OF THE PLANNING COMMISSION OF TIE CITY
OF CHULA VISTA, CALIFORNIA
Held May 4., 1953.
The Planning Commission met in the Council Chamber at the Civic Center on
the above date at 7:30 P.M. with the following Members present: Wulff y Drew'
Stewart., Poulter and Smith.
Absent: Members Longuorth., Ramage.
Also Present: City Attorney Boyer., City Planner Wagner and Mr. Horace L. Gilbert'
Councilman from the City of Escondido.
APPROVAL OF MINUTES
Meeting held April 20., 1953. It was moved by Member Poulter, seconded by
Member Stewart, and carried., that the minutes be approved.
ZONE VARIANCES
Carl Roth,, 881 First Avenue, requests permission to convert existing garage
into a childrents playroom in an R-1 zone with 3 foot side yard. Mr. Roth, who
was present, stated he had no intentions of using the room other than as a play-
room for his own children; the room has no plumbing and no.windows on the side wall
where setback variance is requested and., further, it has no further use as a garage.
Mr, Roth added that he plans to build a garage in the future at the .rear of his
property, where he has access to an alley. It was moved by Member Smith, seconded
by Member Stewart, and carried, that the variance be granted.
Sam Shapov., 357 Third Avenue Extension., requests permission to construct and
�:_. . operate a cleaning plant' liquor store and other commercialbusinesson a triangular
piece of property at the northeast corner of "C" Street and Third Avenue Extension.
Representing Mr. Shapov were Mr. Keith'Atherton, Attorney., and Mr. E. Yahnke.
City Planner Wagner informed the Commission-that cards had been sent to .50 property
owners in view of the parcel, and that the petitioner has indicated that he wished
to amend the application to a request for the cleaning plant and.not the liquor
store and other store as indicated. Member Drew suggested that when a variance of
this type is granted$ it might be advisable to put a time limit on -such a variance.,
so that control of any future business for the location might be effected.
Attorney Atherton stated he would like to withdraw all other uses but for that
of a-cleaning plant. When informed that signs were not included in this particular
request for variance, he asked that such request be added at this time. Attorney
Atherton was also advised that a cleaning establishment permitted in C--2 zone is
one using only cleaning fluid which is non-explosive and non-inflammable at
temperatures below 138.50 Fa
In the audience were a number of nearby property owners who protested the
variance., as follows: Commander W.' H. Farrell, 381 'D'1 Street., declared that a
promise was made to property owners in the vicinity of Herb Daviest Florist Shop
that no further commercial infiltration would occur in this area.
Mr, Frank Sipan, 327 Kimball Terrace' stated that Third Avenue Extension is
considered an important entrance to the City and should be made attractive. .
Mr. Robert Norton' 321 Kimball Terrace, inquired if Third Avenue Extension
and its eventual hookup with 29th Street in National City and Montgomery Freeway
in Chula Vista is to become a commercial vehicle inlet into Chula Vista. City
Planner Wagner informed him that a belt line freeway through Sweetwater Valley
to connect with First Avenue and Highland is proposed. Chairman Wulff added his
belief that both commercial and passenger vehicles would be used on Third Avenue
Extension.
Mr. Oscar T. Weisgerber, 347 Kimball Terrace' wondered if the property
for which the request is being made is the only piece of property available in
Chula Vista for a cleaning plant. It was- his suggestion that, because of the
drainage problem' the City should purchase the property and make a park of it.
Mrs. Weisgerber reiterated Mr. Weisgerberts statements.
Mrs. LeRoy F. Donovan, 331 Kimball Terrace,.was assured, when she pur-
chased her property that it was zoned R-1 and would remain so.
Mr. Sidney Achter, 263 I'D" Street' stated he bought his property just for
the view. He, too, felt that a park effect would serve Chula Vista best.
Mr. Norris F. Schultz, 269 "D" Street - in accord with rest of nearby
residents protesting the variance.
Mr. Gabriel Olijnek., 255 I'D" Street, also purchased property because of
the view.
Most of the above mentioned property owriers were signers of the petition
presented to the Planning Commission and read by City Planner. Wagner, protesting
the granting of a variance on the parcel in question.
Attorney Atherton stated he did not feel that there is sufficient commer-
cial zoned property in Chula Vista, considering its growth in population.
Chairman Wulff expressed his desire to appoint a committee, with City
Planner Wagner to prepare a study of the area zoned R-1 to determine its best use.
It was moved by Member DreTPa, seconded by Member Stewart, and carried, that
the variance be denied because the findings by the Commission indicate the
variance would not conform to the requirements showing exceptional circumstances,
necessity for preservation of property-rights of the applicant, and be materially
detrimental. to the public welfare.
Chairman Wulff appointed a committee to investigate further the matter
of R-1 zoning with Member Smith as Chairman, Member Drew and City Planner Wagner.
Billie Evelyn Cravaack' 190 Brightwood Avenue, requests permission to provide
three off-street parking spaces in front of the setback area of 19 feet. Member
Drew stated that the ordnance does not provide for location on the lot require-
ments for off-street parking. The question of curb breaks must be OK'd by the 4
Director of Public Works.
It was moved by Member Drew, seconded by Member Stewart, and carried' that
the Planning Commission, in considering the request for variation, find that all
provisions of the ordinance have been complied with.
Myron J. Dalseth, 510 Third Avenue, requests permission to convert present
residence into doctors' offices and make additions to same in an R-3 zone. Mr.
Dalseth was present, and when the question of signs was discussed,

it was agreed that they not exceed five square feet. Member Drew added that
the use to be put to this building must be restricted to that of doctorst offices
or clinic.
It was moved by Member Smith, seconded by Member Stewart, and carried' that
the use variance'be approved for the reasons--stated in the application, and that
the setback variance be denied.
Clyde V. Smith, 119 Minot Avenue' requests permission to construct carport
and breezeway from front door as a type of marquee, that will extend 6 feet into
front setback area. It was moved by Member Smith, seconded by Member Stewart,
and carried, that the variance be granted for the reasons stated in the appli-
cation.
APPROVAL OF LOT SPLIT
Mrs. May 114. Grube, 116A Corte Maria, requested approval of lot split with _
less than 50 ft. frontage. It was moved by Member Poulter, seconded by Member
Stewart, and carried, that -applicant be permitted to subdivide the parcel of
land as shown on the plot plan on file with the Commission, and that the applicant
be further permitted to sell Parcel "A" to construct a single family dwelling
on Parcel "B", which has a 15 ft. frontage on Corte Maria, which it is anticipated
will be dedicated as a public street, and, further, that in the event such street
is not dedicated, the applicant be permitted to build on this property which
fronts on the easement now known as Corte Maria,
TENTATIVE MAPS
Vista Del Mar - Leonard R. Morgan for'B.H.F. Smith, 111 Third Avenue.
(R 1 zone for 1251 and remainder R-3 zone). It was moved by .Member Smith,
seconded by Member Stewart, and carried, that the tentative map be approved,
subject to easements either on Lot 4 or Lot: 5 for utilities, and subject to
the approval of the Engineering Department.
Francine Park No. 2 - Henry Algert for C.C. Alley Realty Co. - 4 lots
oil -`she south side of "F't Street in an R-1 zone.
It was agreed by the Commission to lay this matter over until the meeting
of June 1, 1953' pointing out the following:
1. 50-ft. streets. - -
2. The question of facing the lots must be determined.
3. Have adjacent property owner shove his intentions at this time.
Margo Tract - Henry Algert for Margo Builders, Inc. - 22 lots on ap-
proximately acres west of Hilltop Drive and north of Hilltop School in an
R-1 zone. It was moved by Member Stewart,-- seconded by Member Drew, and carried,
that the tentative map be approved with the requested 10 ft. setback on Murray
Street.
Judson Tract - Henry Algert for 17.0. Smith - 66 lots-in approximately
15 acres lying southerly of "J" St, and east of Hilltop Housing Project. This
subdivision is now in the County and would have to, be annexed. It was moved
by Member Stewart that the tentative map be approved, subject to City P7an_nerts
check sheet being run and, also, subject to .Engineering Departments approval;
_�oyrever, the motion failed for lack of a second.

It was moved by Member Drew., seconded by Member Poulter., and carried.,
that the matter be postponed., pending further study, as requested by City
{ Planner Wagner.
DEVISED FINAL MAP - Roseview -' Harold Foster for L. C. Brewer.
In accordance with the request made by the applicant to City Planner
7fagner., this map was vrithdrawm.
ZONE VARIANCE REQUEST
Lee and Quintera Sartina, 510 Jefferson Street, requested an interpre-
tation of.the zone ordinance with regard to housing an ambulance in their
garage to,=accept and answer emergency calls 24 hours a day in an R-3 zone.
The principals agreed not to open up siren until the ambulance reaches
National Avenue., which is approximately 3 blocks away from their residence.
It was moved by Itember Smith, seconded by Member Stewart, and carried' that .
the Planning Commission interprets Section 8A10 of Ordinance 398 as per-
taining to ambulance service as incidental to hospitals, sanitariums and
physicians.
REPORTS
Committee on Central Business District. Member Drew stated he would
prefer to take up this matter at the next mid-month meeting.
U.S. Highway 395 Connection with International Border. City Planner
/ Wagner reported that the nviispapers carried the story as it was presented on
the Assembly floor. In addition, Assemblyman Cloyed stated that the strength
of the Los Angeles ,group was too great for San Diego, said group lining up
votes 43 to 12., defeating the amendment to add U.S. Highway 395 Extension to
the Mainline Highway bill. If any one group could succeed in breaking into
the original bill., all groups would have a chance on all mainline highway
bills., was expressed as the reason for the defeat.
City Planner Wagner informed the Commission that Del AMdr Chamber of
Commerce recently passed a resolution that this proposal be considered and that
it extend from Leucadia to 395 and then doom to the border as a 101 by-pass.
El Cajon favors a highway passing through. Escondido and El Cajon.
Assemblyman Ralph Cloyed still feels that there is a chance of getting this
bill through eventually, particularly since the County of San Diego does not get
its share of gas tax monies and has spent its ovm money in the past. For this
reason, he felt that the Sari Diego area should get some creditable allowance from
the Alvarado Canyon Freeway, as it is intended to relieve Highway 80.
Economic Survey on Great Northwest Congress, City Planner Wagner dis-
tributed copies of a survey made by Mr. Charles H. Young, consulting engineer,
advocating the expenditure of $50.,000 for finding a low level arterial to the
east. The survey would cover not only a low level route., but future development
of the bay as well. The San Diego Highway Development Association is now pre-
paring a resolution to be distributed to various cities covering this subject.
City Planner Wagner prepared a resolution asking the County to provide funds for
this work and contacted private groups to the east., but will wait for the uniform
resolution for presentation to the Commission, the Chamber of Commerce., the
Harbor Commission and the City Council.

Member Stewart informed the Commission that he had occasion to call on Mr.
West of the State Highway Office and discussed access to the Montgomery Freeway
at "J" Street, which was State approved in 1947. Member Stewart suggested draw-
i� ing up evidence and requested that the question be retained' as it might be given
consideration.
Chairman .Wulff suggested the item might be put in the agenda for the next
meeting for resolution in recommendation to the Council so that it can be brought
to action. Member Poulter suggested City Planner Wagner bring -the Commission
up to date on what Major -l.oyd's plans are for the future use of gas tax money.
SUM14ARY
Chairman Wulff requested that Member Smith meet with Member Drew and City
Planner Wagner in the R-1 area at "C" Street and Third Avenue Extension and
report the results of their findings -to the Planning Commission on their meeting
of June 1, 1953.
Member Stewart1s suggestion regarding "J" St. that City Planner Wagner
talk with Mr. West of the State Highway Department and also that the City
Planner ask Major Floyd to be present at the next meeting.
Chairman VA 1ff pointed out that his term of office will expire in the
near future and asked that he not be reappointed.
