OF THE PLANNING COMMISSION OF THE CITY OF
` CHULA VISTA,, CALIFORNIA
Held Monday, October 1, 1951
The Planning Commission met in the Council Chamber at City Hall on the above
date with the following Members present: Wulff, Ramage, Stewart, Poulter, Smith,
Drew. Absent: Member Halferty. Also Present: City Planner Wagner, City At-
torney Boyer, Asst. City Engineer Wheeler.
APPROVAL OF MINUTES
It was moved by Member Poulter, seconded by Member Stewart, and carried, that
the minutes of the meetings held September 4 and 17, 1951, be approved, copies
having been mailed to the Members.
TENTATIVE MAP - Zurcher Tract #2 L Henry Algert
It was moved by Member Poulter, seconded by Member Stewart, and carried, that
the tentative map of Zurcher Tract #2 be approved with the provision that there
be a 40 ft. grant on First Avenue instead of the 25 ft. as shown, and that the lots
contiguous have at least 7,000 sq. ft.
ZONE VARIANCES
Mr. Fred Wilson, 421 J Street, requested a variance to allow the construction
of two houses on lots having less than the required 7,000 sq. ft. At the hearing,
Mr. Wilson amended his request to request permission to extend Guava Avenue
through to J Street, thereby giving him three lots. No street improvements were
to be made on this extension. After a discussion with the Members, Mr. Wilson
withdrew his amended request in favor of the decision made by the Planning Com-
mission, at the meeting of July 16, 1951. (See minutes. )
Dr. John D. McCausland, Lots 42 and 43, Dyer Tract, requested a variance to
allow an lb ft. rear yard instead of the required 2 ft. for the construction of
a two-story six unit apartment building. At the hearing, Dr. McCausland amended
his request to include a variance for a front yard setback of 5 feet to line up
with the building to the west. It was moved by Member Smith, seconded by Member
Ramage, and carried, that the amended variance application for the front yard to
be decreased to 5 ft., be granted.
Mr. H. B, Caldwell, 165 Second Avenue, requested a variance to allow the
erection of a duplex in an R-2 zone. It was moved by Member Drew, seconded by
Member Stewart, and carried, that the request be tabled, and that the plan, as
presented, be further studied, and that/the City Planner be authorized to contact-
property owners in the vicinity on their ideas and thoughts on the matter.
FINAL MAP - Bay Vista #3 - Henry Algert.
It was moved by Member Poulter, seconded by Member Stewart, and carried, that
the Final Map be approved, as presented. Member Drew voted "No" on the motion,
because there are four streets in the block, and because the lots are, in his
opinion, too shallow.

ZONE VARIANCES
Mr. C. IV. Dunkelberger, 154 Brightwood Avenue, requested a variance to allow
the erection of a garage with apartment above, 5 ft. from the rear property line.
It was moved by Member Smith, seconded by Member Stewart, that the variance be
granted for the reasons stated in the application. The motion failed to carry by
the following vote, to-wit:
AYES: Members Stewart, Smith, Poulter.
NOES: Members Ramage, Drew, Wulff.
ABSENT: Member Halferty.
After a discussion, 'in which Chairman Wulff requested that City Planner
Wagner make a study of the required rear yard in R-3 zones with a view to possible
change, it was moved by Member Stewart,. seconded by Member Smith, that the re-
quest be granted, providing the rear yard have a setback of at least 10 ft. The
motion was carried by the following vote, to-wit.-

NOES: Member Drew.
ABSENT: Member Halferty.
Mr. William N. Armstrong, 188 Minot Avenue, requested a variance to allow an
existing car port to remain 3 ft. from the side property line. Mr. Armstrong ap-
peared at the meeting and stated that he had been issued a building permit for
the car port. It_was moved by Member Poulter, seconded by Member Ramage, and
carried, that the matter be tabled until the next regular meeting, pending fur-
ther action from the Building Department. Member Drew, amended the motion to
include that the Building Inspector give a report on the matter for the next
meeting. The amended motion was seconded by Member Smith,-, and carried.
1&. A. L. Simas, 388 K Street, requested a variance to allow construction of
multiple units in an R-1 zone. It was moved by Member Drew, seconded by Member
Poulter, and carried, that the City Attorney be instructed to draw up and present
a proposed resolution in conformity with the Zoning Ordinance allowing the
variance.
Miss M. Patricia Humphreys, 205 H Street, requested a variance to allow a
real estate o face in a residence and the erection of an advertising sign in an
R-1 zone. It was moved by Member Stewart, seconded by Member Smith, that the
application for the operation of a real estate business and erection of a sign, in
compliance with the State Real Estate law, be approved. ?dem_ber Drew stated that
he would vote "No" on the matter since he feels that no business should be con-
ducted in an R-1 zone. The motion failed to carry by the following vote, to writ:
AYES: Members Smith, Stewart, Wulff.
NOES: Members Drew, Poulter, Ramage.
ABSENT: Member Halferty.
Mr. William A. Sangster, 739 Twin Oaks Avenue, requested a variance to allow
the construction of an -unit bungalow court in an R-1 zone, with a rear yard of
22 ft. instead of the required 25 ft. There were several adjacent property owners
in the audience who protested the variance, together with a petition signed by
eighteen other property owners protesting the granting of the variance. It was
moved by Member, Poulter, seconded by Member Stewart, and carried, that the request
for the variance be denied.

Mr. P. J. Balestreri, 575 Second• Avenue, requested a variance to maintain
an existing fence in violation of a 15 ft. setback. Mr. Balestreri was at the
hearing and stated that he had obtained a building permit from the Building
Department for the fence. It was moved by Member Drew, seconded by Member Smith,
and carried, that the matter be tabled until the next regular meeting, and that
a report be requested from the Building Inspector on the matter.
Mr. George F. Fogerty, 184 National Avenue, requested a variance to allow the
construction and operation of a trailer park in an M-1 and R-3 zone. It was
moved by Member Smith, seconded by Member Stevrrart, and carried, that a variance
be granted on the rear of 164 National Avenue for this M-1 use in an R-3 zone.
Member Drew did not vote on the question.
Mr. Raymond .L. Burg, 163 G Street, requested a variance to allow the construc-
tion of a guest house, with kitchen, in an R-1 zone. It was moved by Member Poulter,
seconded by Member Stewart, and carried,. that a variance be granted for a guest
house, 'with no kitchen, .on a lot having less than the required 8,000 sq. ft.
Mr. .Stanely N. Myers, 50 Minot Avenue, ,appeared before the Commission to re-
quest a zoning definition regarding privately owned horses to be pastured and
boarded in the R-1 zone. The question presented was'whether it was an agricul-
tural use permitted by the Ordinance. It was decided to table the matter until
the meeting of October 15, 1951.
ADJOURNMENT
It was moved by Member -Poulter, seconded by- Member Smith, and carried, that
the meeting adjourn until Monday, October 15, 1951.
