusion of the adopted Pavement Standards for Private Vehicular Areas and hereby referred
to as Sections 19.62.100(a) and 19.62.100(b) respectively; and
WHEREAS, this amendment brings the changes into conformance with the City of Chula
Vista Zoning Code; and
WHEREAS, this amendment brings the adopted policy and the City's parking surfacing
requirements into compliance with the City of Chula Vista Standard Special Provisions, and
State and Federal regulations per the Standard Specifications for Public Works Construction, and
San Diego Regional Supplement Amendments; and
WHEREAS, the Environmental Review Coordinator determined that the Project is a
Class 5 Categorical Exemption pursuant to the California Environmental Quality Act; and
WHEREAS, on June 24, 1998 the City Planning Commission voted
recommending that the City Council approve the Zoning Code text amendment to Section
19.62.100(a) and (b) in accordance with Resolution No. PCA-98-06; and
WHEREAS, the City Clerk set the time and place for a hearing on said Zoning Code
Amendment application and notice of said hearing, together with its purpose, was given by its
publication in a newspaper of general circulation in the city least ten days prior to the hearing;
and
WHEREAS, the hearing was held at the time and place as advertised, namely on
1998, at 7:00 p.m. in the Council Chambers, 276 Fourth Avenue, before the City Council and
said hearing was thereafter closed.
NOW, THEREFORE, the City Council of the City of Chula Vista does hereby find,
determine, and ordain as fo!!ows:
SECTION I: The City Council hereby finds that the Zoning Code amendment provided
for herein is consistent with the City of Chula Vista General Plan and that the amendment is
supported by public necessity, convenience, general welfare and good zoning practice.
SECTION II: That the Project is a Class 5 Categorical Exemption from Environmental
Review pursuant to the California Environmental Quality Act.
SECTION III: That the amendment of Chapter 19, Section 19.62.100a "Temporary"
parking from six months to 12 months and inclusion of the Paving Standards for Parking into
Chapter 19, Section 19.62.100b, as shown on Exhibit A.
SECTION IV: this Ordinance shall take effect and be in full force the thirtieth day from
its adoption.

GENERAL PURPOSE OF THE COMMISSION: Serves as the official planning agency ofChula
Vista and evaluates major land use proposals in terms of their impact on the City. It conducts public
hearings on significant planning, zoning and land subdivision matters, and recommends action and
policy to the City Council. The General Plan and specific plans are prepared under the guidance of
the Planning Commission.
IDGHLIGHTS AND ACTIVITIES DURING THE PAST YEAR:
While the Planning Commission work effort for FY 1997-98 was largely focused on the eastern
territory planning efforts, a variety of projects were also addressed by the Commission. They
processed GPA's, rezonings, tentative subdivision maps, SPA amendments as well as numerous
ordinance amendments including the City's newly adopted citation authorization to assist in more
efficient processing of violations.
The Planning Department conducted monthly workshops to provide the members with additional
background information on important and complicated issues. The workshops included a detailed
update on the major developments in eastern Chula Vista together with background information on
the proposed open space conveyance schedule and in-lieu-fee program. In addition, the Otay Valley
Regional Park concept plan and the City's mitigation monitoring program were presented to the
Commission.
