HomeMy WebLinkAbout1953-02-02 PC MINS r MINUTES OF A REGULAR MEETING OF THE PLANNING COMMISSION OF THE CITY OF CHULA VISTA, CALIFORNIA Held February 2, 1953 The Planning Commission met in the Council Chambers of the City Hall on the above date at 7:30 P.M. with the following members present: Wulff, Longworth, Drew, Ramage, Stewart, Poulter and Smith Absent: None Also Present: City Attorney Boyer, City Planner Wagner and Assistant City Engineer, Wheeler APPROVAL OF MINUTES Meeting held January 5, 1953. Regarding the Dra. Kelly variance: Member Smith amended his motion to read that the Dr. Kelly structure is to substantially follow the plans submitted to the Commission. City Planner Wagner added that Mr. Frank Farrell, representing Dr. Kelly, has assured him that this would be done. It was moved by Member Stewart, seconded by.Member Ramage, and carried, that the minutes be approved with the above correction. Meeting held January 19 1953. It was moved by Member Stewart, seconded by Member Poulter, and carried, t at the minutes be approved. ZONE VARIANCES Clarence L. Close - 196 Madrona.Street, requests_ permission to split a 931-8" by 12 - of into two parcels - one 501-0" by 1271-711 and the other 431-$ by 127!-7" in an R-1 zone. ' It was moved.by Member Ramage, seconded by Member Smith, and carried, that the lots be split, reducing the corner lot to approximately 6379 sq. ft. and the other lot to approximately 5571 sq. ft., and maintaining the established setback for the reasons stated in the application. G Forrest S. Buffington - 398 Mankato Street, requested permission to conduct a commerclal p oto inis ing laboratory and business .in his garage in an R-3 zone. ;`Ll Me. Buffington produced his business licenses for the years 1950 and 1951, issued by ;• the City of Chula Vista as evidence that his neighbors apparently did not know that t he was conducting a mail order business on his property. . Mr. Buffinton stated that he would not use signs on the .property in his. business. It was moved by Member Smith, seconded by Member Stewart that the zone variance be approved with a time limit es- tablished at December 31, 1954. The motion carried by the following vote, to-wit: AYES: Members Wulff, Longworth, Ramage, Stewart, Poulter, Smith NAYS: Member Drew ABSENT: None Frank Mohaupt - 330 National Ave., requested variance to allow a trailer park to extend beyond 1251 M-1 zone., a distance of 4751 westward into the R-3 zone'. It il•a was moved by Member Ramage, seconded by Members Stewart and Longworth that the variance for a trailer park be granted for the reasons stated in the application, inasmuch as there is nothing but trailer parks 300 feet to the south and the only residence which might be affected is the Mohaupt residence. The motion carried by the following vote, to-wit: i -2- AYES: MEMBERS lluulff, Longworth, Ramage, Stewart', ,Smith NAYS: MEMBERS Poulter, .Drew ABSENT: None Herman L. and Vernon Tribby - 119 Minot Street, request permission to reduce the front setBack rom 25 ft. to 17 ft. - 3 inches. The roof overhang of the building now extends beyond the front setback established for this property and. the proposed addition would riot extend beyond said overhang. Assistant City Engineer clarified the fact that the City had proposed to re- quest each property owner (under the 1911 Act) in the area to dedicate frontage for sidewalks, so a 36' travelway is now being considered within the 40' right of way. It was moved by Member Stewart, seconded by Member Smith, and carried, that the variance be approved for the reasons stated in the application. TREE REMOVALS James J. Mazomenos - east side of National Avenue, south of "J" Street. City Planner Wagner reviewed the minutes of meeting of August 4, 1952 and stated that, at that time the request was granted Mr. Mazomenos to remove only the palm trees at that property; now the owner wishes permission to remove the 6 fig trees and one pepper tree that were also on the original application-. It was moved by Member Poulter, seconded by Member Stewart, and carried, that the trees be re- moved at the owner's expense. Bertha Hall - 539 "E" Street, requests permission to-remove two eucalyptus trees on pa`k ay strip as the roots are raising the sidewalk. However, when Park Superintendent,Chester Norman, talked with Mrs. Hall, she had decided to withdraw her request, inasmuch as "E" Street, she felt, would soon be widened. As no formal notice was received by.the Planning Commission, as to the withdrawal of the request, it was moved- by Member Ramage, seconded by Member Longworth, and carried, that permission be granted to remove the trees at the owner's expense. Martin Green - 621 "G" Street, requests permission to remove one pepper tree, as it wou in er ere with proposed driveway to a new apartment house. It was moved by Member Stewart, seconded by'Member Ramage, and -carried, that the tree at the east er of the parkway strip be-removed at the owner's expense and that suitable replacement be made and at a location that meets with the approval of the Park Superintendent. TENTATIVE MAPS Rose View - Harold Foster for L. T. Brewer - 18 lots in approximately 5 acres - R-1 zone - east of Second Ave., south Boundary 260 feet north of "'�" Street. The owner of the parcel which :.would be closed off entirely without access is not in- terested in selling or developing at this time, according to Mr. Brewer. Member Poulter suggested that City Planner Wagner contact the owner of the closed off property before any further steps are taken. Member Poulter said that the double frontage lots restriction would not hold in this case because the City could request that one foot be dedicated by the developers. Chairman Wulff brought out the fact that an easement would be required for drainage on King Street to the west. It was moved by Member Stewart, seconded by Member Ramage that the tentative plans be approved as submitted but failed to carry by the following vote; to-wit: AYES: MEMBERS Longworth, Ramage; Stewart NAYS: MEMBERS Wulff, Poulter, Smith and Drew ABSENT: None. -3- It was moved by Member Ramage, seconded by Member Smith, that the matter be held over until the next meeting which would be a joint City-Council Planning Commission Meeting to be held February 16, 1953, rather than wait until the March 2, 1953, meeting of the Planning Commission, and carried, by the following vote, to-wit: , AYES: MEMBERS Wulff'. Longworth, Ramage, Poulter and Smith NAYS: MEMBERS Drew and Stewart s ABSENT: None Pepper Tree Lane Tract No. 2 - Henry Al-gert for Centex Corporation - 133 lots, on approximate y acres, between nJn and !'K" Streets. City Planner Wagner questioned the possibility of erecting a duplex on the 52 feet left after set-- backs et-backs on a lot on Madison, but the developer said the duplex would be only 48 feet in width. It was moved by Member Poulter, seconded by Member Ramage, and carried that the tentative map be approved under the following conditions: (1) that a one foot lot along the east side of Madison Avenue be deeded to the City, (2) that curb returns be made with a greater radius at each corner, (3) that all setbacks on Kearney be considered as side yards, (4) that tangents be placed on reverse curbs, and (5) setbacks on nK" and "J" Streets be considered side yard setbacks. Member Ramage left the meeting at this point. Kuebler Terrace #9 - H.C. Foster for V.C. Kuebler - 87 lots - between IIF" and 117- treets - west side of first Avenue. Mr. Foster explained that the developers plan to complete the subdivision in two units -- Unit #9- would cover those lots on the perimeter and Unit #10 would be the interior lots as shown on the plans sub- mitted to the Planning Commission. Also the plans call for improvement of Minot and Alpine Streets on Unit #9, between 'IF" and "G" Streets. It was moved by Member Poulter, seconded by Member Stewart, that the map be approved with the following modifications: (1) Cypress Street go through to Minot, (2) 20 foot set- backs on First Avenue only if that is the setback approved for �the Uecker sub- division to the north, and (3) 20 foot setbacks on "G", "F" and First Avenue. Motion carried with the following vote, to-wit: AYES: MEMBERS Wulff," Stewart, Poulter and Smith NAYS: MEMBERS Longworth and Drew ABSENT: MEMBER Ramage Member Drew made a motion, -seconded by Member Longworth, to add an amendment to the motion to the effect Cypress Street be improved through to Alpine, but it did not receive the approval' of the other planning Commission members: Member Ramage 'returned .to the meeting at this time. FINAL MAPS Country Club Vista. The subdivision name,- "Country Club Villas No. 211, was assigned to this tract by the City Council. It was moved by Member Ramage, -seconded by Member Stewart, and carried, that the final map be approved as the engineering office had already approved it. Verde Park No. 5 - It was moved by Member Stewart, seconded by Member Poulter, and carrie , t at anal map be approved subject to the final-approval of the City Engineer's office. Kuebler Terrace No. 8 - It was moved by rlember Ramage, seconded by Member Smith, and carried, t at the final map be approved "subject to final check by the city engineers. Chula Vista Manor - It was moved by Member Poulter, seconded by Member Smith, that -=efinal map be approved subject to city engineers' final check, and carried, by the following vote, to-tient: AYES: MEMBERS Wulff, Longworth, Drew, Stewart, Poulter and Smith NAYS: MEMBER Ramage ABSENT: None RESOLUTIONS OF PROPERTY USE Charles S. Offerman - N.W. Corner Montgomery Freeway and "G" Street in M-2 zone - 93 unit trailer park. It was moved by Member Stewart, seconded by Member Ramage, that the resolution be-approved contingent upon the trailer park's being improved as outlined in the letter and in accordance with the plans submitted; the motion carried by the following vote, to-wit: AYES: MEMBERS Wulff, Longworth, Stewart, Smith and Ramage NAYS: MEMBERS Poulter. and Drew ABSENT: None Littlejohn and 'Wesselink - 4.60 National Avenue - 62 units trailer park. This is the third time this parceI has been before the Planning Commission for approval. It was moved by Member Ramage, seconded by Member StewFrt that this resolution be approved subject to a 90 day time limit for starting the development. The motion carried by the following vote, to-wit: •AYES: MEMBERS t-Tulff, Longworth, Ramage, Stewart, Poulter and Smith NAYS: MEMBER Drew ABSENT: None Sterbenz-Terry - It was moved by Member Stewart, seconded by Member Longworth, that the reso -uion for property use be approved. The motion carried by the follow- ing vote, to-wit: AYES: MEMBERS Wulff, Longworth, Ramage, Stewart, Poulter and Smith NAYS: MEMEER Drew ABSENT: None LETTERS J.D. Peters' letter requesting a resolution be passed asking the State Highway Commission to move the future cloverleaf inters-section at "L" Street and Montgomery Freeway to "J" Street and Montgomery Freeway was read by City Planner Wagner. Member Drew suggested further study be made by City Planner Wagner. Discussion centered ,around State Highway discussions of the past. Members Stewart and Chairman Wulff told of the talks with the State.Highway representative. Chairman Wulff stated.he. appreciated Mr. Peters' interest and effort on this matter. Mr. Peters added that hetias not opposed to the original plans for "L" Street and he had talked to Rep. Cloyed, who offered to aid in moving the appropriation from "L" to "J" Street if the Planning Commission would write a letter to that effect. i -5- _ It was moved by Member Drew, seconded by Member Ramage, and carried, thatCity Planner Wagner make preliminary survey of "J" Street and if it proves feasible, make a report to the City Council so that funds from budget may be drawn to make the ne- cessary studies -- amended to state that City. Planner has blanket approval to proceed. PETITION A petition signed by 12 property owners in the vicinity of First Avenue and "K" Street requesting reinstatement of original "L'' Street extension into the Master Street Plan, was read by City Planner .Wagner. Chairman Wulff explained past action by Commission and reasons for considering other routes, cautioning those present to make brief statements. Mr. George Kenworth, 276 "K" Street stated his lot runs 100 ft. back and falls into canyon w is e c aims is owned by the City as it is a waterway. Mr. M. L. Small, 783 First Avenue, registered complaint against it -- owns 315 feet on First Avenue and objects to a temporary survey. Mr. Small stated that he purchased his property 'in 1945 desiring a large area with no streets and added he believes property owners on 11K" Street have constructed their houses so that there is no access to rear of their lots. He added that he doesn't believe this condition. is a hazard to children nor is it a breeding place for mosquitoes. Mr. Butterfield - owns property north-and south of Mr. mall, and feels as Mr. Small does -- wants no road at that point. Mr. Butterfield inquired about whether it would be a freeway or if there would be access. ChairmanWulff stated that there would be access. Mr. Anderson, 53 nK" Street was interested in obtaining access to back of his lot -- says present area needs improving. Mr. Anderson stated that if the road were constructed, it would be.advantageous to his property. Mrs. Anderson talked of weeds and snakes, called it "waste land" that would be developed. Mrs. Guthrie, 83 "K" Street, has first long lot 475 ft. and has no use for rear end of lot and would like a street so'access might be obtained to rear. Mrs. Messler, 43 nKn Street, would like to see a road at the back of her property. Mr. Dalton, 33 "K." Street, has same problem as'others, with a steep hill in back of the lot and would like to develop the property. Tenants of Hilltop Village dump their trash into his lot. Mr. Barker, 23 11K11 Street, states -'his property goes 515 ft. back from "K« St. and has a level lot at bottom for about 150 feet. Mr. Barket states the rear of lot is where the wash is -- originally the wash went straight, but has changed its course as the result of a flood. Would like to see the wash corrected. Chairman Wulff thanked the property owners for their interest and comments and further explained reasons for the proposed "L" Street and its new location, as well as the engineering problems encountered as the reason for the abandonment of the original plan. City`Planner Wagner requested the Commission to establish an official setback for the recently approved extension of Ccsselman Street east of Monte Vista Avenue. It was -6- moved by Member Poulter, seconded by Member Stewart, and carried, that a 20 foot setback be established. Member Ramage asked that consideration be given to eliminating all M-1 zoning from residential areas and requested that M-1 be moved west to.the Freeway; also that M-1 zoning on National Avenue be changed to commercial -- possibly C-2 zone. Chairman Wulff requested City Planner Wagner to prepare a suggested rezoning for the next meeting. It was moved by Member Ramage, seconded by Member Stewart, and unanimously carried that.the meeting adjourn at 12:30 A.M. until February 16, 1953. a I-A ci a onar , Secretary
