HomeMy WebLinkAbout1952-02-04 PC MINS MINUTES OF A REGULAR MEETING OF THE PLANNING,COr8v4ISSION OF THE CITY OF CHULA VISTA, CALIFORNIA Held Monday., February 4, 1952 The Planning Commission met in the Council Chamber on the above date at 7:30 P.14. with the following Members present: Drew, Ramage, Stewart, Halferty, Poutler. Absent: Members tiuulff, Smith. Also Present: City Planner Wagner, City Attorney Boyer, Asst. 'City Engineer Wheeler. In the absence of Chairman Wulff, the Secretary called the meeting to order and asked for nominations for a Chairman pro tempore. It was moved by Member Stewart, seconded by Member Drew, and carried, that Member Poulter be appointed Chairman pro tempore during the absence of Chairman Wulff. Member Poulter thereupon assumed the duties of Chairman pro tempore. APPROVAL OF MINUTES It was moved by Member Stewart, seconded by Member Drew, and carried, that the minutes of the meeting held January 21, 1952 be approved, copies having been mailed to the Members. PUBLIC HEARING - Resolution No. 20, Amending Ordinance No. 398• The Planning Commission held the first Public Hearing on amendments to Zoning Ordinance No. 398. There was a large audience present, and the discussion was as follows: I Area from Flower St. to "I" St. Mr.- George Kotitsa stated that there were plans in progress for an R-3 subdivision, and that he would like to see the rezoning go through. There were no objections, either oral or written. Area North of "ll" Street. No objections, eitheroral or written. Area North of Flower St., Between Flower St. and "D" St. There were no objections, either oral or-written. Area Between "C" St. and "D" St. and Between Fourth Ave. and Fifth Ave. Mrs. Surrell stated that she would like to have the South side of "D" Street in the 400 b167ck remain in an R-1 zone. Mr. F. K. Thom stated that he would like to have the corner of Brightwood and Flower Sts. remain in an R-1 zone.. Mr. P. E. Seeley inquired whether there would be any restrictions on the size of dwellings erected in an R-3 zone, and stated that he objected to having the area re- zoned. Mr. Dobson stated that he would like to see Guava Ave. at "D" St. remain in an R-1 zone. r -2- Mr. Floodberg stated that he had no objection to an R-3 zone and inquired whether the size of the dwelling could be restricted. He was advised that any restriction would have to be imposed by covenants of the property owners. Mrs. Beech stated that she had-no objection to an R-3 zone. Mr. Landsifey inquired whether a subdivider could have restrictions put in a deed as to the size of dwellings. He was advised that it would be permissible. Dr. Stadin inquired whether the area on the east side of Fourth Avenue could be placed in an R-3 zone. He was advised that at present such a change is not contemplated. Mrs. Dobson stated that she does not object to an R-3 zone across the street from "D" St. and Guava Ave. Mr. H. H. Surell wished to know if the proposed zone changes would supercede covenant or deed restrictions against R-3 uses. He was'advised that the City has no jurisdiction over deed restrictions and that covenant or deed restrictions would. remain binding upon the property owners as private contracts. Mr. Slipok, representing the Ajax Crate Co., stated that he objected to changing from M-2 to R-3 in the area south of "F" Street, but that he would not object to an 'M 1 zone. Mr. Henderson stated that he would like to have the M-2 zone remain in the area north of "F St. along the railroad right-of-way. Mr. Frye, representing the S.D. and A.E. Railroad, stated that the railroad would like to have the triangle of land bordered by their tracks at "F" St. remain M-1 if Mr. Slipok's and Mr. Henderson's property is to remain M-1. Amending Building bine Map There were no objections, either oral or written. Garage or Carport Required in R-2 and R=3 Zones. Mr. Smith stated that he felt that an unnecessary hardship would be worked on people to require them to build garages or carports. Mr. Tyson stated that he would like to object because in many cases people do not have cars. He stated that if the Resolution was amended to read "improved off-street parking" he would have no objection. Mr. Herb Tompkins stated that he felt that. the words "and/or off-street parking" should be inc uded in t e proposed Ordinance. Filing Fee for Zone Variances Increased. No-objections, either oral or written. No Action by Commission Shall be Void Because of Improper Letter or Postcard Notification. No objections, either oral or written. Lapse of Granted Variance. Mr. Herb Tompkins stated that ..he did not feel that six months wasa long enough time, and suggested that, it be changed to one year. Rear Yard Requirements in R-2 and R-3 Zones. No objections, either oral or written. " Rear Yard Requirements in C-1, C-2, M-1 and 1.4-2 Zones. No objections, either oral or written. -3- Off-Street Parking for Commercial and Industrial Buildings.. S Mr. Maurice Hooper stated that he objected to the parking requirements at "E" and "F" Streets on the east side of Third Avenue, and that he felt that it defeated the purpose of the alleys. Member Halferty stated that he opposes the requirement as far as business is concerned. Mr. E. A. Logan stated that he wished to object to the requirement. Mr. Herb Tompkins asked whether the requirement would affect the remodelling of existing buildings. Mr. Larry Kuebler stated that he did not see why the taxpayer 'should be asked to provide parking from general funds for businessmen down town. Member Halferty stated that everyone benefits from off-street parking, not only the businessmen. 'halter Davis stated that through parking meters the public which uses off-street parking pays the cost. Member Drew stated that he believes the Ordinance is unfair to property owners and will be until such time as parking space will be provided by the businessman, and that for that reason he would oppose it. - Mr. Prescott stated that he wished to object to the size of parking lots for churches. Mr. Greenwall stated that a parking lot for a church would only be used extensively on Sunday morning, and that he wished to object to such a requirement. There was no one else in the audience who wished to speak, so Chairman Poulter called the Public Hearing closed, and announced that the second Public Hearing will be held on Monday, February 18, 1952 at 7:30 P.M. TENTATIVE MAPS Vista Real - Harold Foster. It was-moved by Member Drew, seconded by Member Stewart, and carried, that the plan which was approved on the 7th of January be approved, and that the amended plan be rejected. Copies of each plan were retained by •the Commission. Loma Alta Park - Henry Algert. It was moved by Member Halferty, seconded by Member Stewart, and carried, that the Tentative Map be approved with the following changes: provided that the centerline radius at Elm Ave. and Lardsley Way be increased to 100 ft., or that adequate widening be provided in the intersection. 3 Verde Park No. - Harold Foster. It was moved by Member Halferty, seconded by Member Ramage, and carried, that the Tentative Map be approved with the following changes: that permit be granted to reduce the size of the lots. to 6,760 sq. ft., and that a Grant Deed be given to the City for a 30 ft. half width street along the southerly boundary of the sub- division, and that the subdivider pay into the General Fund a sum equal to the City Engineer's estimate of the cost of installation of sidewalks, curbs, gutters, paving and excavation for such half street for use when and if the City developes the same. FINAL MAPS Kuebler Terrace No. 6 - Harold Foster. It was moved by Member Stewart, seconded by Member Ramage, and carried, that -4- the Final Map of Kuebler Terrace No. 6 be approved. Wesley Park No. 2 - Harold Foster. It was moved by Member Stewart, seconded by Member Drew, and carried, that the Final Map of Wesley Park #2 be approved. Canasta Terrace - Harold Foster. It was moved b Member Ramage, seconded b I Y g , y Member Stewart, and carried, that the Final Map of Canasta Terrace be approved and recommended to the-City -Council for approval as modified by the City Engineer as indicated on the maps signed by the Chairman. i APPROVAL OF TRAILER PARK = 350 National' Avenue. On motion of Member Stewart, seconded by Member Ramage, and carried, it was Resolved that the use of land described in the application of William 0. Smith for a trailer park according to the plot plans and application, be approved. It was noted that J. H. Harris, State Housing Inspector, the County Health Inspector, and the City Building Inspector had approved the plans. ZONE VARIANCES r Robert E. Tyson, d Bonita Rd., requested permission .to enlarge existing old . garage located less, than 0 feet from street. It was moved by Member Stewart, seconded by Member Ramage, and carried, that the variance be granted for the reasons stated in the application, providing the expansion of the existing garage is not nearer than three feet from the side property. line. Claude Yager, 3342 Del Mar Ave., requested a variance to allow developing and printing of photographics in an R-3 zone,, so that he might renew his business license. It was moved by Member Drew, seconded by Member Stewart, and carried, that the variance be granted for the reasons stated in the application, until January 1, •1955. Dewey H. Wallace, 363 "A" Street, requested a variance to operate a spare time business in reloading ammunition and occasional sale of sporting• goods in an R-3 zone. It was moved by Member Halferty, seconded by Member Stewart, and carried, that the variance be granted for the reasons stated in the application, until January 1, 1955• Charles T. Brindell, 556 Glover Avenue, requested a variance to continue operating a radio and television repair shop in a residence in an R-3 zone. It was moved by Member Halferty, seconded by Member Stewart, and carried, that the variance be granted for the reasons stated in the application, until January 1, 1955. William F. Stillwell, 221 "I" Street, requested a variance to allow the reduction of rear yard from ft. to 1 .5 ft. in an R-3 zone. It was moved by Member Halferty, _ seconded by Member Ramage, and carried; that the hearing on the application be con- tinued until a future meeting in order that the applicant might be present to further explain his plan. APPROVAL OF TRAILER PARK - 181-187 Jefferson Ave. On motion of Member Ramage, seconded by Member Stewart, and carried, it was -5— Resolved Resolved that the use of land described in the application of Berger Indseth for a trailer park according to the plot plans and application, be approved, provided that the conditions-attached to"the zone variance be performed., and further provided that . e the 20 foot widening of .Jefferson Ave. be improved with sidewalks, curbs and gutters to the satisfaction of the City Engineer. ADJOURNMENT It was moved by Member Drew, seconded by Member Ramage, and carried, that the meeting adjourn until Monday, February 18, 1952. an C. Steele, Secretary
