OF THE PLANNING COMMISSION OF THE CITY OF

Held Monday, July 6., 1953
The Planning Commission met in the Council Chamber at the Civic Center
on the above date at 7:30 P.M. with the following members present: Wulff,,,
Longworth, Drew and Smith.
Absent: Members Stewart, Poulter.
Also Present: City Planner Wagner and Assistant-to City Engineer,, Johnson,
APPROVAL OF MINUTES
It was moved by Member Drew, seconded by Member Smith, and carried, that
the minutes of the meeting held June 15, 1953, be approved"
ZONE VARIANCES
Wilford E. Christoffersen, 615 Chula Vista Street,, requests approval for
a building permit on a lot 0 x 108.37 fte in an R-3 zone. Mr. and Mrs.
Christoffersen, who were present, .stated that they planned,, at time of pur—
chase (1951),, to build a rental unit on the site as soon as the property was
clear. They added that the distance between buildings is 38 ft. 10 inches,
Chairman Wulff felt that the property (in an R-3 zone), in spite of not
having the required minimum 6000 square footage, is not being used to best
advantage.
I It was moved by Member Drew, seconded by Member Smith, and carried, that
the variance be granted' subject to provision of adequate off—street parking
for rental units.
John D. McCausland, M.Di, 261 to 263 "F" Street, requests approval to
convert first floor apartments of building at this site into professional
and medical offices.
It was explained that this block is divided into C-1 and R-3 zones. The
property for which variance is requested is flanked on both sides by pro—
fessional offices.
Dr. McCausland, who was present, explained that he plans, for the present'
to convert the two front apartments on the first floor and at a later date,
possibly,to convert the two rear apartments on the first floor.
Present in protest was Mrs. Allan G. Olson of Bonita, ovmer of properties'
on Third Avenue in Chula Vista. She stated that she considered zone variances
unconstitutional; also that she did not believe it fair to permit commercialism
in a residential zone, thus taking advantage of lower taxes while those owning
properties in commercial zones pay higher taxes. In addition, Mrs. Olson asked
for clarification of "professional offices". In answer, Chairman Wulff informed
Mrs. Olson of- the Commissionts studies of and future recommendations for zoning
"F" Street east to Del Mar for commercial use. The Commission's members felt
--� that "professional offices" would include' dental9 medical, architectural, law
and similar offices.
It was moved by Member Smith, seconded by Member Longworth., and carried,
that the variance be approved for the reasons stated in the application.
E. C. Teer, 103 Shasta Street, requests approval to be allowed to keep a
54 inch high fence in violation of -setback requirements on First Avenue. Mr.
and Mrs. Teer were present. Mrs. Teer stated that the whole idea was mis-
represented and no understanding was put in writing. She asked for leniency
until her six months' old child grows up sufficiently so it won1t fall into
the gulley. Applicant deblared that moving the fence back would cut off the
back yard., as the kitchen steps are toward the front of the house.
Oity Planner Wagner read report from City Building Inspector Cord.
Mr. Teer stated that, at such time as First Avenue is widened, he would
be willing to move the fence back. Member Longworth suggested that City
Planner Wagner verify the measurements and possibly come up with a suggestion
as to how the fence might be moved back four feet.
It was moved by Member Drew, seconded by Member Longworth' and carried,
that the matter be tabled pending further investigation and verification of
measurements by City Planner Wagner, and report back to Commission at the first
meeting in August, 1953.
LETTERS
1,4organ Skinner, M.D., 709 Third Ave., requesting permission to submit
amende application for zone variance, in order to extend the time limit for
'J his application for zone variance.

It was moved by Member Drew., seconded by Member Smith, and carried, that
a 90 day extension be granted, and that additional application fee be waived.
L. E. Curren, ItOaK. Rubber Welders"., 919 National Avenue, requested inter-
pretation of Section 11-A-25 of Ordinance No. 398. City Planner Wagner read
the zoning ordinance covering M-1 use and-pointed out that it does not now
cover tire recapping specifically, but the Commission agreed it was closely
allied to other types of businesses already covered, and therefore should fall
in this classification.
Lot 4 of this plot falls in the R-1 zone; Mr. Curren debelared., however., that
he intends to 'surface and use this lot for parking cars only. City Planner
Wagner volunteered the information that, to date, 6510 of the property owners
nearby had agreed to petition for lifting,the restrictions in the area between the
M-1 and R-1 zones. Assistant to City Engineer., Johnson, inquired whether or not
electrical tire recapping has an advantage over other methods of recapping as far
as odor-etc., are concerned. Mr. Curren replied it is far superior.
The Commission pointed out that two issues are at hand: (1) Whether or not
tire recapping falls in the M-1 classification and (2) whether or not resurfacing
Lot 4 and using it for a parking area is permissible in an R-1 zone.
It was moved by Member Drew, seconded by Member Smith., and carried, that the
Commission is of the opinion that electric tire recapping falls within M-1 zone
classification and that the matter of Lot' 4 in the R-1 zone is covered by deed

restriction.
Sam Shapov, 344 "C" Street, requests favorable recommendation for annexation
of 20 acres to be -developed for- large shopping center at northeast corner of
Highland Avenue and. ."C" Street
It was City Planner Wagner,s suggestion that the Telephone Company, which has
adjacent property, be notified of the intention to annex the Shapov property to
the City of Chula Vista and perhaps the company,would be willing to annex at the
same time.
Mr. Dreifuss, son of the applicant, stated that it is their intention to
follow the same drainage- channels that now exists in developing the property. When
the matter of again contacting nearby property owners came up, City Planner Wagner
pointed out that whether or not the area is annexed, the said property owners
would still look down on this supermarket, as the applicant,intends to proceed
regardless of whether the plot is in the County or the City of Chula Vista. (The
plot is zoned for commercial in the County) .
Member Smith suggested that the City Planner study the possibilities of
annexing the whole strip. Member Drew added that it might be possible to get
together with National City and annex the'irahole valley. City Planner Wagner
stated that he would not recommend that the Shapov Annexation be held up pending
further study.
It was moved by Member Drew, seconded by Member Longworth, and carried,
that the Planning Co:mnissi.on recommend to the City Council the annexation of
` the 20 acres for proposed C-1 zoning with the reservation that any drainage
.� and contouring on this site be subject to approval of the Engineering Depart-
Pent and, also, that Mr. Shapov dedicate to the City the north, half of "C"
Street from the southerly portion of the property and improve the 400 feet in
front of the proposed market development.
RECO1411ENDATION FROTM CITY COUNCIL
The Commission was presented with a copy of a City Council resolution pur-
suant to Section 7 of Ordinance No. 377 (subdivision ordinance) requiring street
name signs and ornamental trees be installed by subdividers.
City Planner Vfagizer read the resolution drawn up .covering this matter.
It was moved by blember Drew5 seconded by Member Longgorth, and carried,
that the resolution be recommended for adoption by. the City Council.
DISCUSSION
Proposed rezoning in County. City Planner Wagner advised the Commission
that San Diego County has been officially requested to rezone a portion of
Harborside Unit No. 2 from R-2-B to .M-2 to allow salvage operations, and that
the matter would come before the San Diego County Planning Commission at their
July 24 and August 14 meetings.
It was moved by Member Smith, seconded by Member Longworth., and carried,
+ -that protest be filed with County Planning Commission, with a copy to the Chula

Vista Chamber of Cor nerce.
RESUBi5ISSIO-N Or TENTATIVE MAP - Judson Tract
At the request of the City Council, the subdivider changed the 60 foot lots
to 70 x 100 feet, with 60 foot streets, simi_7..ar to Country Club Villas, and sub-
mitted -revised tentative map accordingly:.
It was .roved by Member Smith, seconded by Member Longworth, and carried,
that -revised tentative map be recornnended to the City Council for approval with
the following conditions: (1) Lot X10 be deeded to the City with the condition
that the City will use the site for a street within ten years. (If not used
for this purpose i,,rithin the allotted time, Lot X10 would -revert to the original
subdivider) ; (2) That 50-foot street connections between Gretchen Road and Dennis
Avenue at the south boundary of the subdivision, be installed; (3) That one foot
lots along the south side of "K" Street and along the east line of 11K" Street
be dedicated to the City; and (4) that the Planning Commission favors annexation.
The motion failed to carry by the following vote, to 11it:
AYES: Members Wulff, Longworth, Smith.
NOES: Member Drew,
ABSENT: Members Stewart and Poulter.
Member Drew voted "No" for the reason that he opposes the annexation. Chair-
man Wulff suggested that City Planner Wagner read the Ordinance regarding -Mnether
or not a 4 vote majority is necessary for approval of tentative maps.
r� It was agreed that the attention of City Council should be called to the fact
1 that only 4 members of the Commission were present and the majority favored the
annexation and the matter should therefore be considered accordingly.
The motion failed to carry for the reason that it did not receive the af-
firmative vote of a majority of the entire membership of the Commission (Charter
Section 604),
Proposed New Zoning Ordinance. City Planner Wagner informed the Planning
Commission that the supe y o zoning ordinances was depleted and that it would
be necessary to either have a reprint of the old ordinance or to write a new
ordinance, which he favored. He further stated that he was making a list of
corrections and revisions and had -remembered that the Commission Members had
agreed to do likewise and that he would welcome their suggestions on the re-
vision of the writing of a new ordinance, The City Planner showed a copy of
the excellent Pasadena Zoning Ordinance and outlined some of its desirable
features. The Commission members requested City Planner Wagner to secure
copies of each member of the Commission for their study.
City Planner Wagner informed the Commission that he had been invited to
attend the meeting of the National Avenue Businessmen's Ass'n., at which time
zoning for National Avenue mould be discussed. He felt that conference with
these people would be of tremendous value to the Commission.

Master Street Plan. City Planner Wagner outlined the progress to date of
1 Engineering studies on the Master Street Plan and read Engineering estimates
on the cost of i_rmroving four routes to connect "Ell Street and Bonita Road and

'. stated that the Engineering Staff would have the cost estimates for First Ave.
Extension and "L" Street Extension already by the next meeting. He read a report
on highways and the responsible agencies that he had pi�epared for the Commission
and each member of the Commission requested a copy for their studies.
He further informed the Commission that the -firm of Engineers Service Corpora-
tion of Los Angeles had been authorized to fly the City and prepare the aerial
topography maps which frill be ready in about 60 days.. -These maps will be of
tremendous_ value to the Commission and their Master Street and Local Street
Planning.
City Planner Wagner read a letter to the Commission from lt4r. H. V. Bryant'
expressing his appreciation of the Commissionts interest and part in the farewell
dinner in his honor, and for the nice gifts,
Meetings. As the Commission had eliminated the necessity for the second
meetings for months of July and August, during the year 1953, this matter was
again discussed as a policy for the year 1953.
It was moved by Member Longworth, seconded- by'Member Smith, and unanimously
carried, that the Planning Commission dispense with the second meeting in the
months of July and August, 1953, and to resume the regular two-monthly meetings
in September.
